The Smallest MyChart Settlement of the Wave May Pay the Most: $750,000, 182,303 People, and a Four-Month Class Window

Valladolid v. Memorial Health Services, Case No. 23STCV05059 in the Superior Court of California for Los Angeles County, alleges that MemorialCare violated the California Invasion of Privacy Act, Cal. Penal Code § 631(a), by disclosing patients' personally identifiable information to third parties “via the Meta Pixel and other tracking, analytics, and/or advertising technologies without consent.” Memorial Health Services denies all of the claims and maintains that it did nothing wrong.

The class definition is the narrowest in the current pixel wave: “All persons who between March 7, 2022, to and through July 8, 2022, accessed the Memorial Health Services patient portal.” That is a four-month window. Duke's runs three years and four months; the Delta Dental portal case covers four years. Court documents put the MemorialCare class at approximately 182,303 people.

A small fund attached to a small class is not automatically a bad deal — the ratio is what matters, and it is the reason this case deserves a second look from anyone who dismissed it as the runt of the litter.

MemorialCare pays a true pro rata share with no per-person cap. The FAQ is explicit: “If you submit a valid Claim Form, you will receive a pro rata share of the net settlement fund.” Every dollar remaining after deductions is divided among the people who actually file. Fewer claims, bigger checks — the ordinary mechanic, and the exact opposite of the Delta Dental portal settlement, where $16.50 is a ceiling that no shortfall in claims can lift.

The deductions here are unusually well disclosed. Class Counsel “is entitled to seek no more than $250,000.00” (a third of the fund). The administrator, Simpluris, “will be paid not more than $49,000.00 from the Settlement Fund.” And the $2,500 incentive award for the class representative does not come out of the class's money at all — the FAQ states she “will separately be paid an incentive award by Defendants.”

Assume both deductible line items land at their maximum and about $451,000 reaches the class. Against 182,303 class members (our arithmetic, not the administrator's):

• If everyone filed: about $2.47 each
• At a 10% claim rate (18,230 claims): about $25
• At a 5% claim rate (9,115 claims): about $49
• At a 3% claim rate (5,469 claims): about $82

At the single-digit claim rates typical of consumer class actions, this $750,000 settlement plausibly out-pays the $12.67 million Delta Dental portal deal on a per-person basis — because there, no claim rate however low moves the number past $16.50. Fund size is a headline. Fund size divided by claimants is a check.

The caveat runs the other way too, and honesty requires it: if participation is unexpectedly heavy, the pro rata share falls fast, and $2.47 is the floor at full participation. Nobody can quote you a number before the claim period closes, and the administrator does not.

Two practical obstacles stand between the class and the money, and both are easy to miss.

You cannot file without your notice. The FAQ is unambiguous: “You must provide proof of your Settlement Class membership when filing a claim by providing the unique LoginID and PIN on the notice you received by mail or email.” This is the same credential gate that Duke's settlement uses, and the same one that catches people who binned an unremarkable envelope in the spring. If yours is gone, the administrator's line is (833) 421-7255 — and unlike Duke's Sunday deadline, MemorialCare's falls on a Friday, so there are business days left to make that call. That is the single biggest practical advantage this case has over Duke's this week.

The right to object expired on July 15, 2026 — five weeks before the claim deadline. Opting out, unusually, stays open until August 21, the same day as claims. So the menu right now is: file a claim, or opt out and keep your own claims. What you can no longer do is stay in and tell the court the deal is too small.

Claims must be “submitted online by 11:59 p.m. CT on August 21, 2026, or postmarked and mailed by August 21, 2026.” Note the time zone — Central, not local, and not the Pacific time zone a California case might lead you to assume. For a claimant on the West Coast that is 9:59 p.m. Pacific, two hours earlier than the intuitive reading.

The Final Approval Hearing is September 17, 2026, at 9:30 a.m. The FAQ sets out the payment clock precisely: approved claimants “will receive their payment 30 days after the Settlement has been finally approved and any appeals process is complete.” No appeal and the timeline points to late 2026; an appeal pushes it well into 2027.

Payment arrives as a check by default, with PayPal, Venmo or Zelle available if you elect one on the claim form — and one detail worth setting a reminder for: “all checks will expire and become void 180 days after they are issued.” Six months, then the money is gone. Uncashed and undistributed funds go to the Legal Aid Foundation of Los Angeles rather than back to MemorialCare.
