Musk Asked the Ninth Circuit for More Time on October 12 — but the Twitter Stock Claim Deadline Did Not Move: Sellers From May 13 to October 4, 2022 Still Have Until November 24, 2026

Pampena v. Musk, Case No. 3:22-cv-05937-CRB, United States District Court for the Northern District of California (San Francisco), Judge Charles R. Breyer; on appeal as No. 26-4928 in the Ninth Circuit. On October 12, 2026, Elon Musk filed a “Streamlined Request for Extension of Time to File Brief” in his appeal of the March 20, 2026 jury verdict that his May 2022 “deal on hold” tweet artificially deflated Twitter’s stock. His opening brief had been due October 22, 2026; the court’s rules allow one such extension of up to 30 days. Nothing in that request touches the investors’ side of the case: people and entities who sold Twitter stock or call options, or bought put options, between May 13 and October 4, 2022 can still submit the claim form online, or by mail postmarked, by November 24, 2026, through TwitterAcquisitionLitigation.com, run by the court-appointed administrator Epiq. Judge Breyer has also allowed late but valid claims until Epiq files its final claims report. A plaintiffs’ attorney estimated total damages at about $2.6 billion, AFP reported.

Musk Asked the Ninth Circuit for More Time on October 12 — but the Twitter Stock Claim Deadline Did Not Move: Sellers From May 13 to October 4, 2022 Still Have Until November 24, 2026 — key figures at a glance

The short answer: the appeal moved, the claim deadline did not

If you sold Twitter shares or call options, or bought Twitter put options, between May 13 and October 4, 2022, the date that matters to you is still November 24, 2026. The court-approved summary notice says: “If you are a member of the Class, you can submit a Claim Form online or postmarked by November 24, 2026.” That deadline belongs to the claims process Judge Charles R. Breyer approved in the district court on July 6, 2026. It is separate from the briefing schedule in Musk’s appeal, and no filing we found asks to change it.

What is new is on the appeal side. The Ninth Circuit docket for Pampena, et al. v. Musk, No. 26-4928, shows this entry: “Streamlined Request for Extension of Time to File Brief filed by Appellant Elon Musk. [Entered: 10/12/2026 12:41 PM]” Under the court’s original schedule notice of July 31, 2026, Musk’s opening brief was due October 22, 2026 and the investors’ answering brief November 23, 2026. A longer appeal does not give class members more time to file — if anything, it means the verdict will stay under review for longer before anyone is paid.

What Musk asked for on October 12, and what the rules allow

A streamlined extension is the Ninth Circuit’s routine first request for more time on a brief, and the rules spell out its limits. Circuit Rule 31-2.2(a) says a party “may obtain a single streamlined extension of time to file that brief not to exceed 30 days,” and that “The Clerk will approve requests that comply with the rule and will provide the parties with a new schedule.” It is a one-time tool: “If a streamlined extension of time is approved, any further request for an extension of time to file a brief must be made in writing pursuant to Circuit Rule 31-2.2(b)”, which requires a showing of diligence and substantial need.

What that means for the calendar, by our count and not from a court order: 30 days after October 22 is November 21, 2026, a Saturday, and under Federal Rule of Appellate Procedure 26(a)(1)(C) a deadline that falls on a weekend “continues to run until the end of the next day that is not a Saturday, Sunday, or legal holiday” — November 23, 2026. The investors’ brief, which was keyed to the old schedule, would normally move as well. As of October 18, 2026, the copy of the appeal docket we could check (CourtListener’s index, last refreshed October 13) showed the request but no clerk’s order with the new dates, so the exact schedule is not confirmed. The original notice also carries a warning that applies to Musk as the appellant: “Failure of the petitioner(s)/appellant(s) to comply with this briefing schedule will result in automatic dismissal of the appeal.”

In the district court, the latest filing in CourtListener’s bulk records (current to September 30, 2026) is dated August 19, 2026, and the court’s electronic feed shows no new entries from October 10, 2026 on.

How do I know if I am eligible — and what a share is worth

This is a jury verdict, not a settlement, so eligibility is set by the class definition the jury and the court worked with: “All persons and entities who sold the publicly traded stock or call options, or purchased the put options, of Twitter, Inc. during the period from May 13, 2022 through October 4, 2022, both dates inclusive, and who suffered damages by Defendant’s violations of § 10(b) and of the Exchange Act.” Musk and anyone who opted out earlier are excluded, and “You may not opt out of this Litigation at this time.” The key word is sold: a sale (or a call sold or put bought) inside the window is what counts.

