What the Lawsuit Alleges

Plaintiffs allege that Suboxone sublingual film — used to treat opioid addiction — has a highly acidic formulation that erodes tooth enamel when dissolved in the mouth multiple times daily. Manufacturers Indivior Inc. and Aquestive Therapeutics are accused of knowing about the dental risks for years yet failing to warn patients or doctors. The FDA did not require a dental-injury warning label until January 2022. Plaintiffs report severe decay, tooth loss, extractions, root canals, and full-mouth rehabilitation.

Case Details

MDL No. 3092, U.S. District Court for the Northern District of Ohio, Judge J. Philip Calabrese.

Current Status

As of 2026, MDL 3092 has roughly 1,833 pending individual cases plus thousands of bundled claims — more than 11,000 total plaintiffs — and is in active discovery. In February 2026, the court selected 100 plaintiffs for a Core Discovery Pool, narrowing toward bellwether trials projected to begin in March 2028. No global settlement has been announced; bellwether outcomes will inform settlement negotiations.

Who Is Affected & Can You Join?

You may qualify if you: (1) used brand-name Suboxone sublingual film — not tablets or generic buprenorphine — for at least 6 months; (2) developed documented dental injuries such as severe decay, tooth loss, extractions, root canals, cracked teeth, or implants; (3) used the medication as prescribed; (4) had no severe pre-existing dental disease before starting Suboxone; and (5) are within your state's statute of limitations. Cases involving use before the January 2022 FDA warning are generally strongest. Filing deadlines vary by state — some have passed — so consult an attorney promptly.

Is There a Payout?

No Suboxone dental settlement has been reached, so there is no fixed payout. Attorney estimates based on comparable product-liability MDLs range from roughly $10,000 to $150,000 per claimant for documented injuries, with potentially higher values at trial. These are projections, not guarantees, and depend on injury severity, treatment costs, records quality, and how bellwether trials perform in 2028.

Case Timeline

  1. 1

August 2010 — Suboxone Film Approved

The FDA approves the sublingual film, which dissolves in the mouth multiple times daily, creating prolonged acidic exposure. No dental-injury warning is included.

  2. 2

January 2022 — FDA Issues Dental Warning

After hundreds of adverse-event reports of severe tooth decay and tooth loss, the FDA mandates a new label warning about dental risks — nearly 12 years after film approval.

  3. 3

    February 2024 — MDL 3092 Established

A federal judicial panel consolidates Suboxone dental-injury lawsuits into MDL No. 3092 in the Northern District of Ohio, under Judge J. Philip Calabrese.

  4. 4

February 2026 — Core Discovery Pool Selected

The court selects 100 plaintiffs for intensive discovery, to be narrowed toward 15 trial candidates. Total case count exceeds 11,000 claimants.

  5. 5

March 2028 — First Bellwether Trials Projected

Cases from the discovery pool are expected to go to trial. Verdicts will be non-binding but will heavily influence settlement negotiations for the remaining claims.

Scam & Misinformation Warnings

Whenever a brand lawsuit goes viral, scam sites and bad actors follow. Watch for these red flags:

No Settlement Exists Yet — Ignore Payout Claims

As of 2026, no Suboxone dental settlement has been reached and no settlement fund exists. Any website, letter, or call claiming you can receive a guaranteed payout now is false.

Unsolicited 'File Your Claim' Offers

Mass-tort marketers can be aggressive. Be cautious of anyone asking for upfront fees or promising specific dollar amounts. Reputable MDL attorneys work on contingency — you pay nothing unless you win.

Generic Buprenorphine and Tablets Are Not Part of This MDL

This litigation applies specifically to brand-name Suboxone sublingual film. If you took buprenorphine tablets, generic film, or Subutex, your situation is different. Do not assume eligibility based on any buprenorphine product.

Frequently Asked Questions

What is the Suboxone lawsuit about?

Patients who used Suboxone sublingual film to treat opioid addiction developed severe tooth decay and permanent dental injuries. Lawsuits allege manufacturers Indivior and Aquestive knew the acidic film damaged tooth enamel but failed to warn for over a decade. The FDA required a dental warning label in January 2022.

Is there an active lawsuit I can join?

Yes. MDL 3092 is active in federal court in Ohio and accepting new cases as of 2026. However, statute-of-limitations deadlines vary by state — some have passed. Contact a mass-tort attorney promptly for a free case evaluation.

How much could my Suboxone claim be worth?

No settlements have been finalized. Attorney estimates based on similar MDLs range from $10,000 to $150,000 per claimant, with potentially higher values at trial. Compensation depends on the severity of your injuries, documented treatment costs, and the quality of your records. These are projections, not guarantees.

Who are the defendants?

The primary defendants are Indivior Inc. (the brand-name manufacturer) and Aquestive Therapeutics (the film-technology developer), along with affiliated entities. Some related parties have been partially dismissed on jurisdictional grounds.

When will Suboxone lawsuits settle?

Settlement talks typically intensify after bellwether trial verdicts. The first bellwether trials in MDL 3092 are currently projected for March 2028, so broader settlements — if they occur — would likely follow, meaning payouts are unlikely before 2028–2029.
