Wegovy Lawsuit: Where the Stomach and Vision-Loss Cases Stand
Questions about this case?

There is no single Wegovy lawsuit and no Wegovy settlement. Wegovy cases are personal-injury suits against Novo Nordisk, grouped with Ozempic and other GLP-1 drugs in two federal court proceedings in Philadelphia: one over stomach and bowel injuries, one over sudden vision loss. As of October 1, 2026, 4,025 and 247 cases were pending. The next step is a judge's ruling on expert evidence — not a payout.

What the Wegovy Lawsuits Allege
Wegovy is Novo Nordisk's semaglutide drug for weight management, the same active ingredient as Ozempic. The lawsuits allege that GLP-1 drugs, Wegovy among them, can cause gastroparesis (stomach paralysis) and other gastrointestinal injuries such as bowel obstruction, and — in a second group of cases — NAION, a sudden loss of vision in one eye caused by reduced blood flow to the optic nerve. The core claim is failure to warn: the plaintiffs allege that Novo Nordisk knew or should have known of these risks and did not adequately warn patients or their doctors. The vision-loss cases also plead design defect and breach of warranty. Novo Nordisk and Eli Lilly, the other defendant, deny the allegations.
Case Details
Stomach and bowel injuries: In re: Glucagon-like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, MDL No. 3094, No. 2:24-md-03094, U.S. District Court for the Eastern District of Pennsylvania, Judge Karen S. Marston. The court lists Ozempic, Wegovy and Rybelsus (Novo Nordisk) and Trulicity and Mounjaro (Eli Lilly) as the drugs involved (court MDL page).
Vision loss (NAION): a separate MDL No. 3163, same court and same judge, covering Ozempic, Wegovy and Saxenda (Novo Nordisk) and Trulicity (Eli Lilly). Its first case-management order is dated December 23, 2025 (court orders).
Investors, not patients: Moon v. Novo Nordisk A/S, No. 3:25-cv-00713 (D.N.J.), is a securities class action over statements about a trial of a different drug, CagriSema. It does not involve Wegovy patients; see our Novo Nordisk overview.
Status: Waiting on the Expert-Evidence Ruling, No Settlement
The reason the Wegovy lawsuit is in the news: from September 14–18, 2026 Judge Marston held a five-day Rule 702 (“Daubert”) evidentiary hearing in MDL 3094 on two of the court's “cross-cutting issues” — questions that affect every case, with summary-judgment motions briefed alongside. The hearing tests whether plaintiffs' experts may testify on Cross Cutting Issues 2 and 3. As of October 5, 2026, the court's list of orders shows no ruling from it.
No Wegovy settlement exists — no fund, no administrator, no claim form and no deadline.

Who Has a Wegovy Claim
These are not class actions. Each injured person files their own lawsuit, which is then grouped in the MDL. Nobody is included automatically, and there is nothing to sign up for.
The cases concern people who took Wegovy (or another listed GLP-1 drug) and were later diagnosed with gastroparesis or another serious gastrointestinal injury, or with NAION. Proof matters: in an August 15, 2025 ruling, as summarized by the Drug & Device Law Blog, the court excluded the plaintiffs' expert opinion that drug-induced gastroparesis can be reliably diagnosed without a gastric emptying study. Roughly 95% of the MDL 3094 claims allege gastroparesis, so medical records showing that test carry real weight.
Nausea or vomiting that resolved after stopping the drug is not, by itself, what these cases are about. Deadlines to sue (statutes of limitations) are set by state law and can be short; a lawyer can tell you which applies to you.
What a Wegovy Settlement Would Pay
The “average Wegovy settlement” figures on law-firm sites are projections, not court numbers. The first real milestone is the expert-evidence ruling in MDL 3094: if the court excludes the plaintiffs' key experts, many claims could fail; if it admits them, the case moves toward trials and, possibly, negotiations. Either way, any resolution runs through each plaintiff's own lawsuit, not a public claim form.
How cases like this one end
Our copy of the federal courts’ own case database covers 166,050 health care/pharmaceutical product liability casesclosed in U.S. federal district courts between 2015 and 2025:
- 34.5% ended in a settlement recorded by the court. Another 17.9% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 34.5% and 52.4%.
- 9% were decided on a motion before any trial.
- 1 in 2,863 reached a trial (0%), after a median of 32 months.
- Median time from filing to the end of the case: 26.3 months.
- Almost none record a money award in this data (18 of 166,050), and the recorded figures are capped, so we do not publish an average.

Three Wegovy Lawsuit Traps
Millions of people have heard of Wegovy, and “settlement” is a word that gets clicks. Watch for these:
“Claim your Wegovy settlement payment”
There is no Wegovy settlement and no claim form. A text, email or site asking for your pharmacy records, Social Security number or a “processing fee” to release a payment is not connected to any court.
Ads quoting a guaranteed payout
No court has valued a single Wegovy claim. Figures such as a fixed amount per gastroparesis case are advertising projections. Read any retainer before signing, including the fee percentage and who pays case costs.
“You're in the Wegovy class action”
The injury cases are individual lawsuits, not a class action. You are not automatically a member of anything, and no administrator will contact you about a payment you never filed a lawsuit for.
Wegovy Lawsuit — Questions People Actually Ask
Is there a Wegovy settlement?
No. As of October 5, 2026, there is no Wegovy settlement, fund or claim form in either federal MDL. For settlements that are open now, see open class action settlements.
Is there a Wegovy class action lawsuit?
Not for injuries. Wegovy injury claims are individual lawsuits grouped in MDL 3094 (stomach and bowel) or MDL 3163 (vision loss). The class action that names Novo Nordisk, Moon v. Novo Nordisk A/S, is brought by investors over a different drug trial.
What injuries are the Wegovy lawsuits about?
Gastroparesis and other serious gastrointestinal injuries in MDL 3094, and NAION (sudden vision loss in one eye) in MDL 3163. The full GLP-1 picture is on our GLP-1 lawsuit tracker, and the vision cases on our NAION page.
How many Wegovy lawsuits are there?
The court does not publish a count per drug. On October 1, 2026 the JPML reported 4,025 pending cases in MDL 3094 and 247 in MDL 3163, covering all the listed GLP-1 drugs together.
Is a Wegovy lawsuit different from an Ozempic lawsuit?
Legally, barely. Both are Novo Nordisk semaglutide drugs, both are listed in both MDLs, and the cases sit before the same judge. Ozempic is approved for type 2 diabetes and Wegovy for weight management, which affects who took it but not where the case is heard.
What happened at the September 2026 hearing?
From September 14–18, 2026 the court heard evidence on Rule 702 motions in MDL 3094 — whether the plaintiffs' experts are reliable enough to testify on issues common to every case. As of October 5, 2026, no ruling has been posted. That decision shapes everything that follows.
Do I need a gastric emptying study for a Wegovy gastroparesis claim?
It matters a lot. After the court's August 15, 2025 ruling, an expert can no longer testify that drug-induced gastroparesis was diagnosed without one. Ask your doctor what testing is in your records.
I took Wegovy and had side effects. What should I do now?
Talk to your doctor about your health first. Keep pharmacy records showing when you took Wegovy and the medical records for any diagnosis. If you are considering a claim, ask a lawyer about your state's filing deadline, because waiting for a settlement that does not exist yet can cost you the right to sue.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
