Mounjaro Lawsuit: Where the Stomach and Vision-Loss Cases Stand in October 2026

The Mounjaro lawsuit is not one case. Patients who allege Eli Lilly’s tirzepatide drug caused stomach paralysis, bowel obstruction or sudden vision loss are suing in two federal MDLs in Philadelphia, together with Ozempic and Wegovy users. Why it is in the news: Judge Karen S. Marston held a five-day expert hearing on September 14–18, 2026, and no ruling had appeared on the court’s orders page at last check. There is no Mounjaro settlement, no fund and no claim form.

What the Mounjaro Lawsuits Allege
Since August 2023, patients have sued Eli Lilly and Novo Nordisk over injuries they allege followed use of incretin drugs — on Lilly’s side Mounjaro, Zepbound (both tirzepatide) and Trulicity, according to Lilly’s own quarterly report.
Stomach and bowel injuries. The lawsuits allege the drugs can cause gastroparesis (stomach paralysis) and other gastrointestinal injuries, and that the makers did not adequately warn patients or their doctors. The court describes the shared questions as whether the companies “knew or should have known” of that risk and whether they warned adequately.
Vision loss. A second group of cases alleges NAION — sudden damage to the optic nerve that can cause permanent vision loss. These are individual injury lawsuits, not a consumer class action. Lilly and Novo Nordisk deny the allegations.
Case Details
Stomach and bowel injuries: In re: Glucagon-like Peptide-1 Receptor Agonists (GLP-1 RAs) Products Liability Litigation, MDL No. 3094, No. 2:24-md-03094, U.S. District Court for the Eastern District of Pennsylvania, Judge Karen S. Marston. Court page: paed.uscourts.gov.
Vision loss (NAION): a separate MDL No. 3163, No. 2:25-md-03163, same court and judge, created in December 2025.
Outside federal court: Lilly reports similar cases in Delaware, Indiana and New Jersey state courts — New Jersey runs a coordinated docket, In re GLP-1 Gastrointestinal Injuries, BER-L-3367-26 — plus two class action petitions in Israel and two in Canada.
Status on October 5, 2026: Waiting for the Expert Ruling
The Judicial Panel on Multidistrict Litigation’s report of October 1, 2026 lists 4,025 pending cases in MDL 3094 (4,139 filed in total) and 247 in the vision-loss MDL 3163. Those numbers cover all GLP-1 makers; the court does not publish a Mounjaro-only count.
The key event is the Rule 702 (“Daubert”) hearing held September 14–18, 2026, on cross-cutting issues 2 and 3 — whether the plaintiffs’ expert evidence on warnings and related questions is reliable enough to reach a jury. An August 28, 2026 order had moved it from September 10–18. As of October 5, 2026, the court’s list of MDL 3094 orders shows no ruling from that hearing. Whatever the judge decides will shape which claims go forward. No bellwether trial has been scheduled.

Who Could Have a Claim
There is nothing to sign up for. MDL 3094 and MDL 3163 collect individual lawsuits. Nobody is included automatically; each person files their own case, usually through a lawyer.
Cases generally involve people who took Mounjaro (or another GLP-1 drug) and were diagnosed with a serious stomach or bowel injury such as gastroparesis or bowel obstruction, or with NAION. According to a plaintiffs’ firm, a ruling in August 2025 requires gastroparesis claims to be backed by a gastric emptying study in the medical records — nausea alone, or a diagnosis without that test, is not enough.
Lawsuits have filing deadlines (statutes of limitations) that vary by state and often run from when you were diagnosed. If you are weighing a claim, a lawyer can tell you which deadline applies. Injury tiers and what firms screen for: our GLP-1 lawsuit calculator.
Is There a Mounjaro Settlement?
The dollar ranges on law-firm websites are projections, not court figures. If these cases ever resolve, injury lawsuits are typically valued one by one or through a grid that weighs diagnosis, treatment (hospitalization, surgery, feeding tube) and lasting harm — not split evenly. How cases like this one end
Our copy of the federal courts’ own case database covers 166,050 health care/pharmaceutical product liability casesclosed in U.S. federal district courts between 2015 and 2025:
- 34.5% ended in a settlement recorded by the court. Another 17.9% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 34.5% and 52.4%.
- 9% were decided on a motion before any trial.
- 1 in 2,863 reached a trial (0%), after a median of 32 months.
- Median time from filing to the end of the case: 26.3 months.
- Almost none record a money award in this data (18 of 166,050), and the recorded figures are capped, so we do not publish an average.

Three Things to Watch For
Mounjaro is heavily advertised, and so is the litigation about it:
“Claim your Mounjaro settlement” ads
There is no settlement and no official claims site. A form asking for your prescription history, insurance ID or Social Security number to “secure your payout” is collecting leads or data, not filing anything with a court.
“Join the Mounjaro class action”
The U.S. injury cases are individual lawsuits in an MDL, not a class you join. Signing up means hiring a law firm: read the retainer and the fee percentage before you sign, and never pay an upfront fee to “register.”
Cheap “tirzepatide” from unknown sellers
Lilly’s filings warn of counterfeit and mass-compounded incretins. A seller that points to lawsuit headlines to explain why its Mounjaro look-alike is cheaper or “safer” is proving nothing — check with your pharmacist.
Mounjaro Lawsuit — Questions People Ask
Is there a Mounjaro lawsuit settlement?
No. As of October 5, 2026, there is no Mounjaro settlement, fund or claim form. The cases are in pretrial proceedings in MDL 3094 and MDL 3163 in Philadelphia, and Lilly’s filings disclose no settlement.
How many Mounjaro lawsuits are there?
The court does not count Mounjaro separately. On October 1, 2026, the JPML listed 4,025 pending cases in the GLP-1 stomach-injury MDL 3094 and 247 in the vision-loss MDL 3163, across Ozempic, Wegovy, Mounjaro and the other drugs.
Is Mounjaro part of the Ozempic lawsuit?
Yes. Mounjaro and Trulicity (Lilly) are in the same federal MDL as Ozempic, Wegovy and Rybelsus (Novo Nordisk). Status across all brands: our GLP-1 lawsuit tracker.
What was the September 2026 hearing about?
From September 14 to 18, 2026, Judge Marston heard expert testimony under Rule 702 on cross-cutting issues 2 and 3 in MDL 3094. Her ruling decides how much of the plaintiffs’ expert evidence can be used. As of October 5, 2026, no ruling had been posted.
Can I sue over Mounjaro and vision loss?
NAION claims are handled in MDL 3163. In July 2026 the court ordered early work on whether GLP-1 drugs can cause NAION at all and on the adequacy of warnings, with briefing expected to run into 2027. More: our GLP-1 vision-loss lawsuit page.
Is there a Mounjaro class action I can join?
Not in the U.S. The American cases are individual injury lawsuits. Lilly reports two class action petitions in Israel and two in Canada. Other cases against Lilly, including insulin pricing, are on our Eli Lilly lawsuit page.
Do I have to stop taking Mounjaro to file a claim?
No lawsuit requires that, and the litigation is not medical advice. Do not stop or change a prescription without talking to your doctor.
When will the Mounjaro lawsuit settle?
Nobody knows. No bellwether trial is scheduled, the expert ruling is pending, and the vision-loss track is only beginning its causation work. Anyone quoting a payout date is guessing.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
