What This Page Covers
This page answers one question: when and how the Nelnet data-breach settlement pays. For what the case is about and who is in the class, see our Nelnet settlement overview.
Short version of where the money stands: the fund is $10,000,000. The court has approved it. The administrator, A.B. Data, has not posted a payment date on NelnetSettlement.com. Nothing on the official site says Nelnet settlement checks or electronic payments have gone out.
Case Details
The settlement was approved in In re Data Security Cases Against Nelnet Servicing, LLC, No. 4:22-cv-03191, U.S. District Court for the District of Nebraska (lead case Spearman v. Nelnet Servicing, LLC). Senior U.S. District Judge John M. Gerrard signed the final approval order and the judgment on May 21, 2026, dismissing the case with prejudice.
A related case sits in Oklahoma: Carr v. Oklahoma Student Loan Authority, No. 5:23-cv-00099-R, Western District of Oklahoma. That matters for the payout, as explained below.
Nelnet Settlement Update: Why No Money Yet
1. Final approval — done May 21, 2026.
2. Funding. Nelnet and the other settling entities must pay the remaining $9,600,000 into the fund within 25 days of the final-approval judgment.
3. The Effective Date. This is the date all conditions in Section 13 are met. One condition is that final judgments or dismissals with prejudice are entered in the Nebraska case and in Carr in Oklahoma. We could not confirm from the docket whether that has happened, or whether anyone appealed.
4. Payment. Under Section 7.11.6, the administrator distributes payments within 30 days after the later of the Effective Date or the court’s review of the administrator’s declaration.
So the honest Nelnet settlement payout answer is: about a month after the Effective Date, and that date has not been announced. The official FAQ itself warns that appeals “can sometimes take a year or more.” Before electronic payments go out, the agreement says claimants will be notified and given a chance to update their payment details — watch your email for that.
Who Gets Paid — Only Verified Claimants
Nobody is paid automatically. The official site states that if you did nothing, “you will receive no payment.” The claim deadline was March 5, 2026.
Filing a claim was not enough either. In the count reported to the court in May 2026, 1,035,674 claim forms had been filed, but only 308,531 were verified as coming from class members. The court explained why: many people filed because Nelnet was their servicer, but the class only covers about 2.5 million borrowers whose loans originated with EdFinancial or the Oklahoma Student Loan Authority (OSLA). Claims that could not be matched to one of those loans were rejected.
Late claims were rejected too. The court noted those claimants were told they could ask the court to review that decision.
How Much Each Person Gets
What the agreement fixes:
• Documented losses: up to $5,000 per person, with proof.
• Lost time: up to 4 hours at $25 per hour, capped at $100.
• Pro rata cash payment: an equal share of what is left, for verified claimants who claimed no losses. California residents at the time of the breach get two times the base amount.
• Credit monitoring: two years, with $1,000,000 in identity-theft insurance.
Before any of that, the court approved deductions from the $10 million: $3.33 million in attorneys’ fees, $65,000 in costs, service awards of $1,500 each to twenty-seven plaintiffs ($40,500), and administration costs of about $852,721.
How cases like this one end
Our copy of the federal courts’ own case database covers 4,339 federal civil cases of this typeclosed in U.S. federal district courts between 2015 and 2026:
- 3.6% ended in a settlement recorded by the court. Another 21.4% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 3.6% and 25%.
- 4.7% were decided on a motion before any trial.
- 1 in 723 reached a trial (0.1%), after a median of 18 months.
- Median time from filing to the end of the case: 4.1 months.
- Only 1,909 of them (44%) record a money award at all; the median of those is $13,000.

Three Things to Watch For
With 1,035,674 claims filed and only 308,531 verified, many people are waiting for money that is not coming — an easy group to target:
Emails from the wrong address
The court-approved notice came from help@mg.abdataclassactionmail.com “on behalf of Nelnet Data Security Settlement.” The administrator’s contact address is info@nelnetsettlement.com. A payment email from any other domain, or one asking for a fee to “release” your payment, is not from the administrator.
Offers to “fix” a late or rejected claim
Late claims were rejected. The only route the court described is a request for review to the court itself. The official Fix My Claim portal only works with the Claim Number from a Notice of Deficiency letter. Nobody can buy you back in.
Calls that mix the settlement with your loan
The settlement pays cash and credit monitoring for a data breach. It does not forgive, reduce or pause student loans. A caller who links your payout to your loan account, or asks for your loan login, is not the administrator.
Nelnet Settlement Payout — Questions People Actually Ask
What is the Nelnet settlement payout date?
As of October 12, 2026, none has been announced. Under Section 7.11.6 of the agreement, payments go out within 30 days after the later of the Effective Date or the court’s review of the administrator’s declaration. The Effective Date has not been published.
Have Nelnet settlement checks been mailed?
Not according to the official site, which shows no payment update as of October 12, 2026. If you chose an electronic payment, the agreement says you will be notified and given a chance to update your details before money is sent.
How much will I get from the Nelnet settlement?
Unknown. The official FAQ says the amount depends on the types of relief chosen and how many claims are approved. Documented losses can be paid up to $5,000 and lost time up to $100. Everyone else gets an equal share of what is left, doubled for California residents.
Why was my Nelnet settlement claim rejected?
Most likely because your loan did not originate with EdFinancial or OSLA. The court said many people “thought they were class members when they were not” just because Nelnet serviced their loans. Of 1,035,674 claims, 308,531 were verified.
How do I check my claim status?
Call A.B. Data at 1-877-388-1763 or email info@nelnetsettlement.com, and have your claimant ID or Claim Number ready. If you got a Notice of Deficiency letter, use the Fix My Claim page on NelnetSettlement.com. Moved? Use its Change of Information Form or write to Nelnet Data Security Settlement, c/o A.B. Data, Ltd., P.O. Box 173032, Milwaukee, WI 53217.
What if my check is lost or expires?
Checks are void 60 days after they are issued. If a check is lost or damaged, ask the administrator in writing for a replacement. A reissued check must be cashed within 30 days of mailing, or the money is forfeited. Electronic payments are not reissued once sent to the details you confirmed.
What happens to uncashed money?
It is shared again among people who cashed or received their payment, if each share would be at least $5. Anything left after that goes as a cy pres award to a cybersecurity public-interest organization. No date for either step has been set.
How long do Nelnet payments take to process?
That search is usually about student-loan payments, not this settlement. The settlement does not change your loan, grace period or repayment terms — for those, contact your loan servicer. This page covers only the data-breach settlement payout.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
