What the Lawsuits Allege

Pomona abuse case. A woman identified as Jane Doe filed suit in December 2022 in Pomona Superior Court. The lawsuit alleges that a former Salvation Army youth leader at the Pomona Corps sexually abused her hundreds of times, starting when she was 12, and that adult staff should have been supervising. The Salvation Army says it reported concerns about her safety to authorities in 2006 and 2007, and argues she left out other parties it says bear responsibility.

Rehab-worker wage cases. Participants in Salvation Army Adult Rehabilitation Centers (ARCs) allege they did at least 40 hours a week of “work therapy” for its thrift stores for as little as $1 a week, capped at $20–$30, plus housing and food. They argue they were employees owed minimum wage. The Salvation Army says they were program participants, not employees.

Portland shelter case. The owner of an apartment building next to the Northrup homeless shelter sued the City of Portland and the Salvation Army in March 2026, alleging nuisance, negligence and inverse condemnation and seeking $6 million.

Case Details

Clancy v. The Salvation Army, No. 1:22-cv-01250, U.S. District Court for the Northern District of Illinois, Judge Manish S. Shah — now on appeal to the Seventh Circuit. Two sister cases are stayed: Acker, No. 1:22-CV-01968 (S.D.N.Y.), and Massey, No. 1:22-CV-00979 (N.D. Ga.). Together they cover 38 states. Counsel’s case page: Cohen Milstein.

Pomona abuse case: Los Angeles County Superior Court, Pomona, before Judge Allison L. Westfahl Kong. Portland shelter case: Oregon state court.

Status of Each Case as of October 6, 2026

Pomona abuse case — trial set. Trial was scheduled to begin October 13, 2026. On September 30, 2026 the Salvation Army filed papers arguing others share the blame. No verdict and no settlement had been reported as of October 6, 2026.

Clancy (federal ARC wage case) — on appeal. On March 26, 2026 the court certified classes in Illinois, Michigan and Wisconsin plus a federal wage collective covering ten states. Five days later, on March 31, 2026, it granted the Salvation Army summary judgment. The workers appealed on April 8, 2026; their reply brief was filed September 24, 2026. The Seventh Circuit had not ruled as of October 6, 2026.

Spilman (California ARC wage case) — back in trial court. On January 6, 2026 the Court of Appeal vacated the Salvation Army’s win and set a new test for when a nonprofit “volunteer” is really an employee.

Portland shelter case — pending. On June 30, 2026 the Salvation Army was reported to be seeking dismissal, arguing the shelter is religious ministry. The shelter itself closed in September 2026.

NLRB challenge — ended. The Salvation Army dropped its Michigan federal suit against the National Labor Relations Board after the agency dropped its complaint, as reported on January 22, 2026.

Am I Affected?

You worked in a Salvation Army ARC in Illinois, Michigan or Wisconsin. You may be in the Clancy classes — more than 3,500 people in Michigan, more than 3,000 in Illinois and more than 650 in Wisconsin, per plaintiffs’ counsel. But the trial court ruled for the Salvation Army, so nothing is owed unless that is reversed. Counsel states the period to join the federal collective has closed.

You worked in a California ARC. The Spilman class action is back before the San Francisco trial court. No class payment exists.

You applied for a Salvation Army job between November 2, 2018 and May 17, 2021. That is the old Parker background-check settlement, described below. Its deadlines passed in 2024.

Is There Money Available?

Not today. There is no open Salvation Army settlement, no fund and no claim form as of October 6, 2026. The ARC wage cases have produced no payment: the federal court ruled for the Salvation Army and the appeal is pending.

One past class settlement was Parker v. The Salvation Army, No. 20-civ-04787 (San Mateo County Superior Court), over background checks on job applicants. It totaled $1,875,250 for about 19,550 class members, paid as a thrift-store voucher worth up to $95. The exclusion deadline was June 15, 2024 and the final approval hearing was set for August 6, 2024. It is closed.

A sexual-abuse lawsuit in Pomona, California, filed in December 2022 and scheduled for trial on October 13, 2026. The lawsuit alleges a former youth leader abused the plaintiff starting when she was 12. The Salvation Army disputes responsibility.

Is there a Salvation Army class action settlement I can claim?

No. As of October 6, 2026 there is no open Salvation Army settlement and no claim form. A past class settlement, Parker, closed in 2024.

Did the Salvation Army lose the rehab-worker wage case?

Not yet in any final way. In Illinois federal court the Salvation Army won summary judgment on March 31, 2026, and the workers appealed. In California, the Court of Appeal reversed a Salvation Army win on January 6, 2026, so that case continues.

I was in a Salvation Army rehab program. Am I owed back pay?

Nothing is payable now. If you were in an ARC in Illinois, Michigan or Wisconsin you may be a class member in Clancy, but the trial court ruled against the class. Any money would depend on winning the appeal and then the case.
