Deyerler, et al. v. HireVue, Inc., Case No. 2026LA00000141, Circuit Court of Lake County, Illinois, Judge Daniel L. Jasica. The claim window for the $3,750,000 settlement over alleged voice and facial biometric collection in Illinois video interviews closed on October 13, 2026. The papers that will decide how far the money stretches are now on the record: class counsel McGuire Law asks for $1,249,875 in fees (33.33%) plus $15,686 in expenses — $1,265,561 in total — and $6,000 for each of the three class representatives. Every approved claimant gets at most $150; money that is not claimed goes back to HireVue. Final approval papers are due October 19, 2026, and the final approval hearing is October 28, 2026, at 9:00 a.m. CT.

Where the HireVue Illinois BIPA settlement stands on October 18, 2026
As of October 18, 2026, nobody has been paid and nobody new can join. The claim deadline was October 13, 2026, online at the settlement website or postmarked by that date, and Judge Jasica’s preliminary approval order is blunt about what happens to anyone who missed it: class members who did not file a timely, valid claim form “shall not be entitled to receive any portion of the Settlement Fund.” The opt-out and objection deadline passed earlier, on September 28, 2026.
Two court dates are left. Under the schedule in the preliminary approval order, the parties’ final approval submission is due October 19, 2026 — the order requires all papers supporting final approval no later than ten days before the hearing. The final approval hearing follows on October 28, 2026, at 9:00 a.m. in Waukegan. At that hearing the judge decides whether the settlement is fair and how much of the fund goes to the lawyers and the three named plaintiffs. Payments can only start after that.
The lawsuit alleges that HireVue collected voice and facial biometrics from job candidates in Illinois through its automated video-interview technology without the written disclosures and consent the Illinois Biometric Information Privacy Act requires. HireVue “denies that it collected or possessed biometrics or any other information subject to BIPA, and denies that it violated BIPA,” according to the official FAQ, and says the interview models at issue “were phased out beginning in 2020, were retired entirely by February 2023.”
The new numbers: $1,265,561 for the lawyers, $18,000 for the plaintiffs, $150 at most for everyone else
Class counsel filed their request on September 7, 2026, and it is now posted on the official site. It reads: “Class Counsel seek attorneys’ fees in the amount of $1,249,875, which amounts to 33.33% of the Settlement Fund, plus $15,686 in reimbursable expenses,” the expenses being “filing fees, mediation costs, and case administration.” Together that is $1,265,561. The motion also asks for $6,000 for each of the three class representatives — $18,000 in all, by our arithmetic. The motion notes that the plaintiffs had agreed in advance to a fee of up to 40%; counsel ask for one third.
The motion also gives the only claims update so far: as of September 7, “thousands of claims have been submitted, no Settlement Class Member has objected to the Settlement, and no Settlement Class Member has requested exclusion.” An exact count has not been published. As of October 18, 2026, the documents page of the official site lists the fee motion, the settlement agreement, the preliminary approval order, the long-form notice and the claim form — the final approval papers due October 19 are not posted.
What a claimant can receive is fixed by the settlement agreement: “In no event shall any Settlement Class Member receive more than $150.00.” If approved claims add up to more than the net fund, every payment shrinks pro rata. Our arithmetic, if the judge grants the full request: $3,750,000 minus $1,265,561 minus $18,000 leaves $2,466,439 before administration costs, which have not been published. That covers at most about 16,442 full $150 payments — roughly 18 percent of the 91,305 people HireVue says are in the class. If fewer approved claims come in, each gets the full $150. Whatever is left does not go to charity: under the agreement, unused money still in the fund 60 days after the Effective Date “shall remain the property of Defendant and shall be transferred to Defendant.” Every dollar the judge trims from the fee request therefore helps claimants only if claims exceed the cap; otherwise it flows back to HireVue.
When the money could arrive, and what to do now
If you filed, you do not need to do anything else, and you do not need to attend the hearing — the FAQ says “Attendance at the hearing is not necessary.” Only class members who filed a written objection by September 28 and said in it that they want to appear can be heard. The preliminary approval order puts the hearing in Courtroom 302 of the Lake County courthouse, 18 N. County Street, Waukegan, with Zoom access through the Nineteenth Judicial Circuit’s remote-session page for C302; the FAQ says Courtroom 202. The order also says the location can change and will be shown on the settlement website — check it before you go.
Timing depends on objections and appeals. The agreement says the settlement becomes “Final” on the date of final approval if no objection was filed, the Effective Date is one business day later, and payments go out “within thirty (30) days after the Effective Date, or as soon as practicable.” If Judge Jasica approves on October 28 and there were no objections, that points, by our count, to payments by about November 28, 2026. The FAQ is more cautious: payment “should occur within approximately 60 days after the Settlement has been finally approved” — about December 27, 2026 — and an appeal would delay it.
You chose check or digital payment on the claim form. Cash or deposit a check promptly: checks “uncashed for any reason within seventy-five (75) days after the issuance of such checks shall be deemed void and will not be re-issued for any reason,” and the money goes back to HireVue. If you filed with the long-form claim (no emailed Claim ID and PIN) and the administrator cannot match your employer, job title and year to HireVue’s records, you get a deficiency notice and 30 days from that notice to fix it; otherwise the claim is denied. Keep your mailing address and email current with the administrator.
Is the email real? How to check
The only official site is VideoInterviewBIPASettlement.com, run by the court-appointed administrator Simpluris. Contacts: (833) 421-7334, info@VideoInterviewBIPASettlement.com, and HireVue BIPA Settlement, c/o Simpluris, P.O. Box 25226, Santa Ana, CA 92799. Class counsel is McGuire Law, P.C., 55 W. Wacker Drive, 9th Fl., Chicago, (312) 893-7002.
Notice emails with a Claim ID and PIN went to the roughly 22,234 email addresses on HireVue’s class list starting July 30, 2026, with a second round on August 31, 2026, plus targeted online ads. Three checks against a fake: the settlement is administered by Simpluris, not by your employer — the FAQ says plainly that employers “do not administer this settlement and cannot determine eligibility”; any message offering to let you file now is not part of the court’s schedule, because late claims are not entitled to money; and no claimant can get more than $150, so a message promising more is wrong. When in doubt, type the address of the official site yourself or call the administrator’s number above, not a number in the message.
BIPA in context: the Facebook payout, and why Google’s $700 million is a different case
What are the largest BIPA settlements ever reached? The benchmark is Facebook. In In re Facebook Biometric Information Privacy Litigation (N.D. Cal., No. 15-cv-03747-JD), Judge James Donato approved a $650 million settlement on February 26, 2021, calling it “one the largest settlements ever for a privacy violation.” We have not verified a full ranking of other BIPA settlements and do not give one.
How much will each person get in the Facebook settlement, and what is the amount of the Illinois Facebook settlement payout? The order says the deal “will put at least $345 into the hands of every class member interested in being compensated.” The court counted 1,571,608 timely claim forms in December 2020 — a claims rate the court put at around 22% of an estimated 6.9 million class members. That case is closed; it does not reopen for HireVue claimants. For scale: BIPA sets liquidated damages of $1,000 per negligent and $5,000 per intentional or reckless violation, which is why a $150 cap draws attention.
Who is eligible for Google’s $700 million settlement payout? That is not a biometric case. According to the Utah Attorney General’s office, it is an antitrust settlement between Google and 53 attorneys general for consumers who made purchases on the Google Play Store between August 2016 and September 2023, with most payments sent automatically by PayPal or Venmo. A HireVue claim has nothing to do with it; questions about that payout go to your state attorney general.
