Ozempic / GLP-1 MDL — Early Stage

GLP-1 receptor agonists: Ozempic/semaglutide (Novo Nordisk), Wegovy (Novo), Mounjaro/tirzepatide (Eli Lilly), Zepbound (Lilly), Rybelsus (Novo). Allegedly cause: (1) severe gastroparesis (stomach paralysis), ileus, intestinal obstruction, aspiration during anesthesia; (2) NAION (non-arteritic anterior ischemic optic neuropathy — sudden vision loss).

Two MDLs: (1) MDL 3094 (E.D. Pa., Judge Karen S. Marston) — gastrointestinal injuries, 3,928 lawsuits (JPML census, August 3, 2026). (2) MDL 3163 (separate docket, E.D. Pa., same judge) — NAION vision loss, 200 lawsuits as of the August 3, 2026 JPML census, up from 110 on June 1. Expert hearings set for September 10–18, 2026. Details: our NAION tracker. Additional 3,363 general GLP-1 injury cases pending elsewhere.

Status: EARLY ACTIVE — pre-bellwether. No global settlement. No bellwether trials. Pretrial/expert discovery phase. General causation expert discovery + Daubert hearings likely 2026-2027. Bellwether trials projected late 2026 or 2027. Defendants deny causation + contest warning adequacy. These are blockbuster drugs with massive economic interests — Novo + Lilly have significant defense resources.

Who May Qualify for an Ozempic Lawsuit?

You may have a claim if ALL apply:

  • You took Ozempic, Wegovy, Mounjaro, or Zepbound (GLP-1 / GIP drugs)
  • You were diagnosed with gastroparesis (stomach paralysis), severe intestinal blockage, NAION vision loss, or gallbladder disease
  • Your diagnosis came after starting the medication (typically used for ≥several months)
  • You have medical records documenting both the prescription and the injury

The MDL (multidistrict litigation) is consolidating cases — no settlement exists yet, so filing now preserves your place. Statute of limitations varies by state (often 2-3 years from diagnosis).

The Two Main Injury Tracks

Ozempic litigation splits into distinct injury categories. Which track you're in affects case strength and potential value. Both are part of MDL 3094 in the Eastern District of Pennsylvania.

Gastrointestinal Track (Gastroparesis / Stomach Paralysis)

The largest group. Plaintiffs allege GLP-1 drugs caused gastroparesis (stomach paralysis), severe vomiting, intestinal obstruction, or ileus. In January 2025, the Ozempic label was updated to state it is "not recommended in patients with severe gastroparesis" — though it does not admit the drug causes the condition.

NAION Vision Loss Track

A newer, separate group. Plaintiffs allege semaglutide caused NAION (Non-Arteritic Anterior Ischemic Optic Neuropathy) — sudden, often permanent vision loss. A 2024 Harvard study linked semaglutide to elevated NAION risk, fueling these claims.

Estimated Case Values — IMPORTANT: No Settlement Exists Yet

There is NO global Ozempic settlement as of 2026. No money has been awarded. The figures below are attorney projections based on similar pharmaceutical MDLs — NOT guaranteed amounts. Actual values depend on bellwether trial outcomes (expected late 2026) and individual case facts. Anyone promising you a specific dollar amount now is misleading you.

SeverityTierEstimate (NOT guaranteed)
Severe (hospitalization, surgery, permanent gastroparesis)Higher-tier projection$400,000–$700,000+ (estimate)
Moderate (ongoing treatment, documented diagnosis)Mid-tier projection$100,000–$400,000 (estimate)
Mild / unconfirmed causationLower-tier or no recovery$0–$100,000 (estimate)

Current MDL Status (May 2026)

The Ozempic litigation is in active pre-trial phase. No settlement, no payouts yet. Here's exactly where it stands:

3,636 lawsuits consolidated in MDL 3094 (E.D. Pennsylvania, Judge Karen S. Marston) as of May 2026, against Novo Nordisk and Eli Lilly.
No global settlement in either the gastrointestinal MDL or the NAION claims. Discovery and bellwether selection ongoing.
Bellwether trials expected late 2026. Settlement negotiations likely to intensify after early trial results. Filing now preserves your statute-of-limitations position.

Last verified: May 2026. Litigation status changes frequently — verify current MDL status before relying on any figure. This page is informational, not legal advice.

Ozempic MDL Timeline

  1. 1

    2023: First Lawsuits Filed

Plaintiffs begin filing claims alleging Novo Nordisk (Ozempic/Wegovy) and Eli Lilly (Mounjaro/Zepbound) failed to warn about gastroparesis and severe GI risks.

  2. 2

    February 2024: MDL 3094 Created

The Judicial Panel on Multidistrict Litigation consolidates federal cases into MDL 3094 in the Eastern District of Pennsylvania before Judge Karen S. Marston.

  3. 3

    January 2025: Label Update

Ozempic's label is updated to state it is "not recommended in patients with severe gastroparesis" — a development plaintiffs cite, though it stops short of admitting causation.

  4. 4

    2025-2026: Discovery + Case Growth

MDL grows to 3,636 lawsuits (May 2026). Discovery, expert reports, and bellwether case selection proceed. NAION vision-loss claims added as a second track.

  5. 5

    Late 2026: Bellwether Trials Expected

First bellwether (test) trials anticipated late 2026. Outcomes will heavily influence whether/when a global settlement emerges. Settlement negotiations expected to intensify after early trial results.

