What the Twilio Class Action Lawsuit Alleged
Twilio sells Segment, a software development kit that app makers build into their apps to collect usage data. In Bender v. Twilio Inc., filed on August 8, 2024, a user of the Calm meditation app alleged that Segment captured his in-app search terms, keystrokes, button presses, page views, name and email address without his consent.
The complaint alleges more than 11,000 app developers had integrated Segment. It also alleges that Twilio combined the data into profiles. It pleaded violations of the federal Wiretap Act, the California Wiretap Act and California's Comprehensive Computer Data Access and Fraud Act. It sought damages, an injunction and a jury trial. These are allegations; no court ruled on whether they were true.
Case Details
Bender v. Twilio Inc., No. 3:24-cv-04914, U.S. District Court for the Northern District of California. In an order issued August 11, 2025, the court allowed Twilio to enforce Calm's arbitration agreement as a third-party beneficiary, because the claims were intertwined with the app's terms of service. In practice, the dispute left open court and went to individual arbitration.
A separate Twilio lawsuit, Anthony v. Twilio Inc., No. 3:24-cv-02999 (same court, filed May 17, 2024), is a Telephone Consumer Protection Act claim over robocalls and robotexts. Commentators noted at filing that it is an individual suit, not a class action.
Status: No Twilio Settlement, No Claim Form
The Anthony TCPA suit is one person's claim, not a class. We found no class action over the 2022 or 2024 Twilio data breach incidents. If a real Twilio settlement is ever approved, it will have a court-appointed administrator and a notice that names the case number.
Who Was in the Proposed Class
The Bender complaint proposed a nationwide class: everyone who used a mobile app with Twilio's Segment SDK built in, where the app did not name “Twilio” in its notices. It also proposed a California subclass. No class was ever certified, so nobody is a class member today.
If you saw an ad mentioning “Twilio”, it is not a court-approved settlement you can claim from, because none exists. Intuit's own cases are covered on our TurboTax class action lawsuit page.

How cases like this one end
Our copy of the federal courts’ own case database covers 111,990 other personal injury casesclosed in U.S. federal district courts between 2015 and 2025, 3.6% of them filed as class actions:
- 39.9% ended in a settlement recorded by the court. Another 13.8% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 39.9% and 53.7%.
- 5.7% were decided on a motion before any trial.
- 1 in 106 reached a trial (0.9%), after a median of 23.9 months.
- Median time from filing to the end of the case: 9 months.
- Only 771 of them (0.7%) record a money award at all; the median of those is $500,000.

Three Things to Watch For
Twilio's name is on billions of texts, and that makes it an easy cover story:
“Claim your Twilio settlement” pages
There is no Twilio settlement and no claims site. A page asking for your Social Security number or bank details to “release your payment” is collecting data, not filing a claim.
Texts pretending to be your 2FA provider
Twilio itself warned that leaked Authy phone numbers could be used for smishing. A text asking for a verification code or password is the attack, not a lawsuit notice. Twilio says it never asks for that information outside twilio.com.
Sign-up forms sold as “joining the class”
Any ad offering to put you in a Twilio “class” is not a court-approved settlement: no class was certified. If it asks you to sign up as a law firm's client, that is a contract, not a settlement claim. Read the fee terms before you sign.
Twilio Lawsuit — Questions People Actually Ask
Is there a Twilio class action settlement?
No. As of October 2026 there is no Twilio settlement, no fund, no claim form and no deadline. The main Twilio class action, Bender v. Twilio Inc., was sent to individual arbitration on August 11, 2025.
What was the Twilio class action lawsuit about?
It alleged that Twilio's Segment SDK, built into mobile apps such as Calm, collected users' search terms, keystrokes, page views, names and emails without consent. The suit claimed this violated federal and California wiretap laws.
Why do I have to arbitrate if I never agreed to anything with Twilio?
The court found that Twilio could rely on the arbitration agreement in Calm's terms of service as a third-party beneficiary, because the claims were intertwined with that agreement. Other apps have their own terms, so the answer can differ app by app.
Was there a Twilio data breach?
Yes, two incidents. In August 2022, phishing texts to employees led to access to data of 209 Twilio customers and 93 Authy users. In July 2024, Twilio confirmed that 33 million phone numbers tied to Authy had been identified through an unsecured endpoint. Twilio said it found no evidence that attackers got into its systems in that case.
Is there a Twilio data breach lawsuit?
We found no class action and no settlement over either Twilio data breach as of October 2026. If one is filed or settled, the notice will name a court and a case number you can check.
What does TurboTax have to do with Twilio?
We found no source tying the Twilio cases to TurboTax. Bender concerned the Calm app, and no Twilio settlement exists. Intuit's own lawsuits are a different matter, covered on our TurboTax class action lawsuit page.
Can I sue Twilio over spam texts?
Usually the sender is the target, because Twilio is the platform carrying the message. One consumer did sue Twilio under the TCPA in 2024 (Anthony v. Twilio Inc., No. 3:24-cv-02999), alleging he asked Twilio to stop the messages. That is an individual case, not a class anyone can join.
What should I do right now?
Nothing to file. If you use Authy, watch for texts asking for codes and never share them. Be careful with any site offering a “Twilio settlement” payment. To see real deadlines, check our list of open class action settlements.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
