What the Lawsuit Alleges

A federal class action (Batton v. NAR, Case No. 21 C 430) alleged that Keller Williams, the National Association of Realtors, RE/MAX, and other major real-estate defendants conspired to inflate and maintain artificially high broker commissions paid by home buyers. Plaintiffs argued the practice forced buyers to indirectly fund seller-side agent compensation built into home prices, violating federal antitrust law. Keller Williams settled in January 2026 — the first brokerage to do so in this buyer-side case — without admitting wrongdoing.

Current Status

Settlement reached. Keller Williams agreed January 20, 2026 to pay $20 million; RE/MAX agreed March 22, 2026 to pay $8.5 million (combined fund $28.5M). A settlement approval hearing is scheduled for July 28, 2026 and the claim deadline is August 25, 2026 — the window is currently OPEN. Other defendants (NAR, Anywhere Real Estate) remain unresolved in this buyer case.

Who Is Affected & Can You Join?

You may qualify if you: (1) purchased U.S. residential real estate listed on an MLS; (2) your purchase closed on or before April 14, 2026; and (3) your purchase falls within your state's statutory period (ranging from January 25, 2006 to January 25, 2019 depending on state — all 50 states and Puerto Rico are covered). You do NOT need to have used a Keller Williams or RE/MAX agent. A valid claim must be submitted by August 25, 2026.

Is There a Payout?

This settlement has an OPEN claim window. It is a pro-rata distribution from a $28.5 million fund after deducting attorney fees, administration costs, and service awards. Individual payouts depend on total valid claims filed and commissions paid — no per-person amount is predetermined. File for free at homebuyerlitigation.com by August 25, 2026 (payment options include virtual debit card, check, PayPal, or Venmo). Note: a separate seller-side settlement (Sitzer/Burnett) in which Keller Williams paid $70 million had a claim deadline of May 9, 2025 and is now closed.

    January 2021 — Batton Lawsuit Filed

    A New Jersey home buyer filed the Batton class action in the Northern District of Illinois (Case No. 21 C 430), alleging a conspiracy among NAR, Keller Williams, RE/MAX, and others to keep buyer-side commissions artificially inflated.

    February 2024 — Separate Seller Settlement

    In the parallel Sitzer/Burnett seller-side case, Keller Williams agreed to pay $70 million as part of a combined industry settlement. That case received final approval in 2024 and its claim deadline passed May 9, 2025.

    January 20, 2026 — Keller Williams Settles Batton

    Keller Williams became the first defendant in the Batton buyer case to settle, agreeing to pay $20 million. The settlement releases KW franchisees, agents, and teams from antitrust claims by qualifying home buyers nationwide.

    March 22, 2026 — RE/MAX Also Settles

    RE/MAX agreed to pay an additional $8.5 million in the same Batton case, bringing the combined fund to $28.5 million. NAR and Anywhere Real Estate remain active defendants.

    The final settlement approval hearing is scheduled for July 28, 2026. Class members must file claims at homebuyerlitigation.com or by mail by August 25, 2026. The opt-out and objection deadline was June 23, 2026.

Third-Party 'Claim Filing' Services Charging Fees

Filing a claim is free. The only legitimate place to file is homebuyerlitigation.com or by mail to the official administrator (A.B. Data, Ltd.). Any website or service charging a fee to submit your claim is not affiliated with the court-approved settlement.

Phishing Emails Impersonating the Administrator

Scammers send emails mimicking official settlement notices requesting sensitive banking information upfront. The legitimate administrator will not ask for your bank account number to process a claim. Verify all communications against homebuyerlitigation.com directly.

Confusion With the Closed Seller Settlement

Some sites conflate the still-open buyer settlement (Batton, deadline Aug 25, 2026) with the closed seller settlement (Sitzer/Burnett, deadline May 9, 2025). If a site says the Keller Williams claim window has passed, they are referring to the separate seller case — the buyer case is still open.

Do I have to have used a Keller Williams agent to qualify?

No. Eligibility is based on whether you purchased residential real estate listed on an MLS within your state's statutory period (as early as 2006 in some states) through April 14, 2026 — regardless of which brokerage or agent you used.

How much money will I actually receive?

The $28.5 million fund is divided proportionally among all valid claimants after attorney fees and administration costs. The exact individual payout depends on how many people file and how much commission was paid. No guaranteed per-person amount has been set by the court.

What documents do I need to file a claim?

Is this the same as the NAR settlement I heard about in 2024?

No. The Batton case (homebuyerlitigation.com) is a separate buyer-side antitrust lawsuit. The widely publicized 2024 NAR/Sitzer-Burnett settlement compensated home sellers and had a May 9, 2025 claim deadline, which has passed. The Batton settlement compensates home buyers and is accepting claims through August 25, 2026.
