Two Keller Williams Settlements, Two Payment Tracks
This page covers only the payout. For the case itself, see our Keller Williams lawsuit overview.
Seller settlement (Burnett): Keller Williams agreed to pay $70,000,000. It is handled by JND Legal Administration at RealEstateCommissionLitigation.com. Claims closed on May 9, 2025.
Buyer settlement (Batton): Keller Williams agreed to pay $20 million, alongside $8.5 million from RE/MAX, for a combined $28.5 million fund. It runs through HomebuyerLitigation.com. Claims closed on August 25, 2026.
The two settlements are separate. Each has its own claim, its own administrator and its own payment timing. A claim in one does not count in the other.
Case Details
Seller case: Burnett et al. v. National Association of Realtors et al., No. 4:19-cv-00332-SRB, U.S. District Court for the Western District of Missouri, Judge Stephen R. Bough. The Keller Williams settlement also resolves Keller Williams claims in Moehrl (N.D. Ill.) and Nosalek (D. Mass.). Appeals went to the Eighth Circuit as No. 24-3444 and related appeals, before Circuit Judges L.R. Smith, Erickson and Kobes.
Buyer case: Batton v. The National Association of Realtors et al., Case No. 21 C 430, U.S. District Court for the Northern District of Illinois, Judge LaShonda Hunt.
Status as of October 12, 2026: Waiting on Distribution
Buyer settlement ($20 million): Judge Hunt granted final approval after a fairness hearing on August 4, 2026, with no objections and no opt-outs. Claims closed August 25, 2026. Per HousingWire, the order says the fund “will be distributed later under the court-approved plan.” No date has been published.
What still has to happen before money moves: any remaining appeals must be finished, the administrators must finish reviewing claims, and the court-approved distribution must begin. We could not find a fixed number of days in a published document, so we do not estimate one.
Who Gets Paid: Only People Who Filed
Nobody is paid automatically. The seller notice calls a claim form “the only way to get a payment.” It also says that if you did nothing, “you will get no payment.” The buyer site says the same thing for the Batton deal.
Sellers: you needed one claim for each home sold, filed by May 9, 2025.
Buyers: purchases through April 14, 2026, claimed by August 25, 2026.
If you missed both deadlines, neither Keller Williams settlement will pay you. Buyers should note that NAR and Anywhere settled their buyer claims separately in the Tuccori case, which HousingWire reported was up for final approval in early November 2026. That is a different settlement with its own process.
How Much Each Person Gets: Not Yet Known
Seller fund: $70,000,000 from Keller Williams, paid out only after court-awarded attorneys' fees, expenses, administration costs and service awards are deducted. The notice warns that claims the administrator cannot confirm may be rejected or get “a reduced share.”
Buyer fund: $28.5 million combined from Keller Williams and RE/MAX. In June 2026, class counsel asked for $14 million in attorneys' fees and litigation expenses. We could not confirm the amount the court awarded.
How you will be paid: neither administrator has said whether payments will be checks or electronic. We also found no published rules on reissuing lost or expired checks, a second distribution, or leftover funds.
How cases like this one end
Our copy of the federal courts’ own case database covers 6,924 antitrust casesclosed in U.S. federal district courts between 2015 and 2026, 37.3% of them filed as class actions:
- 19.1% ended in a settlement recorded by the court. Another 14.5% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 19.1% and 33.6%.
- 11.4% were decided on a motion before any trial.
- 1 in 119 reached a trial (0.8%), after a median of 37.1 months.
- Median time from filing to the end of the case: 11.9 months.
- Almost none record a money award in this data (33 of 6,924), and the recorded figures are capped, so we do not publish an average.

Three Things to Watch For
Two approved settlements with no payment date yet make an easy story for imposters:
“Your Keller Williams payment is ready” messages
As of October 12, 2026, no distribution date has been announced. A text or email saying your money is waiting, especially one asking for bank login details or a “release fee,” is not from the administrator.
Offers to file a late claim for you
The seller deadline was May 9, 2025, and the buyer deadline was August 25, 2026. Anyone offering to get you into either Keller Williams settlement now, for a fee, is selling something that does not exist.
Look-alike settlement sites

Keller Williams Settlement Payout — Questions People Actually Ask
Has the Keller Williams settlement paid out yet?
Not as far as any official source shows. As of October 12, 2026, neither the seller settlement site nor the buyer settlement site lists a payment date, and we found no report of payments being sent.
Which Keller Williams settlement am I in?
If you sold a home and paid a commission, you were in the $70 million Burnett seller settlement (claims closed May 9, 2025). If you bought a home listed on an MLS, you were in the $20 million Batton buyer settlement (claims closed August 25, 2026). Some people were in both, but each needed its own claim.
When will Keller Williams settlement payments be sent?
No date has been announced. The seller notice says payments come “after appeals are resolved.” The Eighth Circuit affirmed on August 19, 2026, and rehearing petitions followed. For the buyer settlement, the August 2026 approval order says the fund will be distributed later under a court-approved plan.
How much will I get from the Keller Williams settlement?
Nobody knows yet. The funds are $70,000,000 for sellers and $28.5 million combined for buyers. Each share depends on fees and costs deducted and on how many valid claims were approved, and neither administrator has published a per-person figure.
How do I know if I’m owed money from a class action lawsuit?
For these settlements: you are owed money only if you filed a claim before the deadline and it is approved. If you filed, contact the Settlement Administrator to confirm your claim status. If you did not file, you will not receive a Keller Williams payment.
What is the status of the real estate class action lawsuit?
There are several. The Burnett seller settlements were affirmed by the Eighth Circuit on August 19, 2026. The Keller Williams and RE/MAX buyer settlements in Batton received final approval in August 2026. NAR and Anywhere's buyer settlement in Tuccori was reported by HousingWire as up for final approval in early November 2026. See our real estate commission payout page for the wider picture.
How do I check my Keller Williams claim status?
A web search for “keller williams.settlement status” will not show your individual claim. Sellers: call JND at 1-888-995-0207 or email info@RealEstateCommissionLitigation.com, and have your claim ID ready. Buyers: use the contact details on HomebuyerLitigation.com. Neither site lists a payment schedule yet, so ask whether your claim was approved, not when you will be paid.
How can I tell a real payment notice from a fake one?
Seller notices come from JND Legal Administration and the RealEstateCommissionLitigation.com domain. A real administrator will not charge a fee to release your money or ask for your bank password. If in doubt, call the number listed on the official site, not the one in the message.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
