As of October 12, 2026 no payment date has been announced for either Bank of America-related settlement people are searching for. The $17.5 million Infosys McCamish data breach settlement was approved on December 18, 2025 and the company says the money is paid into the fund — but we found no official payment date and no final per-person amount. The $2.25 million 7-Eleven ATM fee settlement had an approval hearing set for August 21, 2026; we could not confirm that it took place or the outcome.

Which Bank of America Settlement Check Are You Waiting For?
This page covers only the money. Bank of America was not a defendant in the data breach case; the claims ran against the vendor Infosys McCamish. For what the data breach case is about and who qualifies, see our Bank of America data breach settlement page.
Two different settlements produce two different checks:
1. The data breach settlement — McNally v. Infosys McCamish Systems, LLC. A $17,500,000 fund. Paid only to people who filed a claim by December 1, 2025. Administrator: Kroll Settlement Administration.
2. The 7-Eleven ATM fee settlement — Schertzer v. Bank of America, N.A. A $2,250,000 fund for customers charged more than one balance-inquiry fee in one visit to an FCTI ATM inside a 7-Eleven between May 1, 2018 and November 16, 2021. Current account holders who got a notice are paid automatically; former account holders had to claim by June 29, 2026. Also administered by Kroll.
A separate settlement, the EY and Bank of America MOVEit breach, has its own page.
Case Details
Data breach: No. 1:24-cv-00995-JPB, U.S. District Court for the Northern District of Georgia, Judge J. P. Boulee. On December 18, 2025 he held the final approval hearing — the minute entry records that there were no objections — and granted final approval, awarding class counsel $5,833,333.33 in fees plus $45,281.57 in expenses, and $2,500 service awards to the class representatives. Those come out of the fund before anyone else is paid. The last filing on the docket in our case database (current to September 30, 2026) is the hearing transcript, filed January 8, 2026.
ATM fees: No. 3:19-cv-00264-DMS-MSB, U.S. District Court for the Southern District of California, Judge Dana M. Sabraw. The Final Fairness Hearing was set for August 21, 2026 at 1:30 PT. The docket shows a filing on August 24, 2026; we could not read it, so we cannot confirm whether final approval was granted.
Status: Approved, Funded, No Payment Date Published
As of October 12, 2026 we found no official notice saying the Bank of America settlement payment has been sent, or when it will be. We also could not read the settlement agreement’s distribution deadlines, so we do not give one.
ATM fee settlement: hearing was set for August 21, 2026, outcome unconfirmed. Payments come only after final approval and any appeals.
Who Gets a Check Automatically, and Who Had to Claim
Data breach (McCamish): nobody is paid automatically. The official site says “the only way to receive benefits from this Settlement is to submit a valid and timely Claim Form.” The deadline was December 1, 2025. If you did not file, no check is coming. If you filed, the administrator decides whether the claim is valid and may ask you for more information — not answering in time invalidates the claim.
7-Eleven ATM fees: two groups. Current Bank of America account holders who received an email or postcard notice do not need to do anything. Former account holders had to file by June 29, 2026; those who filed online could pick electronic payment or a paper check, and if they picked nothing, a check is mailed. Paper claim forms are paid by paper check.
Bank of America Settlement Check Amount: Estimates, Not Final Figures
Data breach — what you could get with a valid claim:
• Documented losses: up to $6,000 per person, with paperwork.
• Residual cash payment: estimated at about $30, “in any event no more than $599.” It is pro rata — more valid claims means a smaller share.
• Credit monitoring: two years, with $1 million in identity theft insurance.
If documented-loss claims use up the fund, they are cut pro rata and there is no residual cash payment or credit monitoring at all. About 3.7 million people were sent notice of the breach.
ATM fees: every eligible person gets an equal pro rata share of the net fund. The exact amount has not been determined, because it depends on how many former account holders filed valid claims. For a rough sense of how settlement shares shrink, try our settlement payout calculator.
