Mediation Settlement: What It Means When a Lawsuit Goes to Mediation

Reference Guide

Get a free case reviewCase status

A headline saying a lawsuit was “sent to mediation” means the two sides will sit down with a neutral go-between to try to settle. It does not mean there is a settlement, money or a claim form. As of October 2026 the case in the news is the Lennar data breach suit, referred to mediation on October 7, 2026 with no settlement. Here is what the rules say, how real 2026 mediations turned out, and what you need to do — usually nothing yet.

What Lawsuit Mediation Actually Is

Lawsuit mediation is a negotiation run by a neutral mediator — often a retired judge — who has no power to decide the case. The Fourth Circuit's mediation office puts it plainly: “the parties control the final outcome.”

Federal law pushes cases toward it. Under 28 U.S.C. § 652, every federal district court must require litigants in all civil cases to consider alternative dispute resolution, and must offer at least one process, including mediation. A court may make mediation mandatory in some cases; arbitration it can only order if the parties consent. Judges also manage settlement directly: under Federal Rule of Civil Procedure 16(c)(2)(I) a pretrial conference can take up “settling the case,” and the court may require a party with authority to be present or reachable.

What is said in mediation is shielded. Section 652(d) requires courts to protect the confidentiality of these communications, and Federal Rule of Evidence 408 bars using settlement offers or statements made in compromise talks to prove or disprove the claim. That is why mediation details rarely appear in the news until a deal is filed.

Case details

Three real 2026 cases show the range of outcomes.

Lennar data breach (S.D. Florida). The lead case is Ramkissoon v. Lennar Corporation, No. 1:26-cv-25518. The case was referred to mediation on October 7, 2026, after a consolidation order. Details and current status: our October 2026 Lennar mediation report and the Lennar lawsuit overview.

700Credit data breach (E.D. Michigan). In In re 700 Credit Data Security Litigation, No. 2:25-cv-13747, before Judge Robert J. White, the parties mediated all day on April 2, 2026 before a retired federal judge and did not settle. Talks continued through the mediator, and they reached a settlement in principle on April 8, 2026. The court granted preliminary approval of a $17.5 million fund on June 4, 2026. See our 700Credit settlement page for deadlines.

Bayhealth website tracking (Delaware Superior Court). In Doe v. Bayhealth Medical Center, C.A. No. N24C-09-002-FJJ, the court stayed the case for mediation on January 12, 2026. At the end of a full-day session on February 9, 2026, the mediator made a proposal that both sides accepted. The proposed preliminary approval order the plaintiffs filed in April 2026 names October 29, 2026 for the final approval hearing; check the court docket for the current date.

Status: Mediation Is a Step, Not a Settlement

A referral to mediation is not a settlement. When a news story calls something a “mediation lawsuit,” it means a case in settlement talks — nothing more. There is no fund, no administrator, no claim form and no deadline until the parties sign an agreement and a court approves it. Mediation can end three ways: a deal at the table (Bayhealth), a deal days later with the mediator's help (700Credit), or an impasse, after which the lawsuit simply continues.

For class actions there is a second gate. Under Rule 23(e)(2), a settlement that binds class members can be approved only after a hearing and only if the court finds it “fair, reasonable, and adequate,” considering, among other things, whether it was “negotiated at arm's length.” Mediation before a neutral is one way parties show that. Any class member may object under Rule 23(e)(5).

Are You Part of a Mediated Case?

You do not attend a class action mediation and you cannot sign up for one. Class counsel negotiates for the proposed class. If a deal is reached and preliminarily approved, the court-appointed administrator sends notice to class members it can identify.

Your own lawsuit is different. If you are a named party in an individual case — an injury claim, an employment dispute — you or a representative with settlement authority may be required to be present or reachable, and nothing settles unless you agree.

The practical test: did you receive a breach notice or a settlement notice naming the case? Keep it. That letter, not a news story about mediation, is what ties you to a class.

What Mediation Pays — and When

Mediation itself pays nothing. In the cases above, the money came only from the settlement that followed, and in class actions only after court approval.

The 700Credit deal shows a typical structure: a $17.5 million non-reversionary fund for about 5.8 million people, up to $2,500 for documented losses or an estimated $50 alternate cash payment, and class counsel's request for fees of up to one-third of the fund, subject to court approval. The Bayhealth settlement includes a $25 cash option.

