In re: Allergan Biocell Textured Breast Implant Products Liability Litigation, MDL No. 2921, Case No. 2:19-md-02921, United States District Court for the District of New Jersey, Judge Brian R. Martinotti, Magistrate Judge Leda Dunn Wettre. The first “surgical explant” bellwether trial was set for October 19, 2026 by Case Management Order No. 37. On August 28, 2026 the judge entered a text order: the matter “has been resolved in principle,” all pending deadlines and the November 2, 2026 trial date “are vacated,” all cases are stayed, and the parties must report on status within 60 days — by October 27, 2026. No amount and no claims process are public. The MDL had 1,370 pending actions on October 1, 2026; separately, AbbVie said in its August 3 quarterly report that in June 2026 it agreed to resolve substantially all U.S. lymphoma (BIA-ALCL) lawsuits.

The short answer: there is no breast implant trial on October 19
Anyone searching for the breast implant lawsuit trial set for October 19, 2026 will find the date on many pages, including, until now, our own case page. It is no longer on the court’s calendar. On August 28, 2026, Judge Brian R. Martinotti of the U.S. District Court for the District of New Jersey entered a short text order on the master docket of In re: Allergan Biocell Textured Breast Implant Products Liability Litigation, MDL No. 2921 (docket entry 788). In full:
“The Court has been advised that this matter has been resolved in principle. All pending deadlines, including the upcoming pretrial deadlines and November 2, 2026 trial date are vacated. All cases are stayed pending execution of a final agreement. The parties will update the Court on status no later than 60 days from the entry of this order.”
Three things follow directly from those four sentences. There is no jury trial in the federal breast implant cases this month, or on the November 2 date the order mentions. Every case in the MDL is on hold while the lawyers turn an agreement “in principle” into a signed one. And the next date the court has set is a status update due no later than 60 days after August 28 — by our count, October 27, 2026.
What the order does not say matters just as much: it names no amount, no list of covered cases and no claims process. We checked the court’s public MDL 2921 page again on October 12, 2026; it lists case management orders up to No. 43 (August 10, 2026) and no settlement notice, claim form or administrator.
What the first trial was supposed to decide
The October 19 date came from Case Management Order No. 37, signed by Judge Martinotti on October 14, 2025. It scheduled “the first surgical explant trial” for October 19, 2026 as “a one-Plaintiff trial,” with the plaintiff to be picked by the court by June 30, 2026 out of six worked-up cases, and a second explant trial “at a date after October 19, 2026.” The pool had been built in July 2025: plaintiffs chose eight cases and Allergan four, twelve in all. “Explant” cases are those of women who had the textured implants surgically removed; they are a different group from the lymphoma cases discussed below.
Case Management Order No. 42, entered by Magistrate Judge Leda Dunn Wettre on July 14, 2026, named the two cases being readied for the first two trials, Henson and Rabin, and set the run-up: motions in limine filed in Henson and only served in Rabin on August 10, proposed final pretrial orders on October 2, and a final pretrial conference on October 6, 2026. The August 28 order vacated all of that. At some point after Case Management Order No. 37 the first trial date moved to November 2, 2026, the date the August 28 order cancels; the order that moved it is not among the case management orders the court posts, and we could not read it.
A bellwether verdict binds only the plaintiff in that case. Its practical role is to show both sides how a jury reacts to the evidence on liability and damages. In the explant cases that question now goes unanswered in this court: the cases were resolved in principle before any jury was seated. Allergan has not admitted the allegations; in AbbVie’s words, plaintiffs “generally seek monetary damages, medical monitoring and attorneys’ fees.”
Who is affected: which implants, which cancer
What brand of breast implants are being recalled? The lawsuits concern Allergan’s BIOCELL textured products, recalled worldwide on July 24, 2019 at the FDA’s request. The FDA’s announcement listed Natrelle Saline-Filled, Natrelle Silicone-Filled, Natrelle Inspira Silicone-Filled and Natrelle 410 Highly Cohesive Anatomically Shaped breast implants, plus the Natrelle 133 Plus and Natrelle 133 tissue expanders. It is not a lawsuit over breast implants in general; smooth implants and other makers’ products are not part of MDL 2921. If you do not know what you have, the FDA suggests “asking your surgeon or obtaining the record of your surgery (operative notes) from the facility where it was performed.”
