No Glenwood Caverns Settlement: A $14.8 Million Sale Plan Was Confirmed on September 30, 2026 — and a Notice of Appeal Hit the Docket on October 13, While the $116 Million Judgment Is Still on Appeal

In re Glenwood Caverns Holdings LLC, Case No. 26-13137-KHT, United States Bankruptcy Court for the District of Colorado, Chief Judge Kimberley H. Tyson (filed in Delaware as No. 26-10166 and transferred on April 30, 2026). After 60 pages of findings on September 29, 2026, the court entered its confirmation order on September 30, 2026, approving the park’s Chapter 11 plan and its sale to GVC Glenwood LLC for an estimated $14,786,000 over the objections of the parents of the 6-year-old who died on the Haunted Mine Drop in 2021. Under the plan the family’s claim — a state-court judgment of more than $116,000,000 that the park is appealing — gets insurance proceeds of about $7 to $7.3 million, net sale proceeds of about $5 to $5.2 million and whatever a litigation trust recovers, but only once the appeal ends. On October 13, 2026 the docket shows a notice of appeal and a filing titled “Stay Pending Appeal.” There is no class action, no claim form and no public payout.

No Glenwood Caverns Settlement: A $14.8 Million Sale Plan Was Confirmed on September 30, 2026 — and a Notice of Appeal Hit the Docket on October 13, While the $116 Million Judgment Is Still on Appeal — key figures at a glance

What happened: a court-approved sale, not a settlement

As of October 14, 2026, there is no Glenwood settlement for the 2021 death at Glenwood Caverns Adventure Park — and no payout to anyone yet. What exists is a Chapter 11 plan. On September 29, 2026, Chief Bankruptcy Judge Kimberley H. Tyson issued 60 pages of findings of fact and conclusions of law and wrote that “the Court will confirm the Plan by separate order.” The debtor’s notice of October 5, 2026 reports that on September 30, 2026 she entered the order confirming the plan, “(II) Approving Asset Purchase Agreement; and (III) Granting Related Relief” (Docket No. 509).

The plan sells the park to GVC Glenwood LLC, a new company owned 80% by the outdoor-hospitality investor Gondola Ventures and 20% by the park’s founder. Its bid won a July 24, 2026 auction after thirteen rounds, beating the stalking-horse bidder, Glenwood Mountain LLC, by $100,000. The debtor estimates the price at $14,786,000: the buyer takes over the bank loan (about $12,086,000 at closing), pays $2,700,000 in cash and covers contract cure costs. The parents, Estifanos Dagne and Rahel Estifanos, the only objectors left at the end of the hearing, argued the price was too low and the process tainted by the founder’s role on both sides. The judge disagreed and found GVC a “good faith purchaser,” saying the family “were unable to produce any evidence supporting their theories of fraud or collusion.”

What is the latest update on the Glenwood Caverns lawsuit? Two tracks are open. In the bankruptcy court, the CourtListener index of the docket lists two entries dated October 13, 2026: No. 530, “Notice of Appeal and Statement of Election,” and No. 529, “Stay Pending Appeal.” The index does not show who filed them or what they ask for, and we could not open the documents, so we cannot say who is appealing or whether any stay has been granted. In the state courts, the park’s appeal of the wrongful death judgment is, per the September 29 findings, “pending before the Colorado Court of Appeals.”

Who gets money from the plan, and when

Nobody outside the case. This is a bankruptcy of one company over one wrongful death judgment — not a class action — so there is no claim form and no fund for park visitors, ticket holders or the public. Under the plan as the court described it:

  • Class 1, the bank (Community Banks of Colorado, a division of NBH Bank): its loan is assumed by the buyer and restructured.
  • Class 2, the parents: “insurance proceeds (approximately $7 to $7.3 million), plus net sales proceeds (approximately $5 to $5.2 million), and the recoveries from the Litigation Trust.” The trust receives one claim: the park’s potential bad-faith claim against its former liability insurer, NOVA Casualty Company. That is an allegation the trust may pursue, not a finding.
  • Class 3, trade vendors — suppliers of “anything from candy to T-shirts” — get 10% of their claims, paid without waiting for the appeal.
  • Class 4, the owner (GCAP Holdco): its equity is cancelled and it receives nothing “unless all Allowed Claims have been paid in full.”