Timing is long. 700Credit mediated on April 2, 2026; its final approval hearing was scheduled for December 15, 2026. No class member is paid before final approval. In an individual case, when you are paid depends on the signed agreement — ask your lawyer for the payment terms in writing.

How a Lawsuit Mediation Unfolds

  1. Lawsuit Filed and Consolidated

Cases are filed and, in multi-plaintiff matters, combined before one judge. In the Lennar breach cases this happened before the October 7, 2026 mediation referral.

  2. Referral or Agreement to Mediate

A court refers the case under its local ADR rules, or the parties agree to mediate. In Bayhealth the court stayed the case for mediation on January 12, 2026.

  3. Informal Discovery and Mediation Statements

Before the session, the sides exchange data on class size and damages and file confidential mediation statements with the mediator.

  4. The Mediation Session

Usually a full day. Bayhealth settled at the table on February 9, 2026; 700Credit did not settle on April 2, 2026, then agreed on April 8.

  5. Signed Agreement and Preliminary Approval

For a class action, the deal goes to the judge. 700Credit's court gave 45 days to file the motion and granted preliminary approval on June 4, 2026.

  6. Notice, Claims, Final Approval, Payment

Notice goes out, class members claim or object, and the court holds a fairness hearing. Payments come only after final approval.

Three Things to Watch For

News of a mediation creates a window where people expect money that does not exist yet:

“The case settled in mediation — claim now”

A referral to mediation is not a deal. Until a court grants preliminary approval and an administrator is appointed, there is no claim form. A page taking your Social Security number to “reserve your share” of the Lennar case is collecting data, not filing a claim.

Fees to “join the mediation”

Class members do not attend or pay to be part of a class action mediation. Class counsel negotiates for the class and any fee award comes out of an approved fund — 700Credit counsel sought up to one-third, subject to court approval.

“Confidential mediation results” for sale

Mediation communications are confidential under federal law and court rules. Anyone offering inside numbers from a session is guessing or lying. What counts is the agreement filed with the court.

Lawsuit Mediation — Questions People Actually Ask

Short answers to the questions people ask most about this case.

What is a mediation settlement?

A mediation settlement is an agreement the parties reach with the help of a neutral mediator. The mediator does not decide anything; the parties control the outcome. In a class action, the agreement still needs court approval under Rule 23(e) before anyone is paid.

Do most lawsuits settle in mediation?

Most lawsuits never reach trial: only 0.4% of federal civil cases ended during or after trial in the year to September 30, 2025 (1,681 of 407,379). Not all of the rest settle in mediation — many are dismissed or settle directly. One court that publishes a figure, the Fourth Circuit, says about 34% of appeals assigned to its mediation program settle each year.

Is it better to settle in mediation?

That depends on the case, and nobody can be forced to accept an offer. Courts can require you to mediate, not to agree. What mediation offers is speed and certainty compared with trial; what you give up is the chance of a larger verdict. In an individual case, weigh any offer with your own lawyer.

How long after mediation does a case settle?

It can be the same day or days later. Bayhealth's parties accepted a mediator's proposal at the end of the February 9, 2026 session. 700Credit's parties left the April 2, 2026 session without a deal and agreed on April 8. If mediation ends in impasse, the lawsuit continues.

How long after mediation will I get my money?

In a class action, not until the court grants final approval after a fairness hearing — in 700Credit that hearing was set for December 15, 2026, more than eight months after mediation. In an individual case, payment timing is set by the signed settlement agreement.

How much of a $25,000 settlement will I get?

In an individual case that depends on your fee agreement, case costs and any medical or insurance liens; our $25,000 settlement guide walks through the deductions. Class actions work differently: fees are approved by the court and come out of the fund before distribution.

Can what I say in mediation be used against me?

Generally not to prove the claim. Federal Rule of Evidence 408 bars using settlement offers and statements made in compromise negotiations to prove or disprove a disputed claim, and 28 U.S.C. § 652(d) requires courts to protect ADR confidentiality. Rule 408 has exceptions, such as proving a witness's bias.

The Lennar case went to mediation. Do I need to do anything?

No. As of October 2026 there is no Lennar settlement and no claim form. If a deal is reached and approved, a court-appointed administrator will notify class members. Keep any breach notice you received and consider a free credit freeze.
