Uber Lawsuit, Settlement and Class Action Guide: Where Every Case Stands

Questions about this case?

AI Legal Assistant · free · answers in seconds · general information, not legal advice

As of September 30, 2026, we found no Uber case with an open claim form. The largest is the passenger sexual assault litigation: 4,588 federal cases pending before one judge as of September 1, 2026; a July 13, 2026 order set jury selection for the next test trial for September 30, 2026. Those are individual lawsuits, not a class you sign up for. The FTC and 21 states are suing over Uber One, but no refund fund exists. The driver-pay settlements in New York ($290 million fund) and Massachusetts ($148 million from Uber) are older, and New York's claim deadline of February 28, 2025 has passed.

The Uber Cases, One by One

“Uber lawsuit” covers very different cases, and who can get money differs in each. Passenger sexual assault (MDL 3084): riders allege Uber failed to protect them from drivers; each case is an individual injury claim. Uber One (FTC and states): the government alleges Uber charged people for its $9.99-a-month or $96-a-year subscription without their consent, advertised savings that many members did not actually get, and made cancelling take as many as 23 screens and 32 actions. Disability access (U.S. Department of Justice): the DOJ alleges Uber routinely refused riders who use service animals or stowable wheelchairs and imposed impermissible charges. Driver classification (California Attorney General): the State alleges drivers were misclassified as independent contractors in the years before Proposition 22. Uber Eats “priority” fee: a proposed consumer class action, covered on our Uber Eats priority fee page. All of these are allegations, and Uber is contesting them in court.

Case Details

Sexual assault: In re: Uber Technologies, Inc., Passenger Sexual Assault Litigation, MDL No. 3084, No. 3:23-md-03084, U.S. District Court for the Northern District of California, Senior Judge Charles R. Breyer. The Judicial Panel on Multidistrict Litigation's September 1, 2026 report lists 4,588 actions pending and 4,890 in total. Uber One: Federal Trade Commission v. Uber Technologies, Inc., No. 4:25-cv-03477, Northern District of California, Judge Jon S. Tigar, filed April 21, 2025. The second amended complaint of May 4, 2026 is brought by the FTC together with 21 states and the District of Columbia. Disability: United States v. Uber Technologies, Inc., Northern District of California, filed September 11, 2025; the court denied Uber's motion to dismiss on March 5, 2026. Driver classification: the California Attorney General's suit, filed May 5, 2020 in San Francisco Superior Court with the city attorneys of San Francisco, Los Angeles and San Diego, remains pending for the period before Proposition 22, according to Uber's quarterly report for the period ended June 30, 2026.

Status on September 30, 2026: Pending Cases, No Open Fund

Several active cases, no global settlement, no claim form. In MDL 3084 the bellwether (test) trials are how both sides put a value on the claims. Under a July 13, 2026 scheduling order, jury selection in the next bellwether was set for September 30, 2026 and trial for October 5, 2026. The FTC's Uber One case is still pending; the FTC asks for a permanent injunction, monetary relief and civil penalties, so any refunds depend on how it ends. The DOJ disability case has passed the motion-to-dismiss stage.

Uber's own quarterly report also lists securities and antitrust claims among its pending matters. Those are separate from the consumer cases above.

Who Could Get Something, Group by Group

Riders who were sexually assaulted or harassed by a driver: you would bring your own lawsuit, usually through a lawyer; there is no class to join. Uber ended mandatory arbitration of sexual misconduct claims effective May 15, 2018. Deadlines differ by state; details on our Uber sexual assault lawsuit page, and for Lyft rides on our Lyft sexual assault lawsuit page.

Uber One subscribers: the FTC and the states sue on behalf of the public; there is nothing to sign up for, and nothing to file today.

Riders with disabilities: the 2025 DOJ case is a government lawsuit, not a class action. A refused ride can be reported to the Justice Department.

Drivers: New York's fund covered drivers who drove between November 10, 2014 and May 22, 2017 and had New York sales tax and Black Car Fund fees deducted. Massachusetts drivers should check the Attorney General's settlement announcement and its follow-up pages. California's case is still pending.

People hurt in a crash: that is an insurance and injury claim, not a class action; see our rideshare accident settlement calculator.

What Has Actually Been Paid, and What Hasn't

Verdicts, not a fund, in the assault cases. In February 2026 a federal jury in Arizona ordered Uber to pay $8.5 million to a rider who said her driver raped her. In April 2026 a federal jury in Charlotte, North Carolina awarded another rider $5,000. In 2025 a California jury found Uber not liable. That spread is why no honest “average Uber settlement” exists.

Settlements that did pay money (older or closed): New York drivers — a $290 million Uber fund for sales-tax and Black Car Fund deductions, claim deadline February 28, 2025. Massachusetts — under the June 27, 2024 settlement Uber agreed to pay $148 million, most of it as restitution to drivers, plus a $32.50 hourly pay floor. Riders with disabilities — under the July 18, 2022 DOJ settlement over wait-time fees, Uber agreed to credit more than 65,000 waiver-program riders double the wait-time fees they had been charged, and to pay $1,738,500 to more than a thousand riders who had complained and $500,000 to others the DOJ identified.

Nothing yet: Uber One, the 2025 disability case, the California driver case and the Uber Eats priority fee case have no settlement and no fund.

