What These Cases Are About
The ATM surcharge litigation alleges that Visa and Mastercard network rules prevented ATM operators from charging less for transactions routed over cheaper networks, which kept surcharges artificially high for anyone withdrawing cash from an ATM that was not their own bank's. Consumers paid the difference, transaction by transaction, over many years. The defendants deny the allegations. Because the rules operated at the network level, the classes are enormous — anyone who paid an out-of-network ATM surcharge in the United States over a period stretching back to October 2007 — which is why the totals across these cases now exceed $430 million.
Case Details
The cases are federal class actions in the United States District Court for the District of Columbia. Mackmin v. Visa and Burke v. Visa are separate cases with separate classes and separate money, and a person can fall into both. Burke covers surcharges paid at independent (nonbank) ATMs — the machines in convenience stores, bars and hotels rather than in bank branches. Each settlement has its own court-authorised administrator and its own website, which is the only place a genuine claim form ever appears.
Each Case, Checked September 13, 2026
Mackmin v. Visa — $197.5 million. Approved and paying, but closed to claims. The claim deadline was January 22, 2025 and has long passed. Digital payments to 296,877 valid claims began in April 2026. If you filed, this is the one you are waiting on; if you did not, it cannot be joined now. The administrator's site, ATMClassAction.com, blocks connections from outside the United States, so check payment status there directly.
Bank of America / 7-Eleven ATM fees — $2.25 million. Closed. The claim deadline was June 29, 2026.
Don't miss the claim deadline
Claims are due by February 10, 2027. We'll email you 7 days and 1 day before the deadline.
Who Will Be Covered by Burke
The Burke class, as certified for settlement in the August 14, 2026 order, covers anyone in the United States who was charged an unreimbursed surcharge (access fee) to withdraw cash from a deposit account with an ATM or PIN-debit card at an independent ATM — one “not owned by Visa, Mastercard, or any bank or other financial institution” — located in the U.S. or its territories between October 24, 2007 and August 14, 2026. Residents of California, Illinois, Massachusetts and Michigan are also in statewide classes under those states' antitrust laws; that changes nothing about filing. Not covered: bank-owned ATMs (that is Mackmin), credit-card cash advances, prepaid cards, and any fee your bank reimbursed. No proof of individual transactions is required to file: the claim form asks for an estimated count of surcharged withdrawals, sworn under penalty of perjury, and states that “the Claims Administrator may ask you for additional documentation or proof that supports your claim.” Payment is pro rata by number of approved transactions.

Why This Case Attracts Fake Claim Forms
A settlement with a class of tens of millions, no proof requirement at filing and a claim window that is open until February 10, 2027 is close to ideal conditions for fraud. Three things to check:
Any “ATM settlement claim form” that is not on NonbankATMSurchargeSettlement.com
As of September 13, 2026 the only open ATM surcharge claim form is Burke's, at NonbankATMSurchargeSettlement.com (A.B. Data, 1-866-893-1052). A page offering an ATM claim form at any other address is either about a different case entirely or is collecting your details for something other than a settlement. The Mackmin site, ATMClassAction.com, is for payment questions only — its claims closed in January 2025.
Requests for your bank account or card number to “verify”
Genuine administrators in these cases have not required transaction proof, and none needs your card number to establish eligibility. A request for full account credentials is the clearest signal there is.
Lookalike addresses
The Burke address is the administrator's, published in the court-approved notice: NonbankATMSurchargeSettlement.com. Check any link against the notice or the court docket rather than against a search result — settlement lookalike domains buy ads.
Questions People Actually Ask
Is there an ATM class action claim form open right now?
Yes — one. As of September 13, 2026, the $167.5 million Burke v. Visa settlement is accepting claims at NonbankATMSurchargeSettlement.com until February 10, 2027. Mackmin closed in January 2025, and the Bank of America/7-Eleven settlement closed on June 29, 2026.
I filed for the ATM settlement. Where is my money?
If you filed before January 22, 2025 you are in Mackmin, where digital payments to 296,877 valid claims began in April 2026 after several schedule delays. Payment questions in that case go to that settlement's administrator, not to Visa or your bank.
How do I file the Burke claim, and what does it ask?
Online at NonbankATMSurchargeSettlement.com, by phone at 1-866-893-1052, or by a mailed form postmarked by February 10, 2027 to Non-Bank ATM Surcharge Fee Settlement, c/o A.B. Data, Ltd., P.O. Box 173053, Milwaukee, WI 53217. The form asks for your name, address, mobile number and email (payments are sent digitally), whether you paid an unreimbursed surcharge at an independent ATM with a debit card between October 24, 2007 and August 14, 2026, and an estimated number of such withdrawals — a four-digit integer, certified under penalty of perjury.
Do I need receipts for ATM fees from 2007?
No — not to file. The court-approved claim form says “you do not need to provide any documentation at this time,” consistent with how Mackmin was administered. It also says the administrator “may ask you for additional documentation or proof that supports your claim,” including bank statements, so the transaction count you give should be an honest estimate, not a guess at the maximum.
Can I be in both settlements?
Yes. Mackmin and Burke are separate cases with separate classes and separate funds. Having been paid in one does not exclude you from the other, though Mackmin can no longer be joined.
How much will Burke pay per person?
Unknown until the claim numbers are in — the notice itself says “nobody can know in advance how much the payment will be.” Payment is pro rata by transactions claimed, from a net fund of roughly $114 million if the fee request of up to 30 percent, up to $3 million in administration and the service awards are all granted. As a reference point: Mackmin divided $197.5 million among 296,877 claims, less administration and fees. The per-transaction value falls as more people file.
What is a nonbank ATM?
One operated by an independent company rather than a bank — the machines in convenience stores, petrol stations, bars and hotels. Burke covers surcharges at those, which is why it is a different class from earlier ATM cases.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
