The Allstate lawsuit in the news is Oklahoma’s: on July 7, 2026 the state sued Allstate, alleging a scheme to deny or underpay wind and hail roof claims. Separately, a federal class action over driving data collected through phone apps is moving forward in Chicago. As of October 2026, none of the active cases has a settlement, a claim form or a deadline.

What the Lawsuits Against Allstate Say
There is no single Allstate lawsuit. Allstate’s own quarterly filing with the SEC lists the matters it considers significant, and they fall into three groups.
Claims handling. Oklahoma’s Attorney General alleges an internal program the petition calls the “Disaster Payment Minimization Scheme”: limits on field adjusters, reliance on third-party inspectors, and internal standards never disclosed to policyholders. Elsewhere, suits in multiple states allege Allstate underpays total-loss car claims and wrongly depreciates labor costs on home claims.
Driving data. Texas and a federal class action allege that Allstate’s Arity unit embedded tracking software in apps such as Life360, collected location data from more than 45 million consumers, and used it to justify higher premiums.
Everything else. A California agents’ misclassification case, a Justice Department case against Allstate’s National General unit, and older life-insurance and securities disputes. Allstate denies the allegations in these cases; none has been decided on the merits.
Case Details
Oklahoma: filed by Attorney General Gentner Drummond on July 7, 2026 in Cleveland County District Court, a state court. It pleads the Oklahoma Consumer Protection Act, the Oklahoma Racketeer-Influenced and Corrupt Organizations Act, civil conspiracy and unjust enrichment (AG announcement).
Driving data, federal: Sims v. The Allstate Corporation, No. 1:25-cv-00407, U.S. District Court for the Northern District of Illinois, filed January 14, 2025.
Driving data, Texas: State of Texas v. The Allstate Corporation et al., District Court of Montgomery County, announced January 13, 2025 (Texas AG release).
Agents: Canchola v. Allstate Insurance Company, Central District of California, filed March 2023.
Allstate’s filing for the quarter ended June 30, 2026 puts its reasonably possible loss above reserves, across the matters it could estimate, at zero to $51 million pre-tax (Form 10-Q).
Status as of October 2026: Active Cases, No Open Claim Form
Arity driving-data class action: as reported on March 19, 2026, the Illinois court refused to dismiss most of the case. It threw out counts based on premium increases under the filed-rate doctrine but kept claims for statutory damages. The court noted 38 separate causes of action. Amended complaints were due March 20 and answers April 17. The docket shows filings as recently as September 2026; we found no report of class certification.
Texas driving-data suit: pending in state court; no resolution reported.
Hilario (California homeowners): the most recent finally approved Allstate settlement we could confirm — $4 million, final approval reported December 4, 2025. It is closed to new participants. (A separate Arizona uninsured/underinsured motorist settlement, Loughran, has preliminary approval per Allstate’s 10-Q.)
So the honest answer to “is there an Allstate settlement I can claim?” is: not as of October 12, 2026.

Which Case, If Any, Covers You
Oklahoma homeowners with an Allstate policy whose wind or hail claim was denied or cut are the people the Oklahoma suit is about. There is nothing to sign up for; any restitution would come through the state’s case.
Drivers who used apps with Arity’s software — the Texas filing names Life360 as an example — are the people the federal driving-data case is about; the complaint alleges Allstate paid app developers to embed Arity’s software in apps such as Life360 and GasBuddy. Check the court’s class definition before assuming you are covered. See our Life360 lawsuit page for the app side.
Owners of a totaled car paid by Allstate fall under the separate total-loss cases. Those are covered on our Allstate total loss settlement page; the Pennsylvania and Louisiana settlements there are closed.
Arizona drivers with uninsured/underinsured motorist claims: the 10-Q reports a preliminarily approved settlement in Loughran v. MIC General Insurance Corporation, one of the Arizona coverage-stacking cases. If you are in that class, the official notice mailed to you is the document to follow.
Hurt in a crash with an Allstate driver? That is an individual claim, not a class action — our Allstate car accident settlement calculator explains how those are valued.
Is There Money? Only From One Closed Settlement
The most recent finally approved Allstate class settlement we could confirm is Hilario v. Allstate Insurance Company, No. 3:20-cv-05459 in the Northern District of California: $4 million to resolve claims that Allstate overcharged homeowners by inflating their homes’ square footage. It received final approval in December 2025. Payment timing for that class is not something we could confirm from an official source.
Allstate’s own estimate — zero to $51 million across the matters it could size — covers many cases at once. It is an accounting disclosure, not a promise to anyone.
How cases like this one end
Our copy of the federal courts’ own case database covers 83,315 other statutory actions casesclosed in U.S. federal district courts between 2015 and 2026, 11.8% of them filed as class actions:
- 25.6% ended in a settlement recorded by the court. Another 22.4% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 25.6% and 47.9%.
- 7.4% were decided on a motion before any trial.
- 1 in 156 reached a trial (0.6%), after a median of 21.8 months.
- Median time from filing to the end of the case: 4.9 months.
- Only 1,756 of them (2.1%) record a money award at all; the median of those is $199,500.

