There is no single lawsuit against Ozempic — there are thousands of individual injury suits against Novo Nordisk (and Eli Lilly for its GLP-1 drugs), grouped in two federal proceedings before Judge Karen S. Marston in Philadelphia. One covers stomach and bowel injuries such as gastroparesis; the other covers sudden vision loss (NAION). As of October 1, 2026 the federal court counts 4,025 and 247 pending cases. In mid-September 2026 the judge held a week-long hearing on expert evidence. There is no settlement, no fund and no claim form.

What the Lawsuits Say
Every lawsuit against Ozempic in these proceedings is a personal-injury claim, not a refund or consumer class action. The suits allege that Novo Nordisk knew or should have known that semaglutide could cause serious harm and did not adequately warn patients or their prescribing doctors.
Stomach and bowel injuries. Plaintiffs allege gastroparesis (stomach paralysis), ileus and intestinal obstruction. Per Drugwatch, the U.S. label added an ileus warning in September 2023, and in January 2025 it began to say Ozempic is “not recommended in patients with severe gastroparesis” — without saying the drug causes it.
Vision loss. Newer suits allege non-arteritic anterior ischemic optic neuropathy (NAION), a sudden loss of blood flow to the optic nerve. The U.S. label has no NAION warning; the European Medicines Agency has called it a very rare side effect, affecting about 1 in 10,000 users.
Novo Nordisk and Eli Lilly deny the allegations, and no court has found that the drugs cause either injury.
Case Details
Both proceedings are in the U.S. District Court for the Eastern District of Pennsylvania before Judge Karen S. Marston.
Gastrointestinal injuries: In re: Glucagon-like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, MDL No. 3094, No. 2:24-md-03094. It covers Ozempic, Wegovy and Rybelsus (Novo Nordisk) and Trulicity and Mounjaro (Eli Lilly). Federal cases were centralized in February 2024.
Vision loss: In re: GLP-1 RAs Non-Arteritic Anterior Ischemic Optic Neuropathy (NAION) Products Liability Litigation, MDL No. 3163, No. 2:25-md-03163, created in December 2025. It covers Ozempic, Wegovy, Saxenda and Trulicity, with claims for failure to warn, design defect and breach of warranty. Related NAION cases are also grouped in New Jersey state court, Novo Nordisk's home state.
The court keeps official pages for MDL 3094 and MDL 3163.
Status: Waiting on Expert Rulings, No Settlement
Stomach cases (MDL 3094): 4,025 pending on October 1, 2026, up from 4,022 a month earlier. From September 14 to 18, 2026, Judge Marston held a Rule 702 (“Daubert”) hearing on two cross-cutting issues — questions about expert evidence that affect large groups of cases. As of October 6, 2026 we have not found a published ruling. An August 2025 ruling already requires a gastric emptying study to support a gastroparesis claim. No bellwether trial date has been reported.
Vision cases (MDL 3163): 247 pending on October 1, 2026, up from 216 on September 1. The judge ruled that two questions go first: whether GLP-1 drugs can cause NAION at all, and whether federal law preempts the failure-to-warn claims. Per a plaintiffs' firm tracking the docket, expert challenges and summary-judgment motions are due July 2, 2027. Details are on our Ozempic vision loss page.

Who Can Bring a Claim
There is no class to join and nothing to sign up for. Each person files an individual lawsuit, usually through a lawyer, and must prove their own injury.
Stomach injuries: after the August 2025 ruling, a gastroparesis claim generally needs a gastric emptying study in the medical records. Ileus and bowel-obstruction claims rest on their own records.
Vision loss: a NAION diagnosis by an eye doctor after taking a GLP-1 drug is the starting point.
Time limits matter. Filing deadlines are set by state law and can be as short as one year, per Drugwatch. The MDLs do not pause your own state's clock. Wegovy and Mounjaro users are in the same proceedings — see our Wegovy and Mounjaro pages.
What a Case Like This Pays
If money comes, it will come through individual case resolutions or a negotiated program for represented plaintiffs — not through a mailed check to everyone who took Ozempic. In drug MDLs, that typically follows expert rulings and bellwether trials, neither of which has finished here. Amounts would depend on proof of diagnosis, severity, medical costs and lost income. Our Ozempic lawsuit calculator walks through those factors; it is not a prediction.
How cases like this one end
Our copy of the federal courts’ own case database covers 166,050 health care/pharmaceutical product liability casesclosed in U.S. federal district courts between 2015 and 2025:
- 34.5% ended in a settlement recorded by the court. Another 17.9% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 34.5% and 52.4%.
- 9% were decided on a motion before any trial.
- 1 in 2,863 reached a trial (0%), after a median of 32 months.
- Median time from filing to the end of the case: 26.3 months.
- Almost none record a money award in this data (18 of 166,050), and the recorded figures are capped, so we do not publish an average.

Three Things to Watch For
Heavy advertising around a drug millions of people take creates easy openings:
“Claim your Ozempic settlement payment”
There is no Ozempic settlement and no claims website. A text, email or page asking for your prescription details, bank account or Social Security number to “release your share” is not connected to any court.
“You qualify for the class action” calls
These are individual injury suits, not a class anyone is automatically in. A caller who says you qualify because you took Ozempic — without asking about a diagnosis — is selling a sign-up, not reporting a result.
Cheap “Ozempic” sold alongside lawsuit ads
Some sites pair lawsuit news with offers of discounted semaglutide shipped without a prescription. Counterfeit pens are a real problem; buy only through a licensed pharmacy, and keep the box and lot number of what you used.
Lawsuit Against Ozempic — Questions People Actually Ask
Is there a class action lawsuit against Ozempic?
Not in the sense most people mean. The federal cases are individual personal-injury lawsuits grouped for pretrial work in two MDLs (3094 and 3163). There is no class you are automatically part of and no class settlement.
How many people are suing over Ozempic and similar drugs?
As of October 1, 2026, the federal court counts 4,025 pending cases in the stomach-injury MDL and 247 in the vision-loss MDL — 4,272 in total. These include Wegovy, Rybelsus, Mounjaro, Trulicity and Saxenda claims, not only Ozempic.
Has Novo Nordisk settled any Ozempic lawsuits?
No global settlement has been announced as of October 2026. Anyone who says a payout is ready to claim is wrong or selling something.
What injuries are the lawsuits about?
Gastroparesis (stomach paralysis), ileus and intestinal obstruction in MDL 3094; sudden optic-nerve vision loss (NAION) in MDL 3163. Weight loss, nausea or ordinary side effects alone are not the basis of these suits.
Do I need a gastric emptying study?
For a gastroparesis claim in the federal MDL, generally yes. Judge Marston's August 2025 ruling requires a gastric emptying study in the medical records. Other GI injuries depend on their own documentation.
What happens next in the Ozempic litigation?
In the stomach MDL, the court has to rule on the expert evidence heard September 14–18, 2026. In the vision MDL, status conferences are set for October 13, November 17 and December 15, 2026, and the causation and preemption fight runs into 2027.
Is there a deadline to file?
There is no court claim deadline, because there is no settlement. Your personal filing deadline is your state's statute of limitations, which can be as short as one year from injury or discovery. A lawyer licensed in your state can tell you which applies.
I took Ozempic but feel fine. Should I do anything?
No. These cases are only for people with a diagnosed injury. Keep your pharmacy records in case you ever need them, and talk to your doctor — not a lawsuit ad — before stopping a prescribed medication.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