What type of cancer is associated with textured breast implants? Breast implant-associated anaplastic large cell lymphoma, BIA-ALCL. The FDA is explicit that it “is not breast cancer — it is a type of non-Hodgkin’s lymphoma (cancer of the immune system),” usually found in the scar tissue and fluid around the implant, and that “the risk of BIA-ALCL is higher for textured surface implants versus smooth surface implants.” At the time of the recall the agency counted 573 unique BIA-ALCL cases worldwide and 33 deaths; 481 of the cases were attributed to Allergan implants, and it put the risk with BIOCELL implants at “approximately six times” that of other makers’ textured implants. Main symptoms, per the FDA: persistent swelling, a mass or pain near the implant, often years after surgery.
The cases fall into two groups. Lymphoma cases: AbbVie, Allergan’s parent, told investors in its quarterly report dated August 3, 2026 that “in June 2026, AbbVie reached an agreement to resolve substantially all the United States-based ALCL lawsuits, which will be dismissed with prejudice.” Everything else: the same filing counted “approximately 1,300 other lawsuits” in MDL 2921, about 475 in state courts and about 1,080 in other countries. The Judicial Panel on Multidistrict Litigation’s report dated October 1, 2026 lists 1,370 actions pending in MDL 2921 and 1,585 filed over its life.
Is there money, and do you need to do anything?
There is no breast implant settlement you can file a claim for. The June 2026 lymphoma agreement resolves lawsuits that were already on file, and AbbVie has not disclosed its amount. The August 28 deal in the MDL is, in the court’s words, an agreement “in principle” awaiting a final agreement; no terms are public. Neither is a class settlement with a notice, a fund, an administrator or a claim deadline, and we found none posted by the court.
If you have a case on file in MDL 2921, it is stayed, and any payment would come through your own lawyer under whatever final agreement is signed — ask your lawyer what the agreement in principle means for your case. If you never sued, nothing in the court record we read invites you to join, and no court has set a filing deadline tied to this deal.
How to get breast explant covered by insurance? This litigation does not answer that, and a settlement in it would not pay a hospital bill for a removal you have not yet had. The FDA warns that “even if you have complications, the cost of implant removal or implant replacement may not be covered by insurance”; coverage questions go to your health plan and your surgeon. Note the FDA’s line on BIOCELL implants: “If you have no symptoms, we are not recommending the removal” of them.
What happens after 10 years of breast implants? The FDA does not give a ten-year figure on the pages we read, but it states that “breast implants are not lifetime devices. The longer you have your implants, the more likely it will be for you to have them removed or replaced,” and that complications become more likely over time. That is a medical question, not a legal one; it does not by itself create a claim in this case.
What happens next
Only one dated step is on the record. The parties must update Judge Martinotti on status “no later than 60 days from the entry of this order” — the order was entered August 28, 2026, so the update is due by October 27, 2026 (our calculation). Until a final agreement is executed, “all cases are stayed.”
No hearing, claim deadline, opt-out deadline or payment date has been set. No new trial date has been set either: the October 19 and November 2, 2026 dates are both gone. Any change will appear as a filing on the MDL docket or a new order on the court’s MDL page; we will report it with the date when it does.
Real or scam: “claim your breast implant settlement”
Because no claims process has been published, any website, text or caller offering to “register” you for an Allergan or breast implant settlement, asking for a fee, your Social Security number or your implant records, is not acting for the court. A legitimate class settlement would be announced in a court-approved notice with a named administrator; none exists here.
Do not schedule surgery to “qualify” for anything. The FDA’s 2019 announcement said the agency “does not recommend removal for patients without symptoms due to potential risks.”
Where the record stands on October 12, 2026
We checked again on October 12, 2026. The latest entry we could read on the MDL 2921 docket is the August 28 order; the full docket is behind PACER, and the free copies we use may not show anything filed since. The court’s own MDL page still lists Case Management Order No. 43 of August 10, 2026 as the latest order, and it points readers to PACER “for the most up to date filings.” The federal count stood at 1,370 pending actions on October 1, 2026.
Outside New Jersey, AbbVie reported that a Dutch court dismissed all claims against Allergan in December 2025 and that plaintiffs appealed in March 2026.
