What Happened
Doctor's Choice runs its patient charts on an electronic medical record platform from the vendor WellSky. According to the company's own HIPAA notice, an unauthorized party logged into a single clinical user account on that platform using compromised credentials between June 5 and July 24, 2026. The company says it discovered the activity on July 21, 2026 and disabled the account.
Its Chief Technology Officer confirmed that account was the only point of access, and a review of Doctor's Choice's own systems found no related activity. The company reported the matter to the Houston Police Department, which has an active case.
Data involved, per the notice: name, address, date of birth, Social Security number, scheduling information and clinical/treatment information. The report to the Texas Attorney General also lists health insurance information. The company says it has no evidence that anyone's information has been misused.
Case details
No court case has been filed that we could find. As of October 18, 2026, a search of federal dockets on CourtListener for “Doctor's Choice Home Care” returns 4 cases — all older Florida lawsuits against a company of that name (an employment case, a wage case, a False Claims Act whistleblower case and one more from 2016), filed between 2014 and 2018. None involves this breach. Example: Libby v. Doctor's Choice Home Care, Inc., No. 2:18-cv-14008 (S.D. Fla.), a Family Medical Leave Act case closed April 30, 2019.
What does exist are law-firm “investigations” announced from September 2026, collecting contact details from affected patients. An investigation is not a lawsuit. We did not check Texas state-court dockets, so a state-court filing cannot be ruled out.
Status: Breach Disclosed, No Lawsuit, No Settlement
The one concrete thing on offer is from the company itself: free credit monitoring, which you have to request by calling the number in the notice. That offer has nothing to do with any lawsuit.
Are You Affected?
You are likely affected if you were a home health or hospice patient of Doctor's Choice and your chart was kept in its WellSky system. The company notified people by U.S. mail and posted a substitute notice on its website. The letter is the test: keep it and the envelope.
If you did not get a letter, call the company's questions line at (833) 365-2464 or write to 13100 Northwest Fwy, Ste 410, Houston, TX 77040. If a class action is later filed and settles, a court-appointed administrator notifies class members directly — there is nothing to sign up for today.
Is There Any Money?
For a sense of what resolved healthcare-breach cases have paid elsewhere — not a prediction for this one — see our data breach settlement calculator. The free credit monitoring from Doctor's Choice is the only benefit available today.

Three Things to Watch For
Hospice and home health patients and their families are an easy target right after a breach letter arrives:
“Claim your Doctor's Choice settlement” sites
There is no settlement and no claims portal. Any page asking for your Social Security number to “secure your payment” is collecting data, not filing a claim.
Calls citing your care schedule or diagnosis
Scheduling and treatment details were in the exposed records, so a caller who knows visit dates or a diagnosis can sound official. The notice itself warns to be cautious of unsolicited calls, emails or letters asking for personal information. Hang up and call (833) 365-2464 yourself.
“Credit monitoring” offers that cost money
The company's monitoring is free, and you request it through the number in its notice. Anyone charging a fee or asking for card details to activate it is not the company.

Short answers to the questions people ask most about this case.
Is there a doctor's choice home care & hospice data breach lawsuit?
