What the Text-Message Lawsuit Says
The current Saks class action lawsuit is Rushin v. Saks.com LLC, No. 2:26-cv-08743. The lawsuit alleges that Saks.com sent promotional text messages before 8 a.m. or after 9 p.m. in the recipient’s local time, and repeated marketing texts to numbers listed on the National Do-Not-Call Registry for at least 30 days. Both are claims under the Telephone Consumer Protection Act.
The plaintiff says his number has been on the registry since July 2014, that he never gave permission, and that the messages were “not informational or transactional” but meant to sell. He asks for an injunction, statutory damages and treble damages for willful or knowing violations. None of this has been proven; Saks.com has not been found liable for anything.
Case Details
The case was filed on August 7, 2026 in federal court in California. Trade reports place it in the “Western District of California” — a court that does not exist. Our case-watch report found it in the Central District of California, and that the only defendant is Saks.com LLC, not Saks Fifth Avenue or the parent company.
The parent, Saks Global, filed Chapter 11 on January 13 and 14, 2026 (Case No. 26-90103, Bankruptcy Court for the Southern District of Texas, Judge Alfredo R. Pérez). Its plan took effect on June 26, 2026 and the holding company is now Exemplar Luxury Group. The text lawsuit was filed after that date. Bankruptcy documents are on the Stretto case site.
Status: Early Stage, No Settlement
Saks Global lawsuit vs. Puck. The “saks puck lawsuit” runs the other way: Saks Global Enterprises LLC v. Heat Media, Inc., d/b/a Puck, No. N25C-10-070, filed October 7, 2025 in Delaware Superior Court. Saks alleges a “sustained campaign of false and sensationalist reporting” about its finances and seeks compensatory and punitive damages. Puck says it stands by its reporting and calls the suit meritless. Saks is the plaintiff, so there is nothing in it for shoppers. We found no public ruling in 2026 and do not state one.
Saks lawsuit returns. The best-known returns case is from 2015: a shopper in the Central District of California alleged Saks did not post its return policy in store after it refused her returns. Saks said she had returned $149,245 of merchandise in 12 months. We found no 2026 class action about Saks returns or refunds.

Who Could Be in the Proposed Class
The proposed class covers people to whom Saks.com, or someone acting for it, sent more than one marketing text within any 12-month period to a mobile number used as a residential line, with at least one sent before 8 a.m. or after 9 p.m. local time. It reaches back four years before the August 7, 2026 filing.
A class is a proposal until a judge certifies it. If that happens, or a settlement is reached, notice goes out through a court-approved program. Until then, the useful step is to screenshot the texts with timestamps visible and note whether you ever gave Saks your number.
What Money Is Actually on the Table
The only Saks consumer payout we could confirm is closed: Nunez v. Saks Off 5th (San Diego Superior Court), a $1.5 million false-discount settlement paying merchandise certificates worth up to $20. Its claim deadline was March 16, 2025. Saks Off 5th’s online entities went through a Chapter 11 plan of liquidation that took effect June 15, 2026; we could not confirm how that affects unused certificates. Three Things to Watch For
A brand-name lawsuit with no claim form, a bankruptcy and an old closed settlement is easy material for imposters:
“Claim your Saks text settlement” links
There is no Saks text-message settlement. A page or text asking for your card number or a fee to “secure your payment” is not connected to Rushin v. Saks.com.
Old Saks Off 5th claim pages
The Nunez false-discount settlement closed to claims on March 16, 2025. Sites still showing it as open, or offering cash for it, are recycling an expired case.
“Bankruptcy refund” callers
Bankruptcy claims go through the court and the official agent, Stretto. Nobody legitimate calls shoppers to collect a fee to recover a Saks refund or gift card balance.

Not for the text case. As of October 2026 there is no settlement, no administrator, no claim form and no deadline. If that changes, class members are notified through a court-approved notice.
How do I know if I am in the proposed class?
You would need more than one Saks.com marketing text in a 12-month period on a personal mobile number, with at least one before 8 a.m. or after 9 p.m. your time, going back four years from filing. Keep screenshots.
What is the Saks Puck lawsuit?
A defamation suit Saks Global Enterprises filed against Puck’s publisher, Heat Media, in Delaware Superior Court on October 7, 2025 (No. N25C-10-070). Saks is the plaintiff. Puck denies wrongdoing. It offers nothing to customers.
Is there a Saks class action lawsuit about returns?
People searching “saks class action lawsuit returns” usually find a 2015 case over Saks refusing returns from a high-volume shopper and not posting its policy. We found no 2026 class action over Saks returns or refunds.
Did the Saks Global bankruptcy end these cases?
No. The text lawsuit was filed August 7, 2026, after the plan took effect on June 26, 2026. Saks itself is the plaintiff against Puck. Bankruptcy claims are handled through the case on the Stretto site.
How much could people get from the Saks text lawsuit?
Nobody can say. The complaint seeks statutory damages, trebled for willful violations, but nothing has been won or agreed. Use our payout calculator to see how settlement funds usually divide.
What should I do about Saks texts right now?
Screenshot the messages with times visible, note whether you gave Saks your number, check donotcall.gov for your registration, and reply STOP to end the texts. There is nothing to file.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