How cases like this one end
Our copy of the federal courts’ own case database covers 129,730 other contract casesclosed in U.S. federal district courts between 2015 and 2026, 6% of them filed as class actions:
- 30.7% ended in a settlement recorded by the court. Another 20.2% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 30.7% and 50.9%.
- 7.5% were decided on a motion before any trial.
- 1 in 72 reached a trial (1.4%), after a median of 29.3 months.
- Median time from filing to the end of the case: 7.6 months.
- Only 7,691 of them (5.9%) record a money award at all; the median of those is $407,000.

Three Things to Watch For
Long waits after a claims deadline are exactly when fake payment messages land:
“Pay a fee to release your settlement check”
Fees and costs come out of the fund before you are paid; a real administrator never asks you to send money first. Kroll’s official sites for these cases are infosysdatasettlement.com and oonfeesettlement.com, and both say they are the only authorized websites. Kroll’s online claim forms for the breach case ran on forms.ksacms.com.
Calls or texts “from Bank of America” about your deposit
Current account holders in the ATM fee case are paid automatically. Nobody needs your online banking login, PIN or a one-time code to send it. Hang up and call the number on your card.
“Late claim” or “guaranteed payout” services
The claim deadlines passed on December 1, 2025 and June 29, 2026. A site offering to file for you now, or promising a fixed check amount, is selling something the settlement does not offer.
Bank of America Settlement Check — Questions People Actually Ask
What is the Bank of America settlement payout date?
As of October 12, 2026 none has been announced. The $17.5 million McCamish data breach settlement was approved December 18, 2025 and Infosys says the fund is paid and the settlement effective, but we found no official notice of when class members will be paid. For the 7-Eleven ATM fee settlement, a final approval hearing was set for August 21, 2026, and we could not confirm the outcome.
How much is the Bank of America settlement check amount per person?
Not final for either case. For the data breach settlement, the residual cash payment is estimated at about $30 and capped at $599; documented losses can be reimbursed up to $6,000. For the ATM fee settlement, everyone eligible gets an equal share of the net $2.25 million fund, amount not yet determined.
Do you actually get money from class action settlements?
Only if you are in the class and meet the settlement’s rules. In the data breach settlement, only people who filed a valid claim by December 1, 2025 can be paid. In the ATM fee settlement, current account holders who got a notice are paid automatically. And nobody is paid before final approval and the end of any appeals.
Did Bank of America have a lawsuit?
Yes, several. The two settlements behind most check searches are Schertzer v. Bank of America, N.A. (No. 3:19-cv-00264, S.D. Cal.) over 7-Eleven ATM balance-inquiry fees, and the McCamish data breach settlement (No. 1:24-cv-00995, N.D. Ga.) covered on our data breach page.
How do I check the status of my Bank of America settlement payment?
Use the official site and administrator, not search ads. Data breach: infosysdatasettlement.com, (833) 621-8670, Kroll Settlement Administration, P.O. Box 225391, New York, NY 10150-5391. ATM fees: oonfeesettlement.com, (833) 447-8321. Have your claim ID or notice ID ready.
How will the Bank of America settlement check be paid?
In the ATM fee case, former account holders who claimed online chose electronic payment or a paper check; paper claims get a check. The data breach settlement’s notice refers to both “Settlement checks” and “electronic payments,” so expect one of those. Keep your mailing address current with the administrator.
What happens if I don’t cash my settlement check?
In the data breach settlement, money left after the time for cashing checks expires — including uncashed checks and unredeemed electronic payments — goes in equal parts to the Network Systems and Security Lab at the University of Georgia and the Electronic Frontier Foundation. If your check is lost or expiring, contact Kroll before that window closes.
How do I file a claim for a class action lawsuit against ATMs?
For the Bank of America 7-Eleven ATM fee settlement, it is too late: former account holders had to file by June 29, 2026, and current account holders never needed to. For other ATM fee cases, check our list of open class action settlements.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