The catch for the family is timing. The judge wrote that if the park wins its state appeal the claim “could be substantially reduced, perhaps as low as the $250,000 statutory cap on non-economic damages,” that “Resolution of the State Court Appeal could take years,” and that “until the amount of the Estifanos Creditors’ claim is finally determined, the claim cannot be paid.” Until then, the remaining money is “held for the benefit of Class 2.” The debtor’s restructuring officer testified that a liquidation would have left the family a share of only $1,244,000, against $5 to $5.2 million in sale proceeds under the plan.

The judgment behind it: $205 million from the jury, more than $116 million on paper

The family’s 6-year-old daughter fell about 100 feet from the Haunted Mine Drop in September 2021 because her seatbelt was not properly fastened; the ride has since been revamped and renamed the Crystal Tower. After a three-week trial in September 2025 in Garfield County, the jury awarded $82,000,000 in noneconomic damages — 49.95% ($40,959,000) assigned to the park and 49.95% to the ride manufacturer — plus $123,000,000 in punitive damages against the park, more than $205 million combined. The trial court found the death met the “felonious killing” exception to Colorado’s $250,000 wrongful-death cap, cut the punitive award to $40,959,000 plus prejudgment interest, and on November 21, 2025 entered judgment allocating “more than $116,000,000 of liability to the Park” — an amount that “exceeds applicable insurance policy limits.” The park says the cap should apply and is appealing.

Standstill talks after the judgment ended in an impasse, and the park filed for Chapter 11 in Delaware on February 9, 2026. On the family’s motion the case moved to Colorado on April 30, 2026. The investment bank Hilco sent a sale teaser to about 190 parties; at least 32 signed nondisclosure agreements. The judge rejected the family’s appraisal of the park, holding that “the price obtained at auction is the value of Debtor’s assets as a going concern.”

Who owns Glenwood Caverns, and is the park still open?

Who owns Glenwood Caverns? Until the sale closes, the operating company is owned by GCAP Holdco, in which funds associated with Off Road Capital Partners hold an 82.5% indirect interest and the founder 17.5%. After closing, the park belongs to GVC Glenwood LLC — Gondola Ventures 80%, the founder 20%. The park told the Post Independent it is “currently under contract with a Colorado investor group” and that details will follow once the purchase is final. As of October 14, 2026 we have not seen a notice that the sale has closed.

Is the Glenwood Springs amusement park still open? Nothing in the court record we read points to a closure: the plan sells the park as a going concern, and the September 29 findings describe it as “open year-round,” with peak season from May through September and up to 250 employees in peak season. Practical visitor questions — tickets, hours, whether you can bring water — are not addressed in the bankruptcy papers; this page cannot answer them, so check with the park directly.

Real or scam: is anyone owed a “Glenwood settlement” payment?

If an email, text or social-media post says you are owed money from a “Glenwood settlement” and asks for bank details or a fee, it did not come from this case. The only creditors with a stake are the bank, the parents, a list of trade vendors and the park’s owner. The court-appointed claims and noticing agent is Epiq Corporate Restructuring, which posts the case documents at dm.epiq11.com/case/glq/dockets.

The name causes confusion. On September 23, 2026 Georgia’s Court of Appeals refused to enforce a $300,000 policy-limits deal in an unrelated hotel-injury case, Glenwood Motel Enterprise v. Martin; we covered that ruling separately. It has nothing to do with the Colorado park.

What to watch next

Three things will decide when, and how much, the family is paid: whether the October 13 appeal in the bankruptcy case leads to a stay of the confirmation order or the sale; when the sale closes and the plan takes effect; and how the Colorado Court of Appeals rules on the felonious-killing finding that lifted the $250,000 cap. In a statement to the Post Independent after the sale ruling, the parents said: “No matter who owns the park we are going to keep doing everything we can to make the park safer.” We will update this page when the appeal papers, the effective-date notice or the state appellate ruling appear on the record.