Realistic Case Scenarios

Hypothetical examples illustrating how case strength varies. These are NOT settlement offers — no settlement exists. Values are attorney projections for similar MDLs:

Hospitalized Gastroparesis, Surgery Required

Patient took Ozempic 14 months for weight loss, developed severe gastroparesis requiring hospitalization and a gastric procedure. Full medical records + prescription history.

Higher-tier projection ($400K-$700K+ estimate) — strong causation + documented severe injury. Only realized IF the MDL settles or a jury awards damages.

Moderate Gastroparesis, Ongoing Treatment

Patient took Wegovy 8 months, diagnosed with gastroparesis, managed with medication and diet. Clear diagnosis, no surgery.

Mid-tier projection ($100K-$400K estimate) — solid claim, value depends on bellwether outcomes.

NAION Vision Loss

Patient on semaglutide developed sudden vision loss diagnosed as NAION. Ophthalmology records link timing to the drug.

Separate NAION track — newer litigation, value highly uncertain pending the science and early trials.

Mild Symptoms, No Formal Diagnosis

Patient experienced nausea and vomiting on Ozempic but no formal gastroparesis diagnosis or hospitalization.

Weak claim ($0-$100K estimate or no recovery) — without a documented qualifying diagnosis, causation is hard to prove.

Took Drug, No Injury

Patient used Ozempic for diabetes with no adverse GI or vision event.

$0 — no injury, no claim. The lawsuit requires a documented qualifying injury.

Ozempic Lawsuit Scams — Red Flags

Active mass torts with no settlement yet are scam magnets. Watch for these:

1. "Guaranteed $X Ozempic Settlement Payout"

There is NO settlement. Anyone guaranteeing a specific payout is lying. Real attorneys give ranges with heavy caveats and explain that bellwether trials (late 2026) determine everything.

2. "Pay an Upfront Fee to Join the Lawsuit"

Legitimate mass-tort attorneys work on contingency — they only get paid if you recover. Never pay upfront to "join" or "register" for the Ozempic MDL.

3. Pressure to "Sign Today or Lose Your Claim"

While statutes of limitations are real, high-pressure "sign now" tactics are a red flag. A reputable firm explains your specific deadline based on your state and diagnosis date.

4. Requests for SSN, Bank, or Card Info to "Process Your Claim"

Case intake needs medical records and prescription history — not your bank account or card numbers. Anyone demanding financial credentials to "process" a non-existent settlement is a scammer.

5. Fake "Ozempic Settlement Administrator" Sites

Since no settlement exists, there is NO official settlement administrator yet. Sites claiming to be "the official Ozempic settlement" with claim forms are fraudulent. Verify any law firm independently.

Ozempic / GLP-1 FAQs

Can I file even if I took Ozempic for diabetes (not weight loss)?

Yes — both diabetes and weight-loss patients are in scope. Both indications use the same active ingredient + same alleged side effects. Your FDA-approved use case doesn't matter for tort liability.

Is Mounjaro (Lilly) in the same lawsuit?

Yes — MDL 3094 covers Lilly's GLP-1 drugs (Mounjaro/tirzepatide, Zepbound) as well as Novo Nordisk's (Ozempic, Wegovy, Rybelsus). Defendants are both manufacturers, plus distributors.

How long will this litigation take?

No trials expected before late 2026 or 2027. Global settlement unlikely before 2028+. Register claim now to preserve SOL but expect multi-year wait. Daubert challenges may end or narrow litigation (like Tylenol MDL).

Does 'stomach paralysis' mean I qualify?

Yes, if you have a documented gastroparesis diagnosis linked to GLP-1 use. Standard label side effects (nausea, vomiting) alone likely don't qualify. Clinical gastroparesis diagnosis typically required via gastric emptying study + GI specialist.

I stopped taking the drug + symptoms resolved — do I still qualify?

Possible — document the diagnosis + hospitalization regardless of current status. Even resolved cases may qualify for compensation if medical treatment + hospitalization occurred during active symptoms.

Is the NAION (vision loss) claim strong?

A September 2024 NEJM study supports the association between GLP-1 use + NAION. Causation is still being litigated. NAION now has its own docket, MDL 3163, with 200 cases as of the August 3, 2026 JPML census — nearly double the 110 pending on June 1. Expert hearings run September 10–18, 2026. Full status: our NAION tracker. If you experienced sudden, painless vision loss in one eye after starting Ozempic/similar, document immediately.

What if I only had nausea/vomiting, not gastroparesis?

Standard label side effects likely DON'T qualify. Clinical gastroparesis diagnosis is typically required — confirmed via gastric emptying study (4-hour nuclear medicine scan) + GI specialist evaluation. Without clinical diagnosis, claim is weak.

Is there a lawsuit against Ozempic — and are there any settlements yet?

Yes - the lawsuit against Ozempic and similar GLP-1 drugs is very real: claims against Novo Nordisk (and Eli Lilly for Mounjaro/Zepbound) are consolidated in MDL 3094 in the Eastern District of Pennsylvania. No — this is pre-bellwether litigation. Speculative projections: gastroparesis requiring hospitalization $100K-$500K; permanent gastroparesis + feeding tube $500K-$2M; NAION significant vision loss $200K-$1M+. These are attorney estimates — not court-verified.
