What the Lawsuit Alleges

A June 2024 class action alleged that VNGR Beverage LLC (maker of Poppi) falsely marketed its prebiotic sodas as 'gut healthy' when each can contains only about two grams of inulin fiber — too little, plaintiffs argued, to deliver a meaningful gut-health benefit. The suit alleged false advertising on behalf of all U.S. purchasers.

Current Status

The $8.9 million settlement received final court approval on April 14, 2026. The claim deadline of September 26, 2025 is closed. Payments to approved claimants are expected within ~90 days of approval (roughly May–July 2026).

Who Is Affected & Can You Join?

Class members are U.S. consumers who purchased any Poppi prebiotic soda between January 23, 2020 and July 18, 2025. The claim deadline (September 26, 2025) has passed — new claims can no longer be submitted.

Is There a Payout?

The settlement fund is $8.9 million. Approved claimants were eligible for up to $0.75 per can, $3 per four-pack, $6 per eight-pack or $9 per 12/15-pack (with a $5 minimum). Because over 2 million no-receipt claims were filed, actual per-person payouts will be reduced pro-rata. The claim deadline has closed — you cannot file a new claim.
