In re: Pierce County Library System Data Breach Litigation, No. 25-2-11297-2, Superior Court of the State of Washington for Pierce County, Judge Alicia M. Burton. On October 9, 2026 the court granted final approval to the settlement for about 3,275 current and former employees, their family members and contractors whose data was hit in the incident PCLS disclosed in July 2025: a $70 cash option, up to $250 or $4,000 for documented losses, $20 an hour for up to four hours, and three years of credit monitoring — cash benefits capped at $385,000 in total. There were no objections and no timely opt-outs. Fees of $220,000 are paid separately by PCLS. Payments are due within 60 days of the settlement’s Effective Date, which only arrives after the appeal period. Official site: PierceCountyLibraryDataSettlement.com, run by Simpluris.

The answer: Judge Burton granted final approval on October 9, 2026
The Pierce County Library settlement is finally approved. At the hearing on October 9, 2026, Pierce County Superior Court Judge Alicia M. Burton signed the Final Approval Order and Judgment in In re: Pierce County Library System Data Breach Litigation, No. 25-2-11297-2; the clerk’s stamp reads “FILED DEPT 22 IN OPEN COURT OCT 09 2026.” The order holds that “the terms of the Settlement are fair, adequate, and reasonable,” directs implementation of all its terms, and orders that judgment be entered “dismissing this case with prejudice.” The court noted “there were no objections to the Settlement, and no timely opt-outs.”
The signed order is posted in the Court Documents list of the administrator, Simpluris. As of October 15, 2026, the home page of PierceCountyLibraryDataSettlement.com still describes the October 9 hearing as upcoming and names no payment date. If you filed a valid claim by the September 28, 2026 deadline, the order says you “shall receive” your benefits under the settlement’s terms — but not yet, and not on a date anyone has announced. The background on who is in this class is in our Pierce County Library settlement guide.
What happens after final approval — and how long until you get paid
What happens after final approval in a class action lawsuit? Here, money does not move on the day of approval. The notice says benefits will be distributed “after any appeals are resolved, or after the period to seek an appeal has expired.” The settlement agreement ties every payment to its “Effective Date,” which requires that “the time to appeal or seek permission to appeal from the Judgment has expired” or any appeal has been dismissed or the judgment affirmed. In Washington state court, Rule of Appellate Procedure 5.2 gives a party “30 days after the entry of the decision” to file a notice of appeal.
How long after a class action settlement is approved do you get paid? For this settlement the agreement sets the clock, counted from the Effective Date, not from October 9:
- 5 days after the Effective Date (and once all claims are decided): Simpluris sends the parties an accounting of approved claims and funding instructions.
- 20 days after the Effective Date: the library system transmits the money for approved claims.
- Payments: checks “shall be mailed and postmarked, and electronic payments shall be issued electronically, within sixty (60) days of the Effective Date, or within thirty (30) days of the date that the claim is approved, whichever is later.”
- 25 days after the Effective Date: the library system pays the court-awarded attorneys’ fees and service awards.
The Effective Date has not been announced. Counting 30 days from the October 9 order puts the end of the appeal window in early November 2026 — that is our arithmetic, and the clock legally runs from the date judgment is entered, which the court record we read does not separately state. A filed appeal would push everything back until it is resolved.
Who gets what: $70 cash or documented losses, under a $385,000 cap
The class the court finally certified is “all current and former employees, and their family members, as well as current and former contractors who received notice from Defendant whose personal information was impacted in the Data Incident” — the cyber incident the Pierce County Library System (PCLS) disclosed in July 2025. The agreement puts the class at about 3,275 people. Library patrons are not part of that definition. PCLS denies wrongdoing; the settlement is not an admission of liability.
Claimants chose from these benefits:
- Alternative Cash Payment: $70, in place of the loss and lost-time categories.
- Ordinary losses: up to $250 per person, with third-party documentation, for costs incurred on or after April 15, 2025.
- Extraordinary losses: up to $4,000 per person for documented, unreimbursed fraud or identity-theft losses more likely than not caused by the incident.
- Lost time: $20 an hour, up to 4 hours ($80), with an attestation; not combinable with the $70 option.
- Credit monitoring: three years of one-bureau monitoring and identity restoration with $1,000,000 identity theft insurance, no deductible — combinable with any cash benefit.
The cash benefits share a $385,000 aggregate cap: “If the total approved claims for these benefits exceed $385,000, said benefits will be reduced, pro rata.” No public document we read reports how many claims came in, so whether the $70 and loss payments will be cut is not known as of October 15, 2026. Credit monitoring, notice and administration costs, attorneys’ fees and service awards sit outside that cap and are paid by PCLS separately.
Fees, awards and what happens to uncashed checks
Judge Burton awarded class counsel (Emery Reddy PC and McNaul Ebel PLLC) $220,000 in combined attorneys’ fees and costs, to be paid by the library system — not out of the $385,000 for claimants. The fee motion, filed August 13, 2026, valued the settlement at “up to $625,000.00 in benefits” before credit monitoring, which it valued at $322.56 per class member, and reported a lodestar of $123,983.30 and costs of $3,159.15, a multiplier of 1.75. Each named plaintiff received a $2,000 service award; the notice had said counsel would ask for up to $2,500 each. The motion also describes security changes by PCLS “estimated to exceed $240,000.”
Checks will carry a 90-day life: “All settlement checks shall be void ninety (90) days after issuance.” If yours lapses, you have “until six months after the Effective Date to request re-issuance.” Money from uncashed checks left 20 days after the 180-day check negotiation period goes to the Legal Foundation of Washington, the court-approved cy pres recipient.
What happens next
These are the next steps the court papers fix, in order. None has a calendar date yet beyond the first:
- October 9, 2026 — final approval order signed and filed in open court; the court directed the clerk to enter final judgment “forthwith pursuant to CR 58.”
- 30 days after entry of judgment — deadline for any notice of appeal under Washington RAP 5.2(a). With no appeal, the settlement can become final.
- Effective Date + 5 days — accounting of approved claims; +20 days — PCLS funds the claims; +25 days — fees and service awards paid.
- Effective Date + 60 days (or 30 days after a claim’s approval, if later) — payment deadline for checks and electronic payments.
- Six months after the Effective Date — last day to ask for a replacement of a voided check.
The claim deadline was September 28, 2026, and opt-outs and objections closed August 28, 2026; there is nothing new to file. If your mailing or email address has changed since you claimed, tell the administrator now. We will update our Pierce County Library settlement guide when Simpluris posts a payment date.
Is this a legit notice? How to tell the real administrator
Is this a legit notice of proposed class action settlement? The genuine notice came from Simpluris, the administrator the court appointed, and names one website and one contact set: PierceCountyLibraryDataSettlement.com, toll-free (833) 421-7302, info@PierceCountyLibraryDataSettlement.com, and Pierce County Library System Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799. The court documents themselves are served from Simpluris’s document server. A message pointing you elsewhere, or asking you to pay something to release your payment, does not match the official materials — class counsel’s $220,000 and the administration costs are paid by PCLS, not by class members. Since the claim deadline has passed, any new “claim now” message about this case is not from the court process.
How much will the Equifax settlement be per person? That is a different case, and this page does not answer it: the Pierce County Library settlement covers only PCLS employees, their family members and contractors. Equifax questions go to the official Equifax Data Breach Settlement website, which says it “is operated by the Settlement Administrator, not by Equifax.”
