Flo App Settlement: Claims for the $59.5 Million Fund Close October 15, 2026, and on October 29 a Judge Hears the Request for a Reported $1.1 Billion Judgment Against Meta

Yes. Frasco v. Flo Health, Inc., Case No. 3:21-cv-00757-JD, is a class action in the U.S. District Court for the Northern District of California before Judge James Donato. The official website is PeriodTrackerDataPrivacyLitigation.com.

Who is included: the court's definition covers “all users of the Flo Health mobile application in the United States who entered menstruation and/or pregnancy information into the Flo Health mobile application between November 1, 2016 and February 28, 2019, inclusive.”

The money: Google agreed to pay $48,000,000, Flo Health $8,000,000 and Flurry $3,500,000, for combined settlements of $59,500,000. All three deny the allegations and deny that they did anything wrong. The court preliminarily approved the Google and Flo settlements on April 22, 2026; the Flurry settlement had been preliminarily approved earlier.

Deadlines: online claims are due by 11:59 p.m. Pacific Time on October 15, 2026; a paper claim form must be postmarked by October 15, 2026. Objections are due October 8, 2026. The deadline to exclude yourself passed on July 20, 2025, so it is no longer possible to opt out.

Payments are pro rata: the fund is split among valid claims after fees and costs, so the amount depends on how many people file. In their motion for final approval, filed August 20, 2026, class counsel estimated an average recovery of $31.94 per class member if 10% of the class files, and $12.69 if 25% files. Figures of $200 to $400 seen online are far higher than that estimate.

Class counsel have also asked for $19,366,666.67 in attorneys' fees, a blended rate of 32.5% (one-third of the Google and Flo funds, 20% of the Flurry fund). The court has not ruled on that request.

California residents: claimants who provide reasonable documentation that they belong to the California subclass, for example a valid California address, receive twice the pro rata share of claimants from other states.

Why Flurry pays less: Flurry had dissolved, and its settlement secures all of its remaining cash on hand.

When: payments come only after final approval and after the appeal and claims process concludes. The notice says it “can sometimes take a year or more for the appellate and Claims process to conclude.”

Meta did not settle. Google agreed to settle on July 3, 2025, before trial; the trial against Flo and Meta began on July 21, 2025; and Flo agreed to settle on July 30, 2025, during trial. On August 1, 2025, the jury found Meta liable under the California Invasion of Privacy Act. In September 2025, Judge Donato refused Meta's request to overturn the verdict or order a new trial. At a hearing on September 30, 2025, he signaled that Meta could owe nearly $8 billion, based on plaintiffs' proposal of $5,000 per class member and their estimate of about 1.6 million eligible California class members.

On September 14, 2026, plaintiffs filed a motion for entry of judgment. According to MLex, the requested judgment would require Meta to pay about $1.1 billion to about 222,000 California residents, far fewer people than the 1.6 million estimated in 2025; the motion itself is not freely available, so we cannot say how that group was counted. Meta filed its opposition on September 28, 2026.

As of September 30, 2026, no judgment has been entered against Meta and no damages have been paid. Meta would ordinarily appeal only after a judgment is entered.

Three requests are set for hearing before Judge Donato in San Francisco on October 29, 2026:

10:00 a.m.: plaintiffs' motion of September 9, 2026 to enter claims administration and notice programs; the filing includes a proposed claim form. Meta opposed it on September 23, 2026.

11:00 a.m.: the final approval hearing for the $59.5 million Google, Flo and Flurry settlements (Courtroom 11), and plaintiffs' motion for entry of judgment against Meta.

The judge can rule at the hearing or later. Nothing is final until the court rules, and either side can appeal a final decision.

There is no approved Meta claim form yet. According to the official settlement website, people who were California residents may be eligible for money from the Meta verdict, and eligible people will be contacted later. Filing a claim in the Google, Flo and Flurry settlement does not affect that right.

What to do now: if you used the Flo app in the class period, file your claim for the $59.5 million settlement on the official website by October 15, 2026. If you lived in California, keep documentation of your address from that time.
