The Cleveland Clinic lawsuit in the news is Weatherly v. Cleveland Clinic Foundation, a proposed class action filed December 8, 2025 in federal court in Florida. It alleges that Cleveland Clinic’s website passed visitors’ health-related activity to ad-tech companies, and it lists patient portal correspondence among the data. As of October 6, 2026 there is no settlement, no fund and no claim form. A separate, older Cleveland Clinic data breach at a billing vendor led to a $400,000 class settlement; its claim deadline passed in 2024.

What the Tracking Lawsuit Says
According to the 58-page complaint, as summarized by ClassAction.org, Cleveland Clinic placed tracking code from Adobe, Google, Amazon, Magnite, Index Exchange and OpenX on its website. The suit alleges this code sent third parties what visitors did on the site: which physicians they looked for, health conditions, treatment locations, types of procedures, sensitive medical questions, attempts to schedule appointments and patient portal correspondence.
The complaint points to Cleveland Clinic’s own privacy policy, which says that “no information provided by patients during medical consultations or requests for medical appointments is ever used for marketing purposes,” and alleges that statement is false. These are allegations; Cleveland Clinic has not been found liable. The summary we read does not name the Meta Pixel among the trackers.
Case Details
Weatherly et al. v. Cleveland Clinic Foundation et al., No. 0:25-cv-62530, U.S. District Court for the Southern District of Florida, filed December 8, 2025. The defendants are the Cleveland Clinic Foundation and Cleveland Clinic Florida Health System Nonprofit Corporation. The claims are brought under the federal Electronic Communications Privacy Act and the Florida Security of Communications Act, both wiretap statutes.
Status: Filed, No Settlement
The only Cleveland Clinic data breach case with a settlement we found is the MedInform vendor case below, and its claim deadline was September 11, 2024. Nothing is open to file today.

Who the Proposed Class Covers
The complaint seeks a class of all individuals in the United States whose online actions and communications were intercepted by third parties through Cleveland Clinic’s website during the limitations period. It is not limited to Florida, even though the case was filed there.
The patient portal is Cleveland Clinic MyChart, built by Epic. If you used the public website to look up a doctor, a condition or an appointment, or used MyChart for messages, note which you used, what you did there and roughly when you last did it. Our form on this page asks exactly those three things. You do not need to sign up anywhere to be part of a class if one is ever certified.
What a Case Like This Pays
For how other hospital tracking cases ended, see our MyChart claim form overview and the MyChart settlement calculator, which use only resolved cases, such as Wellstar.
The one Cleveland Clinic data breach settlement we found shows the scale of a small vendor case: Gero v. MedInform, Inc. reached a $400,000 class settlement offering up to $5,000 for documented losses or a pro rata payment of about $200, with attorneys’ fees of up to $133,333.33 coming out of the fund. Its claim deadline was September 11, 2024.
How cases like this one end
Our copy of the federal courts’ own case database covers 24,037 other fraud casesclosed in U.S. federal district courts between 2015 and 2025, 27.4% of them filed as class actions:
- 17.3% ended in a settlement recorded by the court. Another 22.5% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 17.3% and 39.8%.
- 10.4% were decided on a motion before any trial.
- 1 in 111 reached a trial (0.9%), after a median of 30 months.
- Median time from filing to the end of the case: 7 months.
- Only 735 of them (3.1%) record a money award at all; the median of those is $663,000.

Three Things to Watch For
A big hospital name plus a pending privacy suit is easy material for imposters:
“Claim your Cleveland Clinic MyChart payment”
There is no claim form in the tracking case. A site asking for your MyChart login, date of birth or Social Security number to “verify” you is collecting data, not filing a claim.
Old MedInform notices recycled
The MedInform settlement closed for claims on September 11, 2024. A message saying you can still file, or that you must pay a fee to release a MedInform check, is not from the real administrator.
Fake MyChart messages and texts
Phishing that copies MyChart branding works well after a privacy headline. Log in only by typing mychart.clevelandclinic.org yourself, never through a link about a lawsuit.
Cleveland Clinic Lawsuit — Questions People Actually Ask
Is there a Cleveland Clinic MyChart lawsuit?
Yes, in the sense that a proposed class action filed December 8, 2025 alleges Cleveland Clinic’s website shared visitors’ health-related activity with ad-tech firms, and it lists patient portal correspondence among that data. It is Weatherly v. Cleveland Clinic Foundation, No. 0:25-cv-62530, in the Southern District of Florida. It is aimed at Cleveland Clinic, not at Epic.
Is there a settlement or a claim form?
No. As of October 6, 2026 we found no settlement, no fund, no administrator, no claim form and no deadline in the tracking case.
Does it only cover Florida patients?
No. It was filed in Florida and names Cleveland Clinic Florida, but the proposed class is all individuals in the United States whose activity on Cleveland Clinic’s website was intercepted. Ohio patients fall within that definition if the allegations are proven.
Which tracking tools does the lawsuit name?
Per the ClassAction.org summary: Adobe, Google, Amazon, Magnite, Index Exchange and OpenX. The summary does not mention the Meta Pixel.
Was there a Cleveland Clinic data breach?
Not at Cleveland Clinic itself in what we found, but at a billing vendor. MedInform reported on May 24, 2023 that an intruder accessed Cleveland Clinic patients’ names, addresses, Social Security numbers, billing and financial account information in December 2022. That case, Gero v. MedInform, produced an agreed $400,000 settlement, and the claim deadline was September 11, 2024.
I got a MedInform letter. Can I still file?
No. The claim deadline was September 11, 2024. If you filed on time, questions about payment go to the administrator, Analytics Consulting, LLC.
What is the Cleveland Clinic patient portal called?
Cleveland Clinic MyChart. It is software made by Epic, but the lawsuit is against Cleveland Clinic. Epic is not a defendant.
What should I do now?
Nothing has to be filed. Note whether you used the website or MyChart, what you did there and when you last did it. Keep any letter that names Cleveland Clinic or MedInform, and watch for official notice if the case settles. Our data breach settlement calculator covers breach cases with open claims.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