How cases like this one end

Our copy of the federal courts’ own case database covers 6,781 assault, libel, and slander casesclosed in U.S. federal district courts between 2015 and 2026:

  • •15.9% ended in a settlement recorded by the court. Another 14.6% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 15.9% and 30.5%.
  • •12.8% were decided on a motion before any trial.
  • •1 in 60 reached a trial (1.7%), after a median of 29.6 months.
  • •Median time from filing to the end of the case: 6.1 months.
  • •Only 94 of them (1.4%) record a money award at all; the median of those is $429,000.

These are base rates for this type of case (federal assault, libel, and slander cases) — not a prediction about this lawsuit, and not legal advice. Source: Federal Judicial Center, Integrated Database (civil), analysed by Settlement Insight. Cases heard in state courts are not included.

Uber Lawsuit Timeline

  1. 1

    July 18, 2022 — Wait-Time Fee Settlement

The DOJ settles its November 2021 ADA suit over wait-time fees charged to riders who needed more time because of a disability. Uber agrees to account credits for 65,000-plus riders and payments to those who complained.

  2. 2

    2024 — Driver Pay Settlements

New York's administrator starts mailing notices on March 7, 2024 for the $290 million Uber fund. On June 27, 2024 Massachusetts announces Uber will pay $148 million and a $32.50 hourly minimum.

  3. 3

April 21, 2025 — FTC Sues Over Uber One

The FTC files in the Northern District of California, alleging charges without consent and a cancellation maze. In the second amended complaint of May 4, 2026 it is joined by 21 states and the District of Columbia.

  4. 4

    September 11, 2025 — DOJ Disability Lawsuit

The Justice Department sues under Title III of the ADA over refused rides for riders with service animals and wheelchairs. The court denies Uber's motion to dismiss on March 5, 2026.

  5. 5

February and April 2026 — Two Federal Verdicts

Bellwether juries award $8.5 million in Arizona (February) and $5,000 in Charlotte, North Carolina (April). A California jury had found Uber not liable in 2025.

  6. 6

September 30, 2026 — Next Trial, Still No Fund

Under a July 13, 2026 order, jury selection in the next MDL 3084 bellwether was set for September 30 and trial for October 5, 2026. 4,588 cases were pending on September 1. No Uber case has an open claim form that we could find.

Three Uber-Specific Traps

A famous brand, thousands of pending cases and no open claim form is exactly the gap imposters fill:

“Register for the Uber settlement”

There is no global settlement in the assault litigation and no claims portal to register with. A site charging a fee or asking for your Social Security number to “reserve your share” is not part of MDL 3084.

“Your Uber One refund is ready”

The FTC case has not produced a refund program. A text or email asking you to log in with your Uber account or card details to collect one is phishing. Check charges inside the app instead of tapping the link.

Paid “help” with a driver settlement

New York's Attorney General warned drivers to beware of anyone offering to help file a claim in the Uber and Lyft settlements, and that phone numbers, caller ID and email addresses can be faked. That fund's deadline passed on February 28, 2025.

Uber Lawsuit — Questions People Actually Ask

Is there an Uber settlement I can claim right now?

As of September 30, 2026, we found none with an open claim form. New York's driver fund had a claim deadline of February 28, 2025; the Uber One, disability and assault cases have no fund. Massachusetts drivers should check the Attorney General's pages on mass.gov for payment status.

Is there an Uber class action I can join?

Not in the way most people mean. Nobody “joins” a certified class — if one covers you, you are in unless you opt out. The Uber One and disability cases are government enforcement actions, and the assault cases are individual lawsuits grouped for pretrial work. A proposed consumer class action over the Uber Eats priority fee is at an early stage, with no settlement.

How many Uber sexual assault lawsuits are there?

4,588 were pending in MDL 3084 on the Judicial Panel's September 1, 2026 report, out of 4,890 filed there in total. There is no global settlement. Federal bellwether juries have returned $8.5 million (Arizona, February 2026) and $5,000 (North Carolina, April 2026); a California jury found Uber not liable in 2025.

What is the FTC's Uber One lawsuit about?

The FTC, 21 states and the District of Columbia allege Uber signed people up for Uber One ($9.99 a month or $96 a year) without consent, advertised savings many did not get, and made cancelling take up to 23 screens and 32 actions. They seek an injunction, monetary relief and civil penalties. No settlement or refund process has been announced as of September 30, 2026.

I'm an Uber driver. Is any money owed to me?

It depends on the state. New York: a $290 million fund for drivers with sales-tax and Black Car Fund deductions between November 10, 2014 and May 22, 2017; the claim deadline was February 28, 2025. Massachusetts: Uber agreed to pay $148 million under the June 27, 2024 settlement, most of it as restitution to drivers. California: the Attorney General's misclassification case for the years before Proposition 22 is still pending.

I use a wheelchair or a service animal and was refused an Uber ride. What now?

The Justice Department's September 11, 2025 lawsuit targets exactly that, and the court denied Uber's motion to dismiss on March 5, 2026. You cannot file a claim in that case, but you can report a refusal to the DOJ at ada.gov/complaint.

Did Uber settle its data breach?

The 2016 breach was resolved in September 2018 through stipulated judgments with the attorneys general of all 50 states and the District of Columbia, involving a $148 million payment. That was an agreement with the states; we found no open consumer claim tied to it. For how breach settlements usually pay, see our data breach settlement calculator.

What is worth doing right now?

Uber One subscribers: keep the emails or statements that show each charge. Drivers: keep your earnings statements and any settlement notice. Anyone assaulted during a ride: have the dates reviewed by a lawyer, because state deadlines differ. And ignore any message that asks for a fee or your Uber login to “claim” money.

Separate from this case: were you injured in the last 2 years?
