How Product Liability Cases End in Federal Court: Trials, Settlements and MDLs
Original analysis of 1.2 million records from the Federal Judicial Center, FY2005–FY2025. Published October 10, 2026.
We counted every personal injury and health care/pharmaceutical product liability case filed or resolved in U.S. district courts in fiscal 2005–2025: how each ended, who won at trial, and which MDLs and courts carried the load.
What the Federal Court Records Show
Of 928,375 final resolutions of federal product liability cases in fiscal years 2005 through 2025, 934 were trial verdicts, or 0.10%. Most ended in a voluntary dismissal (41.0%) or a dismissal coded as settled (27.9%). In the trials with a recorded winner, plaintiffs won 29.6%.

Trials are rare
Only 934 of 928,375 final resolutions were jury, directed or bench verdicts (0.10%). Even without the largest MDL, the share was 0.17%.
Trials have become rarer
Federal courts recorded 82 product liability trial verdicts in fiscal 2005 and 18 in fiscal 2025. Over the first five fiscal years there were 314, over the last five 130.
Defendants win most trials
Plaintiffs won 248 and defendants 591 of the 839 trials with a recorded winner. Judgments on motions before trial went to the defendant in 93.0% of cases with a recorded winner.
Most filings carry an MDL number
78.5% of the 1,159,584 product liability case filings carried a multidistrict litigation (MDL) docket number, and the ten largest MDLs account for 59.2% of all filings.
One MDL dominates the count
The 3M Combat Arms Earplug Products Liability Litigation (MDL No. 2885) accounts for 394,304 filings, 34.0% of the national total, and 42.5% of all final resolutions.
Many cases were still open
186,155 product liability cases filed between October 2004 and September 30, 2025 had not been resolved by that date; 88.1% of them belong to an MDL.
How Do Product Liability Lawsuits End in Federal Court
Each terminated federal case carries a disposition code. We count final resolutions only, so a case transferred to another federal court is counted once, in the court that closes it.
41.0% of the 928,375 final resolutions were voluntary dismissals, 27.9% were dismissals coded as settled, 24.0% were dismissals on other grounds and 0.10% were trial verdicts.
The settled share is a lower bound. The FJC codebook defines a settled case as one disposed of after settlement between the parties out of court; a voluntary dismissal only records that the plaintiff withdrew the action under Rule 41(a), and the records do not show how many of those followed a private settlement. Together the two codes cover 68.8% of all final resolutions.
The overall mix depends heavily on the 3M Combat Arms Earplug Products Liability Litigation in the Northern District of Florida, which accounts for 394,245 final resolutions, 74.7% of them voluntary dismissals. Leaving that MDL out, 48.4% of the remaining 534,130 resolutions were coded as settled, 16.0% as voluntary dismissals and 0.17% as trial verdicts.
The median case took 963 days, about 2.6 years, from filing to final resolution; cases that ended in a trial verdict took a median of 793 days.

Fiscal years run October through September. Transfers to another federal court, including transfers into an MDL, are not counted as resolutions.
How Many Product Liability Cases Go to Trial Each Year
The table counts jury verdicts, directed verdicts and bench trials in product liability cases by the fiscal year in which the case ended.
There were 82 trial verdicts in fiscal 2005 and 18 in fiscal 2025, while product liability filings went from 27,149 to 43,891.
The number of resolutions swings with a few mass torts. Filings peaked in fiscal 2020 at 239,244 case records, 95.7% of them with an MDL docket number. Resolutions peaked in fiscal 2025 at 165,126, 93.7% of them voluntary dismissals. Trial verdicts did not follow these swings: after fiscal 2005 (82) the yearly count never rose above 66, and fiscal 2025 recorded 18, 78.0% fewer than fiscal 2005.
Plaintiffs won 29.6% of all trials with a recorded winner over the whole period. Single-year win rates rest on a few dozen trials or fewer and should not be read as a trend.

