Two different things are behind the searches. The Publix class action lawsuit over sale-item weights at checkout was dismissed by a federal judge on March 10, 2026 and, per court records cited by local news, is on appeal. Separately, individual injury suits followed the GreenWise frozen blueberry E. coli recall. As of October 2026 there is no Publix settlement, no fund, no claim form and no deadline.

What the Overcharge Lawsuit Claimed
The class action lawsuit Publix faced, Koutouzis v. Publix Super Markets, Inc., alleged that the store’s point-of-sale system raised the weight of items sold by weight when they were on sale, so the shopper ended up paying the regular price. The headline example: pork tenderloin on sale at $4.99 per pound (regular $6.99), labeled 2.83 pounds, allegedly rang up as 3.96 pounds. The plaintiff says she paid $19.78 instead of $14.12 — $5.66 more, a 40% overcharge by the complaint’s math.
The suit also alleged expired sale signs left on shelves and incorrect per-unit pricing on baby formula, and claimed receipts hide the problem because they show the savings and total but not the weight. These were allegations; no court found them true.
Case Details
Koutouzis v. Publix Super Markets, Inc., No. 1:25-cv-20767, U.S. District Court for the Southern District of Florida, before Judge Rodolfo A. Ruiz II. Filed February 19, 2025 under the Florida Deceptive and Unfair Trade Practices Act, on behalf of a proposed nationwide class of Publix shoppers. The docket shows the case terminated on March 10, 2026.
The blueberry injury suits are in Florida state court, not federal court: one in Palm Beach County Circuit Court (filed July 13, 2026) and a wrongful death suit against Publix and distributor Quirch Foods in Pinellas County Circuit Court (reported September 25, 2026).
Status: Dismissed, Reported on Appeal, No Settlement
Blueberry suits: active, individual. These are personal-injury and wrongful death claims by specific families, not class actions. Publix told Supermarket News it would be inappropriate to comment on pending litigation.
Publix data breach: as of October 2026 we found no Publix data breach notice and no data breach lawsuit against Publix in a federal docket search. Pages claiming otherwise did not cite a court or case number.
Who Is Affected
Overcharge case: the proposed class was all consumers who bought products at a U.S. Publix store through the alleged pricing practices. Because the case was dismissed before any class was certified, no shopper is part of a class today, and nobody needs to sign up anywhere. If you think you were overcharged at the register, Publix’s own “Publix Promise” is the faster route: per ClickOrlando, if an item scans higher than the advertised price, the customer gets one of that item free.
Blueberry recall: the July 3 recall covered 10-ounce bags of GreenWise Organic IQF Blueberries, lot code 60401, “Best By” Feb. 9, 2028, shipped to Publix stores in eight states. On July 29 Publix widened it to all lots of GreenWise Organic Whole Blueberries and Whole Mixed Berries. Our blueberry outbreak report covers the recall in detail. Anyone made ill would have an individual claim, not a class claim.
Is There Any Money?
The blueberry suits seek damages only for the named plaintiffs — medical bills, lost wages, pain and suffering, and in one case wrongful death. Their outcome does not pay other shoppers. If you bought recalled berries and did not get sick, the remedy is a store refund, not a lawsuit.
How cases like this one end
Our copy of the federal courts’ own case database covers 24,037 other fraud casesclosed in U.S. federal district courts between 2015 and 2025, 27.4% of them filed as class actions:
- 17.3% ended in a settlement recorded by the court. Another 22.5% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 17.3% and 39.8%.
- 10.4% were decided on a motion before any trial.
- 1 in 111 reached a trial (0.9%), after a median of 30 months.
- Median time from filing to the end of the case: 7 months.
- Only 735 of them (3.1%) record a money award at all; the median of those is $663,000.

Three Things to Watch For
High search volume for a Publix lawsuit with no settlement attracts lookalike pages and messages:
“Claim your Publix settlement payout” sites
Several sites publish “payout per person” figures for a Publix settlement. There is none. A page asking for your Publix account login, card number or Social Security number to “file” is collecting data.
“Publix data breach” alerts
We found no Publix data breach notice or lawsuit as of October 2026. A text or email warning that your Publix account was breached and asking you to “verify” your details is phishing until Publix itself confirms otherwise.
Fake refund or recall calls about the berries
Refunds for recalled GreenWise berries are handled at the store. No one legitimate calls asking for your card number or a fee to process a recall refund or to “add you” to the blueberry lawsuits.
Publix Lawsuit — Questions People Actually Ask
Is there a class action lawsuit Publix shoppers can join right now?
No. The overcharge class action was dismissed on March 10, 2026 before any class was certified, and the blueberry cases are individual suits. There is nothing to join or sign up for.
What was the Publix class action lawsuit about?
It alleged Publix’s checkout system inflated the weight of sale items so shoppers paid the regular price — for example, a 2.83-pound pork tenderloin allegedly ringing up as 3.96 pounds. Publix was never found liable.
Why was the lawsuit against Publix dismissed?
The judge found the plaintiff lacked standing: she had obtained refunds for 18 purchases and did not explain why she could not use the refund policy for the rest. The dismissal was without prejudice, and local news reports she has appealed.
Is there a Publix settlement, claim form or deadline?
No. As of October 2026 there is no settlement, no fund, no administrator, no claim form and no deadline in any Publix case we could find.
Was there a Publix data breach?
We found no Publix data breach notice and no data breach lawsuit against Publix in a federal docket search as of October 2026. Treat messages claiming a breach with caution.
I bought the recalled GreenWise blueberries. Am I part of a lawsuit?
No. The blueberry suits are brought by specific people who say they got sick. If you did not get sick, return the product for a refund. If you did, keep the packaging or receipt and your medical records.
How many people got sick from the blueberries?
The CDC’s Sept. 21 update counted 17 ill and six hospitalized, and said the outbreak had ended. It attributed no deaths; the wrongful death suit alleges otherwise for one woman.
I think Publix overcharged me. What can I do?
Raise it at the store. Under the Publix Promise, if an item scans higher than the advertised price you get one of that item free. Checking the weight on the screen against the label is the simplest safeguard.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