Three Things to Watch For
A household brand, several cases in the news and no claim form invites imposters:
“Claim your Allstate storm refund”
The Oklahoma case is a state lawsuit, not a class settlement. The Attorney General’s announcement describes restitution sought for affected consumers by the State and mentions no sign-up or claim process, so be wary of anyone asking for a fee or personal data to ‘include’ you.
Driving-data “settlement” texts
The Arity case has no settlement. A text or ad asking for your Life360 login, your phone’s location history or your driver’s license to “verify” your share is collecting data, not filing a claim.
Old Hilario notices recycled
The $4 million Hilario settlement is closed. A message asking you to “re-confirm” bank details for it, or to pay a release fee, is not from a court-appointed administrator.
Allstate Class Action — Questions People Actually Ask
Is Allstate in a class action lawsuit?
Yes, several. The largest active Allstate class action lawsuit is the federal driving-data case in Illinois (1:25-cv-00407), which survived most of a motion to dismiss in March 2026. Allstate also faces putative class actions over total-loss car valuations and home-claim depreciation, plus a California agents’ case. If you are looking for a class action lawsuit Allstate customers can file a claim in today, none is open.
What is the Oklahoma lawsuit against Allstate about?
Filed July 7, 2026, it alleges Allstate ran a program to deny or underpay wind and hail roof claims while selling policies as full replacement coverage. Reporting on the complaint says third-party engineering and adjusting firms supplied reports supporting predetermined denials. These are allegations; nothing has been decided.
Is there an Allstate settlement I can file a claim for?
Not as of October 12, 2026. The most recent finally approved Allstate settlement we could confirm, Hilario ($4 million, California homeowners), received final approval in December 2025 and is closed. A separate Arizona uninsured/underinsured motorist settlement (Loughran) has preliminary approval; if you are in that class, follow the mailed notice. If a new Allstate settlement is reached, the court-approved notice names the administrator and the deadline.
Does Allstate actually pay claims?
Allstate pays claims every day; the lawsuits are about whether it pays enough. The Oklahoma suit and the total-loss and depreciation cases each allege systematic underpayment. Allstate continues to defend these cases, and no court has found the claims true. If your own claim was denied, our insurance bad faith guide explains the options.
How do I file an accident claim with Allstate?
That is a claim under a policy, not part of any lawsuit, and this page cannot file it for you. Use the claims contact in your policy documents or call your agent. If you were injured by an Allstate driver, our Allstate car accident calculator explains how injury claims are valued.
What is the Allstate Arity driving-data lawsuit?
Texas and private plaintiffs allege Arity, an Allstate subsidiary, paid app developers to embed its software, collected location data from more than 45 million consumers and used it to justify higher premiums. Texas filed in Montgomery County; the federal class action is in Illinois.
What about the Allstate total loss settlement?
Those are separate cases about how Allstate valued totaled cars. The Pennsylvania and Louisiana settlements are both closed; details are on our Allstate total loss settlement page. Total-loss suits in other states are still pending, per Allstate’s 10-Q.
Is a lawsuit against Allstate the same as a complaint to my state?
No. A lawsuit against Allstate by a state attorney general, like Oklahoma’s or Texas’s, is brought by the state, and any restitution is decided there. A class action is brought by private plaintiffs for a class. A complaint to your state insurance department is a separate administrative route for your own claim.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
