Second, the fault rule — a few states still bar recovery entirely if you were even slightly at fault, while most reduce the payout by your share. On top of that sits the arithmetic: documented medical bills, lost income, out-of-pocket costs, and a figure for pain and suffering that is usually derived from the medical bills. This is why documentation moves a settlement far more reliably than argument. An adjuster can dispute what your pain was worth; a stack of itemised bills and a treating physician's notes are much harder to argue with.