The notice’s own example: “If you purchased 1,000 Twitter shares any time before May 13, 2022, and sold those shares on May 18, 2022, your damages would equal $7,940.00 (1,000 shares x $7.94, as awarded by the jury for May 18, 2022) plus interest (less any Court approved deductions).” The jury set a separate deflation figure for each trading day, so the per-share amount depends on the day you sold. If you also bought inside the window, the damages “may be reduced to account for any gains attributable to deflation”; the court ordered sales matched to holdings and purchases first-in, first-out. For shares you owned before May 13, 2022, the court held that “the date of purchase does not matter.”

Interest is added: Judge Breyer set prejudgment interest at “the Treasury bill rate pursuant to Section 1961, compounded annually,” from October 4, 2022 through the final judgment of April 3, 2026. Deductions come off: any award “may be proportionally reduced to account for any attorneys’ fees, expenses, or service awards awarded by the Court.” The notice says the verdict entitles class members to claim “the full value of your damages plus interest” — not a share of a fixed fund. No total has been fixed by the court; on verdict day, AFP reported, “An attorney for the plaintiffs estimated the damages at about $2.6 billion.”

Who paid $44 billion for Twitter? Elon Musk. Judge Breyer’s order recounts that he offered “$54.20 per share or about $44 billion total,” announced on April 25, 2022; AFP notes he took over the platform in late October 2022 and later renamed it X. The lawsuit is about the months in between, when, the jury found, his May 13, 2022 tweet that the deal was “temporarily on hold” pushed the price down.

How to submit the Twitter stock class action claim form, and what if you miss November 24

How to submit a class action claim in this case: online through the official site, TwitterAcquisitionLitigation.com, or on the paper claim form mailed with a postmark no later than November 24, 2026. You have to act to get anything — the notice is blunt: “You must submit a Claim Form to collect for any damages you suffered. You may do nothing at all and not submit a Claim Form. If you choose that option, you will not recover anything, but you are and will be bound by any judgments entered by the Court.”

Plan for paperwork. According to the court’s order, “Claimants must already submit their names, contact information, addresses, Social Security Numbers or Taxpayer Identification Numbers, and trading account numbers,” and “Epiq requires documentation and flags ineligibility when it is missing.” In practice that means your old broker’s trade confirmations or account statements for 2022. Judge Breyer turned down Musk’s request to require a government ID.

Missed the date? There is a narrow safety valve. The plaintiffs proposed, and the court approved, that “Epiq should be able to accept all late, but valid, claims that are filed before it submits its final claims report with the Court,” adding that “there is still a hard deadline for such late claims.” The plaintiffs’ reply explains why: class members “living abroad or serving overseas” and brokers who forward notices slowly. The sources we read do not give a date for that final report, so treat November 24, 2026 as the real deadline; a late claim is a fallback, not a plan.

Is the notice real?

Yes. Judge Breyer’s July 6, 2026 order states: “the Court appoints Epiq Class Action and Claims Solutions as the Claims Administrator,” and adopts the plaintiffs’ notice and proof-of-claim form. The summary notice went out on PR Newswire on July 27, 2026 from class counsel, Cotchett, Pitre & McCarthy LLP and Bottini & Bottini, Inc., and names a single website: www.TwitterAcquisitionLitigation.com. Questions about the case go to class counsel — Cotchett, Pitre & McCarthy at (650) 697-6000 or Bottini & Bottini at (858) 914-2001 — and the court file can be read on PACER or at the Clerk’s office, 450 Golden Gate Avenue, San Francisco.

Because the form asks for a Social Security or taxpayer number and brokerage account numbers, type them only into the official site or the official paper form. Class counsel already represent the class, and we saw no filing fee in the official materials. Treat any email, text or caller that asks for a fee, a percentage of your payout, or your brokerage login as a red flag, and check it against the official site before you answer.

Where the case stands

The verdict has already been trimmed once. In the July 6 order, which opens with “Buyer’s remorse is not an exception to the securities laws,” Judge Breyer granted Musk judgment as a matter of law on his May 17, 2022 tweet, denied the rest of his motion and his bid to decertify the class, and approved interest and the claims process. Musk’s lawyers had told AFP minutes after the verdict that he would appeal; the Ninth Circuit opened case No. 26-4928 on July 31, 2026. The October 12 request is the first sign of the briefing calendar slipping. It is a routine filing and says nothing about the strength of either side’s arguments.

For claimants, the practical effect is time. The court has not set a payment date in anything we read, and the appeal will not be argued until the briefs are in. Filing now costs nothing and protects your place if the verdict survives; waiting for the appeal to end means missing November 24, 2026. Our earlier report covers the verdict-day deflation figures and the fee requests in detail. This article explains the claims process; it is not investment, legal or tax advice.
