As of October 2026, one Jefferson Health lawsuit over online tracking is still open: Thorpe v. Thomas Jefferson University Hospitals. It alleges that Meta’s tracking tools sent data from Jefferson’s website and its MyJeffersonHealth portal (Jefferson’s version of MyChart) to Facebook. On September 29, 2026 the judge refused to bring back the wiretap, negligence and privacy claims. Breach-of-contract and unjust-enrichment claims continue. There is no settlement and no claim form.

What the Lawsuit Says Happened
Jefferson Health serves the Greater Philadelphia area and South New Jersey. Its patient portal is called MyJeffersonHealth; the login page runs on Epic’s MyChart, and there is a MyJeffersonHealth mobile app.
The complaint alleges that Jefferson installed Meta’s tracking tools — the Meta Pixel, the Meta SDK, the Conversions API and similar code — on its website, the MyJeffersonHealth portal and the app. According to the lawsuit, those tools sent Meta what patients did: signing in or out of the portal, actions inside it, scheduling appointments, and messages about doctors, treatments, prescriptions and conditions.
In the earlier case, the patients said they began seeing Facebook ads about diabetes, kidney stones and smoking cessation — topics they had discussed with Jefferson providers through the portal. Jefferson denied in court filings that it used the Meta Pixel on its patient portals. It acknowledged using third-party tracking on its public websites, which it says do not contain private medical information.
Case Details
The open case is Thorpe v. Thomas Jefferson University Hospitals, Inc., No. 2:25-cv-07167, in the U.S. District Court for the Eastern District of Pennsylvania, before Judge Cynthia M. Rufe. It was filed on December 18, 2025. That was the day after the same judge dismissed its predecessor, Murphy v. Thomas Jefferson University Hospitals, No. 2:22-cv-04674, filed on November 22, 2022. The court calls the Thorpe complaint “materially identical” to the last Murphy complaint, and the same lawyer represents both sets of plaintiffs.
The Murphy claims against Meta itself were transferred to the Northern District of California and joined the In re Meta Pixel Healthcare Litigation. Murphy ended after the plaintiffs’ lawyers asked to swap in a new named patient. The judge refused and dismissed the case, noting that the class-certification deadline had been missed.
Status: Three Claims Out, Two Still Alive
On September 29, 2026 the court denied the plaintiff’s request to reconsider and refused to certify the question for an early appeal. As of October 6, 2026 we could not confirm any later filing. No class has been certified. There is no settlement, no fund, no administrator, no claim form and no deadline.

Who Could Be Affected
The lawsuit is brought for a proposed class of Jefferson Health patients who used its web properties. No court has certified that class, so nobody is a class member yet. There is nothing to sign up for.
What you can check now: whether you used jeffersonhealth.org or MyJeffersonHealth, what you did there (booked an appointment, messaged a doctor, searched a condition, refilled a prescription), and roughly when you last did it. Our form on this page asks exactly those three things, so you can see how your use lines up with the allegations.
Two other names cause confusion. Jefferson Healthcare in Port Townsend, Washington, is a different hospital with its own, separate pixel settlement. Lehigh Valley Health Network patients had a separate ransomware case, covered below.
Is There Any Money?
Hospital tracking cases elsewhere have ended in every direction: some settled with cash funds, some were dropped, some are still being fought. See which MyChart cases actually paid, or the Loyola Medicine and Hennepin Healthcare pages for one settlement and one dismissal. For a rough number if a case does settle, use the MyChart settlement calculator.
The Jefferson Health data breach that did pay was at Lehigh Valley Health Network, which became part of Jefferson Health on August 1, 2024. LVHN agreed to a $65 million settlement over a BlackCat ransomware attack, discovered February 6, 2023, that exposed data on at least 134,000 people. Class members did not need to file a claim; checks went out by mail. Use the data breach settlement calculator to compare.
How cases like this one end
Our copy of the federal courts’ own case database covers 80,165 other statutory actions casesclosed in U.S. federal district courts between 2015 and 2025, 11.8% of them filed as class actions:
- 26% ended in a settlement recorded by the court. Another 22.4% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 26% and 48.4%.
- 7.4% were decided on a motion before any trial.
- 1 in 155 reached a trial (0.6%), after a median of 22 months.
- Median time from filing to the end of the case: 5 months.
- Only 1,717 of them (2.1%) record a money award at all; the median of those is $195,000.

Three Things to Watch For
Three similar names and one real payout make this an easy case to confuse:
The “Jefferson Healthcare” settlement is not yours
That settlement covers patients who visited jeffersonhealthcare.org in Washington State between March 19, 2020 and March 19, 2024. It offered a 12-month CyEx Privacy Shield voucher, and its claim deadline was November 17, 2025. A page steering Philadelphia or New Jersey patients there is wrong.
Fake MyJeffersonHealth “settlement” login links
There is no Jefferson Health tracking settlement, so an email telling you to sign in to MyJeffersonHealth to “confirm your payment” is phishing. Open the portal yourself, never through a link in such a message.
Fees to “release” LVHN money
Real LVHN breach checks were mailed automatically by relief tier. Nobody legitimate charges a fee or asks for your full Social Security number by phone to send them.
Jefferson Health Lawsuit — Questions People Actually Ask
Is there a Jefferson Health MyChart lawsuit?
Yes. Thorpe v. Thomas Jefferson University Hospitals, No. 2:25-cv-07167 in the Eastern District of Pennsylvania, alleges that Meta tracking tools on Jefferson’s website, the MyJeffersonHealth portal and app sent patient activity to Facebook. As of October 6, 2026 it is open on two claims.
Is MyJeffersonHealth the same as MyChart?
Yes. MyJeffersonHealth is Jefferson’s name for its patient portal, and the login runs on Epic’s MyChart. Epic is not a defendant; the lawsuit is against the hospital system.
Is there a settlement or claim form?
No. There is no settlement, fund, administrator, claim form or deadline. No class has been certified. If that changes, the court-approved notice will name an administrator.
What did the judge decide in September 2026?
On September 29, 2026 Judge Rufe refused to reconsider her August 3, 2026 ruling. That ruling threw out the wiretap, negligence and privacy claims as filed too late, because a nearly identical lawsuit had been filed in 2022. Contract and unjust-enrichment claims continue.
I saw a Jefferson Healthcare pixel settlement. Is that my hospital?
Only if you were a patient of Jefferson Healthcare in Port Townsend, Washington. That case was in a Washington state court (No. 24-2-00070-15), and its claim deadline was November 17, 2025. It has nothing to do with Jefferson Health in Pennsylvania and New Jersey.
Was there a Jefferson Health data breach?
The one with a settlement was at Lehigh Valley Health Network, now part of Jefferson Health. A 2023 BlackCat ransomware attack on a physician practice exposed data on at least 134,000 people, and LVHN agreed to a $65 million settlement in Lackawanna County Court. We found no other Jefferson Health data breach class action with an open claim deadline.
Did Jefferson admit using the Meta Pixel?
No. Jefferson denied in court filings that it used the Meta Pixel on its patient portals. It acknowledged using third-party tracking on its public websites. The portal allegations are unproven.
What is worth doing right now?
Note when and how you used jeffersonhealth.org or MyJeffersonHealth, and keep any letters from Jefferson or LVHN. Turn off ad personalisation in your Facebook settings if health ads bother you. Ignore anyone selling access to a Jefferson Health tracking settlement — it does not exist.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
