What the CVS Privacy Class Action Says — and What It Is Not
The CVS class action behind the September emails. Brewer, et al. v. CVS Pharmacy, Inc. and Criteo Corp. is about the “alleged disclosure of health or private information, personal information, browsing data, identifiers, or other data” of people who used CVS's websites and app “to Criteo or other technology providers or third parties through technology embedded” on them. The settlement agreement describes Criteo as “a digital advertising company that provides advertising support, including on the CVS Website and CVS App.” The complaint, filed May 15, 2026 and later amended, alleges violation of the federal Electronic Communications Privacy Act, state statutory claims, breach of confidence, invasion of privacy and negligence. CVS and Criteo deny violating any law, and the court has not decided who is right.
It is not a hacking case. The lawsuit is about data allegedly passed on through tracking technology built into CVS's own sites and app, not about an intruder stealing records. A message that asks you to “verify your breached data” is not from this settlement.
Settled before it was filed. Per the agreement, the plaintiffs' lawyers contacted CVS and Criteo before suing. The parties mediated with a JAMS mediator on March 17, 2026, agreed on terms over the following weeks, and only then filed the complaint. The other CVS lawsuits are different kinds of cases. The opioid settlements pay governments and, separately, health plans. The insulin-pricing cases target CVS Caremark, CVS's pharmacy benefit manager. Florida's insulin suit is brought by the state. The supplement suit is an early-stage consumer class action. None of them is the reason your inbox has a CVS settlement email.

Privacy settlement: Brewer, et al. v. CVS Pharmacy, Inc. and Criteo Corp., Case No. CACE-26-008094, Circuit Court of the 17th Judicial Circuit in and for Broward County, Florida, before Judge Shari A. Olefson. On the court's preliminary approval order the caption reads Ariel Brooks, et al v. Criteo Corp., et al, No. CACE26008094 — the same case, which helps if you look it up on the Broward clerk's docket. Opioids: the national opioid settlement with states and local governments (documents at nationalopioidsettlement.com), separate settlements with Florida, West Virginia, New Mexico and Nevada, and a case in the U.S. District Court for the District of Rhode Island in which the Justice Department intervened in December 2024, alleging violations of the Controlled Substances Act and the False Claims Act.
Drug pricing (CVS Caremark): the federal insulin-pricing MDL in New Jersey, the FTC's insulin-rebate case, and Florida's state lawsuit announced September 22, 2026. All three big pharmacy benefit managers are defendants in the MDL and in Florida's suit, while the FTC has halted its litigation against CVS pending the proposed settlement described below; our OptumRx lawsuit page tracks those cases in detail.

Status on September 30, 2026: One Open Claim, Everything Else Pending
Opioids: settled with governments, still litigated elsewhere. Forty-five states, the District of Columbia and the eligible territories take part in the national settlement; Maryland does not. CVS's quarterly report filed in August 2026 says suits by non-participating local governments (including Philadelphia) and by private parties such as hospitals continue, and that CVS is defending the Justice Department case. In May 2026 a Florida state court entered a directed verdict for CVS and other defendants in a hospital group's case; the plaintiffs have appealed.
CVS Caremark and the FTC: proposed settlement. In July 2026 CVS and the FTC announced a proposed settlement resolving the FTC's investigations of CVS's pharmacy benefit business — rebates, pharmacy networks, contracts and vertical integration. It is subject to public comment before the FTC decides on a final order. CVS's description mentions no payments to individual patients.
Supplement class action: filed May 26, 2026; we found no settlement. Shareholder case: the defendants moved to dismiss in May 2025, and CVS still lists the case as pending.

Who Qualifies for the CVS Settlement
The class is “All living individuals who accessed the CVS Digital Properties in the United States prior to July 27, 2026” — cvs.com, cvshealth.com and the CVS app. No purchase and no account are required, and there is no minimum number of visits. Shopping only in a CVS store does not make you a member. Excluded are the defendants' officers, directors and employees, the judge and court staff, governmental entities, and anyone who opts out.
You do not need the email to file. Membership depends on having used the sites, not on receiving notice. Email notices went to addresses CVS and Criteo had; the claim form itself asks for a Login ID only “if known.” You can file online or download the form and mail it.
Other CVS cases: the national opioid money goes to states, local governments and tribes, not to individuals. A separate opioid settlement for health plans and other third-party payors, which the court finally approved, as the official settlement website reported on September 23, 2026, excludes consumers. The supplement case proposes a class of U.S. buyers of two CVS-brand products but has no settlement.
How Much the CVS Settlement Pays
The headline $20.5 million is a ceiling, not a fund that must be spent. It includes administration costs, attorneys' fees and service awards: class counsel may ask for up to 37.5% of it — $7,687,500 — plus service awards for the class representatives of no more than $2,500. Money left after valid claims are paid “shall revert to Defendants.” Payment comes 120 days after final approval and any appeals, by PayPal, Venmo, Zelle or check; a paper claim is paid by check, and checks void after 180 days.
Opioids: CVS's national deal was sized at about $5.0 billion over ten years — about $4.9 billion to states and local governments and about $130 million to tribes. It pays governments, not individuals. Everything else: no fund and no consumer claim form.

Three Things to Watch For
A settlement that reaches millions of inboxes at once is an easy template to copy:
“Pay a small fee to release your CVS payment”
Filing is free. The only official site is CVSDigitalPrivacySettlement.com, and the administrator, Simpluris, is at (888) 654-1271 and info@CVSDigitalPrivacySettlement.com. A fee request, a gift-card request or a “processing charge” is not part of this settlement.
Look-alike links asking for your Social Security number
The real claim form asks for your name, address, email, phone and — if known — the Login ID from the notice. It does not ask for a Social Security number, and neither the agreement nor the notice mentions one. Type the settlement address into your browser yourself instead of clicking a link.
“Claim your share of the CVS opioid settlement”
The opioid settlements pay states, local governments, tribes and, in a separate deal, health plans. Individuals cannot file into them. A page promising you personal opioid money from CVS is not describing a real claim program.
