What Starts the Clock: the Discovery Rule

Roundup cases are product-liability claims, and nearly every state applies a discovery rule to latent injuries: the limitations period runs from when you knew - or reasonably should have known - of the injury and its likely cause, not from exposure. In practice the trigger is usually the NHL diagnosis, but defendants argue for earlier dates, often pointing to the March 2015 IARC classification of glyphosate as “probably carcinogenic” as the moment a reasonable person “should have known”. Case Details

Wrongful-death claims run on their own clock - generally from the date of death - and many states give families a shorter window than the injured person had. Some states also impose a statute of repose (an outer limit measured from the product's sale) that can bar old exposures regardless of discovery. 2026: Settlement and Supreme Court Change the Calendar

Class settlement ($7.25 billion, King v. Monsanto, Missouri state court): preliminarily approved March 4, 2026; opt-out deadline June 4, 2026 (passed); after the federal court remanded the case to Missouri on June 17, the final approval hearing was reset to September 14, 2026 (court order of August 6).
