So Delicious Dairy Free Recall: 2,209,728 More Salted Caramel Cluster Pints Pulled for Stones — Nine Months After 4,665,608 Were Recalled for the Same Problem. The Refund Comes From a Phone Line, Not a Lawsuit.
Danone USA recalled So Delicious Dairy Free® Salted Caramel Cluster Non-Dairy Frozen Dessert pints (SKU 136603, UPC 744473476138) with best-by dates on and before April 3, 2028 on September 15, 2026, citing “small stones and other hard objects, within the cashew inclusions.” The announcement gave no quantity. The FDA enforcement report dated September 30, 2026 does: recall H-1394-2026, Class II, 2,209,728 units, nationwide, status “Ongoing.” It is the second recall of the same pint: on December 15, 2025 Danone pulled 4,665,608 US units (plus 665,128 in Canada) with best-by dates before August 8, 2027, and said it had “already identified and corrected this issue.” The new recall starts with best-by August 28, 2027. Refunds or replacement coupons come from the So Delicious Consumer Care Line, 1-833-367-8975. As of October 9, 2026 we found no lawsuit and there is no settlement or claim form.

The short answer: one flavor, 2.2 million pints, refund by phone
If you have a pint of So Delicious Dairy Free Salted Caramel Cluster Non-Dairy Frozen Dessert in the freezer, check the UPC and the best-by date. The recall announced by Danone USA on September 15, 2026 covers UPC 744473476138 (SKU 136603) with best-by dates on and before April 3, 2028. The reason, in the company's words: “the potential presence of foreign materials, such as small stones and other hard objects, within the cashew inclusions.” The FDA-posted notice adds that “No other So Delicious Dairy Free® codes, flavors, or products are affected,” that the problem was found “through consumer complaints,” and that “product shipped going forward is not affected.”
What the announcement did not say was how many pints. Fox station coverage of the recall noted that “It’s unclear how many pints have been recalled.” The answer is now on the record. The FDA's enforcement report, dated September 30, 2026, lists the recall as H-1394-2026, classifies it Class II, puts the quantity at 2,209,728 units and the distribution as “nationwide.” As of October 9, 2026 its status is “Ongoing.”
The same pint, the same stones, nine months apart
This is not the first time. On December 15, 2025, Danone recalled the identical product — same SKU 136603, same UPC 744473476138 — with best-by dates before August 8, 2027, for the same reason: “small stones and other hard objects, within the cashew inclusions.” That notice told customers “the company has already identified and corrected this issue and will soon be able to bring back the frozen dessert so many people enjoy.” The FDA's enforcement report for that first recall, H-0398-2026, counts 4,665,608 units distributed in the US and 665,128 in Canada; the FDA terminated it on January 29, 2026, and its recall page now reads “This recall has been completed and FDA has terminated this recall.”
The dates show what happened next. The September 2026 enforcement report lists 29 best-by codes, and the earliest is August 28, 2027 — three weeks after the cutoff of the first recall. In other words, the pints recalled now carry best-by dates after the first recall's range ended, which suggests they were made after the company had said the issue was corrected; the latest code is April 3, 2028. Together the two recalls cover 6,875,336 US pints by our arithmetic (about 6.9 million), plus the Canadian units from the first round. The September notice does not explain why the problem returned.
How to check your pint and get your money back
Look for three things on the carton: the flavor Salted Caramel Cluster, UPC 744473476138, and a best-by date on or before April 3, 2028. Packaging graphics changed in February 2025 without a change of UPC, so older and newer cartons can both be covered. If all three match, the FDA notice is plain: “Consumers who purchased affected product should not consume it.”
The remedy is a “replacement coupon or refund,” requested from the So Delicious Dairy Free Consumer Care Line at 1-833-367-8975, staffed Monday to Friday, 9 a.m. to 6 p.m. Eastern, or through the contact webform at sodeliciousdairyfree.com/contact-us/. The notice does not set a dollar amount, does not say whether you need a receipt or the carton, and does not set a deadline. Our practical advice: photograph the UPC and best-by date before you throw the pint away, and keep any store receipt.
Is there a lawsuit or a settlement? Not as of October 9, 2026
The Top Class Actions write-up of the recall, published September 20, 2026, has drawn 85 comments, many of them just “Add me.” There is nothing to be added to. A recall is a voluntary product withdrawal reported to the FDA; it is not a class action, and it does not come with a claim form. Top Class Actions itself reported that “The company is not currently facing legal action over the So Delicious Dairy Free recall,” and relayed Danone's statement that “no illnesses or injuries have been linked to the recalled product so far.” Our own search of federal dockets on CourtListener on October 9, 2026 returned no case mentioning “Salted Caramel Cluster” and no 2026 case against Danone over So Delicious.
That makes any message promising “So Delicious settlement” money a red flag. The only official channels in the recall notice are the phone number 1-833-367-8975 and the webform on sodeliciousdairyfree.com; neither is described as asking for bank details, fees or a Social Security number. If you broke a tooth or were otherwise hurt, that is an individual injury claim, not a class matter — keep the carton, the object you found and your dental or medical records, and report it to the company and to the FDA. Should a lawsuit be filed, we will report the court and case number here.
What Class II means and what to watch for next
The FDA sorts recalls by risk. Class II, the category of both So Delicious recalls, is “a situation in which use of or exposure to a violative product may cause temporary or medically reversible adverse health consequences or where the probability of serious adverse health consequences is remote.” It is a step below Class I, which the FDA reserves for a “reasonable probability” of “serious adverse health consequences or death.”
Two things will mark the end of this recall: the FDA changing H-1394-2026 from “Ongoing” to “Terminated,” as it did for the first recall on January 29, 2026, and the flavor returning to shelves with best-by dates after April 3, 2028. The open question is the one the first recall was supposed to settle — whether the cashew problem is now actually fixed.
