Every lawsuit against Prime drink products so far falls into one of three consumer theories, plus business disputes.
Caffeine (Prime Energy). The New York plaintiffs alleged the cans contain 15-25 milligrams more caffeine than the 200 milligrams on the label. PFAS (Prime Hydration Grape). A California plaintiff alleges the Grape Sports Drink contains PFAS, the “forever chemicals,” and that she would not have bought it, or would have paid less, had she known. Prime has said its level was 0.06 parts per trillion. Marketing to minors. Status: One Case Dismissed, Two Unresolved, No Settlement
Caffeine case — dismissed. On July 31, 2025 Judge Failla granted Prime's motion to dismiss in full and closed the case.
