OptumRx Lawsuit: Florida's Insulin Case and the Other OptumRx Cases, Sorted
On September 22, 2026, Florida Attorney General James Uthmeier announced a lawsuit accusing OptumRx, the other two largest pharmacy benefit managers, three insulin makers and three rebate companies of driving up insulin prices. It is the newest of several OptumRx cases people search for: an inhaler wrongful-death suit, a federal insulin MDL, an FTC case and a closed robocall settlement. As of September 25, 2026, there is no settlement and no claim form for insulin or inhaler costs.

What Florida Alleges, and the Other OptumRx Cases
- Florida insulin suit (2026): The state alleges that Eli Lilly, Novo Nordisk and Sanofi inflated published list prices for insulin and related diabetes drugs and paid rebates and fees to CVS Caremark, Express Scripts and OptumRx in exchange for preferred formulary placement, “so that both sides profited when the sticker price rose.” The state says uninsured patients, people in a deductible and people paying percentage-based coinsurance are charged against the list price, not the negotiated one. Citing earlier testimony by a Lilly executive, it says Lilly hands about $210 of every $280 Humalog vial back to PBMs as rebates and discounts. The complaint also covers GLP-1 and combination products including Ozempic, Trulicity, Victoza and Soliqua. Rebate aggregators Zinc, Ascent and Emisar are also defendants. These are allegations; no court has ruled on them.
- Inhaler lawsuit (2025): Shanon and William Schmidtknecht sued OptumRx and Walgreens individually and for the estate of Cole Schmidtknecht of Appleton, Wisconsin. Their complaint says his health plan's 2024 formulary no longer covered Advair Diskus without prior authorization, that on January 10, 2024 a pharmacy employee told him his inhaler would cost $539.19 out of pocket, and that he died on January 21, 2024, at 22. OptumRx denies that it dictates coverage decisions, says the plan chose the formulary and that it included three alternatives needing no prior authorization, and argues the claims are preempted by ERISA. This is an individual wrongful-death case, not a class action.
- FTC insulin case (2024): The Federal Trade Commission accused Caremark, Express Scripts and OptumRx and their rebate aggregators of “anticompetitive and unfair rebating practices that have artificially inflated the list price of insulin drugs.”
- Insulin MDL (2023 to now): Hundreds of federal insulin-pricing cases against the same three manufacturers and three PBMs are coordinated in New Jersey.
- Robocall class action (2024): A Telephone Consumer Protection Act case said OptumRx placed prerecorded “clinical adherence” calls to people who were not its customers. It has settled.

- Florida: State enforcement action filed in Florida's Eleventh Judicial Circuit (Miami-Dade County), announced September 22, 2026: two counts under the Florida Deceptive and Unfair Trade Practices Act and one under the Florida Antitrust Act. The case number and judge were not included in the Florida Attorney General press release.
- Inhaler case: Schmidtknecht v. OptumRx Inc, No. 1:25-cv-00093 (E.D. Wis.), Judge Byron B. Conway, filed January 21, 2025. Walgreen Co. and a Walgreens pharmacy are co-defendants.
- Insulin MDL: In re Insulin Pricing Litigation, MDL No. 3080, master docket 2:23-md-03080 (D.N.J.), Judge Brian R. Martinotti.

Status on September 25, 2026: Florida Just Filed, Nothing to Claim
- Florida insulin suit: just filed. Uthmeier presented the case at a news conference in Tampa this week, WUSF reported. The defendants have not answered yet. Earlier state insulin cases from California, Louisiana and Pennsylvania ended up in federal court and were transferred into the New Jersey MDL even though motions to send them back to state court were pending; California's case was transferred on December 11, 2024. Whether Florida's case stays in Miami-Dade is an open question.
- FTC case: OptumRx is the last PBM left. Express Scripts settled on February 4, 2026, and Caremark signed a proposed consent order on July 14, 2026 that was released for public comment. On June 12, 2026 the FTC withdrew the case against the Optum companies from adjudication to consider a proposed consent agreement; the FTC case page (last updated July 14, 2026) shows no final OptumRx order yet. The FTC describes these settlements as changes to business practices; its case page mentions no payments to individual patients.
- Insulin MDL: ongoing. 516 actions were pending on September 1, 2026 (618 filed in total), according to the Judicial Panel on Multidistrict Litigation.
- Inhaler case: in discovery. The court denied OptumRx's motion to dismiss on July 25, 2025; OptumRx filed its answer on August 22, 2025. The parties asked in May 2026 to extend the discovery and dispositive-motion deadlines, and the docket lists orders on extension motions in May and August 2026. No trial date appears on the public docket.
- Robocall settlement: closed. Final approval March 31, 2026; the claim deadline was February 4, 2026.

Who Could Be Affected
- Florida insulin suit: This is a lawsuit by the state, not a class action, so there is nothing to join. The state says the harm fell on Floridians who pay based on list price: the uninsured, people in a deductible and people on percentage-based coinsurance. About 2.3 million Florida adults have diagnosed diabetes, the Attorney General says. If the case ever produces restitution, the state would announce how it is paid.
- Insulin MDL and FTC case: We found no consumer claim process against OptumRx in either. The FTC case page describes business-practice changes and mentions no payments to individuals.
- Inhaler case: An individual wrongful-death case. It has no class and no class members.
- Robocall settlement: Covered people who were not OptumRx customers and got prerecorded clinical adherence calls on a cell phone or VoIP line between April 20, 2020 and October 22, 2025. Claims had to be filed by February 4, 2026.

There is no insulin settlement with OptumRx and no claim form. Florida's case is brought by the state. Nobody can file you in, and you should not pay a fee or hand over prescription or Social Security details to be “added.”
Mixing up the robocall settlement
The $1.86 million Patterson settlement was about prerecorded phone calls to non-customers. It closed to claims on February 4, 2026 and has nothing to do with insulin or inhaler prices.

Is there an OptumRx class action settlement?
The one most people find is the $1.86 million robocall settlement in Patterson v. OptumRx (S.D. Ind.), approved March 31, 2026. Its claim deadline, February 4, 2026, has passed. There is no settlement over insulin or inhaler prices.
What is the OptumRx inhaler lawsuit?
A wrongful-death suit filed January 21, 2025 in federal court in Wisconsin by the family of 22-year-old Cole Schmidtknecht. They say he could not afford his Advair Diskus inhaler after a 2024 formulary change and died days later. OptumRx denies liability. The court let the case proceed in July 2025, and it is now in discovery. It is not a class action.
Can I join Florida's insulin lawsuit against OptumRx?
No. It is an enforcement action by the State of Florida, not a class action, and there is nothing to sign. If it ever produces restitution for residents, the Attorney General would announce it; see the Florida Attorney General press release.