Which Mass Torts Have the Most Product Liability Cases
Federal case records carry the docket number of the multidistrict litigation a case belongs to. The ranking counts product liability case filings per MDL.
The 3M Combat Arms Earplug Products Liability Litigation leads with 394,304 filings, followed by the Johnson & Johnson Talcum Powder Products Marketing, Sales Practices and Products Liability Litigation (70,162) and the Ethicon, Inc., Pelvic Repair System Products Liability Litigation (48,415).
Product liability case filings carry 242 different MDL docket numbers. The ten largest MDLs alone account for 59.2% of all filings. The CSV also lists how many cases in each MDL were still open on September 30, 2025.

Which Federal Courts Handle the Most Product Liability Cases
The ranking counts product liability filings in each of the 94 federal district courts. It reflects where cases were filed or centralized in MDLs, not where injuries happened, and is not adjusted for population.
The Northern District of Florida recorded 399,375 filings (34.4%), the Southern District of West Virginia 132,015 and the District of New Jersey 111,172. Together the three account for 55.4% of the national total.
Trial verdicts are spread differently: the Middle District of Florida, where 2.9% of product liability filings carry an MDL docket number, recorded the most product liability trial verdicts of any court (61). In 25 of them, the first-listed defendant was a tobacco company.

Full method and limits of the data
Product liability means the nature-of-suit categories personal injury product liability and health care/pharmaceutical personal injury product liability. Asbestos, airplane, marine, motor vehicle and property damage product liability codes are excluded. Separate data collection for health care/pharmaceutical cases began on October 1, 2011, so the two codes are analyzed together. Years are federal fiscal years (October through September), fiscal 2005 through fiscal 2025; fiscal 2026 is incomplete and left out.
Filings count every case record filed in the period, including cases transferred into an MDL; counted this way, they closely match the judiciary's Table C-2. For fiscal 2024 we count 36,418 personal injury product liability filings against 36,515 published (0.27% difference) and 17,278 health care/pharmaceutical filings against 17,276 (0.01%); fiscal 2023 matches within 0.28%.
Outcomes count final resolutions only: terminations in the period other than transfers to another district or into an MDL, including 34,200 resolutions of cases filed before fiscal 2005. Settled means the disposition 'dismissed: settled'; trial verdicts are jury verdicts, directed verdicts and bench trials, assigned to the fiscal year the case ended. Winners at trial come from the judgment field (plaintiff or defendant); trials coded as both, unknown or blank are left out of the win rate. The analysis covers 1.2 million case records from the public FJC IDB civil file; the aggregated results are published as CSV files.
What this data cannot tell you
- The settled share is a lower bound. Some voluntary dismissals may follow private settlements, but the records do not say which ones did. The IDB contains no settlement amounts for these cases.
- Mass torts dominate the totals. One MDL accounts for 34.0% of filings, so national shares and yearly counts move with a few dockets. Filings are case records: a case transferred into an MDL (96,728 records in the period), transferred between districts (10,027), reopened (33,094) or remanded by a court of appeals (5,374) appears again as a new record.
- The MDL share is a lower bound: another 58,840 filing records entered through the MDL process but carry no MDL docket number; counting them, 83.6% of filings belong to an MDL.
- Not every closing ends the case. The resolutions include 28,100 statistical closings (cases pending for more than three years with no activity for more than a year), 7,758 remands to state court, 136 remands to a federal agency and 115 stays pending bankruptcy, together 3.9% of all resolutions. Without them, the trial share would be 0.10%, the settled share 29.0% and the voluntary dismissal share 42.6%.
- A case that is reopened and closed again is counted at each closing: the 928,375 resolutions belong to 878,388 distinct dockets, so 49,987 (5.4%) are repeat closings. Counted by docket, 922 cases ended in a trial verdict, or 0.10%.
- A trial verdict is not the end of a case: appeals, post-trial motions and later settlements are not reflected. MDL bellwether trials are counted like any other trial verdict.
- Court rankings show where cases were filed or centralized, not where plaintiffs live or were injured, and they are not adjusted for population or court size.
- Courts report case data with some delay and the FJC revises records in later releases. Counts for fiscal 2025, the most recent year shown, may still change slightly.
