Bueno v. Etairos Health, Inc., Case No. 24-002129-CI, Circuit Court for the Sixth Judicial Circuit in and for Pinellas County, Florida. People whom Etairos notified on or around March 22, 2024 about the February 20, 2024 ransomware attack (about 3,259 people, mostly current and former employees of the home health company) can claim a flat $75, or up to $4,500 in documented losses including up to $120 for lost time, plus three years of credit monitoring. Etairos pays approved claims directly, so there is no pro rata cut. The claim deadline is December 21, 2026; opt-outs and objections are due November 20, 2026; the final approval hearing is January 20, 2027. The official site is EtairosHealthSettlement.com, run by Simpluris.

The answer first: $75 with no receipts, or up to $4,500 with them — claim by December 21, 2026
If Etairos Health sent you a data-incident letter or email around March 22, 2024, you are in this settlement and you can ask for money now. The choice is simple: an alternative cash payment of $75, or reimbursement of documented losses of up to $4,500 per person, which includes up to $120 for time spent dealing with the breach. You cannot take both. Separately from either cash option, everyone in the class can sign up for three years of three-bureau credit monitoring and identity theft protection — but only by filing a claim. The official site, EtairosHealthSettlement.com, puts it in one line: “You must submit a claim by December 21, 2026.”
The class is small. In the settlement agreement Etairos “represents that the Settlement Class contains approximately 3,259 individuals.” Most of them are current and former employees of the Florida home health company, which, according to the notice, provides home health care services in Largo, Palm Harbor, Fort Lauderdale, Tampa, Orlando and Tamarac. There is no shared pot to split. Etairos pays approved claims directly, at the amounts written into the agreement, so a valid $75 claim is not cut down because many other people file. Nobody gets paid before the court grants final approval, though. The final approval hearing is set for January 20, 2027.
What happened and what the lawsuit claims
According to the settlement agreement, the case “arises from a data security incident that occurred on or around February 20, 2024,” and the circumstances “involved a ransomware attack that impacted Defendant’s network.” The official notice says an unauthorized individual “was suspected to have potentially accessed Etairos’ systems and acquired personally identifiable information” of current and former employees. The agreement lists the data that may have been involved: “name, address, government issued ID, license credential, phone number, and/or Social Security number.” Etairos sent written notices on or around March 22, 2024.
The plaintiff, Isabel Garcia Bueno, sued in Florida state court, not federal court. The case is Bueno v. Etairos Health, Inc., Case No. 24-002129-CI, in the Circuit Court for the Sixth Judicial Circuit in and for Pinellas County. The lawsuit “asserted claims for negligence and breach of implied contract.” Etairos “denies all of the Plaintiff’s claims and maintains it did not do anything wrong.” The settlement agreement is dated April 8, 2026. Class counsel are Patrick A. Barthle of Morgan & Morgan and Ryan D. Maxey of Maxey Law Firm, both in Tampa. Etairos is represented by Constangy, Brooks, Smith & Prophete.
Who gets what, and when the money could arrive
The $75 option. It is a flat payment “in lieu of” a claim for losses and time. The claim form asks you to prove that you are in the class, not that you lost money. You do that with either “the unique identifier provided in the Notice you received by postcard or email” or the “name and physical address you provided to Etairos for employment purposes.”
The documented option, up to $4,500. This covers unreimbursed costs that are traceable to the breach, starting February 20, 2024: credit report and credit freeze or unfreeze fees, credit monitoring you bought yourself, notary, fax, postage, copying, mileage and long-distance phone costs, and losses from identity theft, fraud or falsified tax returns. Each item needs paperwork, such as a bank or card statement, and you may black out unrelated transactions. Time is paid at $15 an hour for up to 8 hours, with a signed statement describing what you did. Time spent filling out the claim form does not count. If the administrator finds a gap in your claim, the agreement gives you 30 days to fix it before the claim is rejected.
When. The agreement says payments go out “within sixty (60) days of the Effective Date, or within thirty (30) days of the date that the claim is approved, whichever is later,” and that “No approved claims shall be paid until after the Effective Date.” The Effective Date comes only after final approval, which cannot happen before the January 20, 2027 hearing, and after any appeals. So by our reading, no payments will arrive in 2026. The claim form says payment comes as “a check or electronic payment.” The lawyers’ request of up to $146,500 in fees and costs, plus a $3,500 service award for the plaintiff, is paid separately by Etairos and “will not reduce the amount available to Settlement Class Members who submit valid claims.” Etairos has also agreed to keep verifiable data security procedures in place for 3 years.
What to do, and the deadlines
- File a claim online at the settlement website, or mail the paper form postmarked no later than December 21, 2026 to: Etairos Health Claims Administrator, P.O. Box 25226, Santa Ana, CA 92799. The same claim is the only way to get the credit monitoring.
- Opt out (no money, but you keep the right to sue on your own): mail a signed letter with your name and address, postmarked by November 20, 2026, to the same P.O. box.
- Object: file a written objection with the Clerk of the Pinellas County Circuit Court, 315 Court St., Clearwater, FL 33756, by November 20, 2026, and mail copies to class counsel and defense counsel postmarked by the same date.
- Final approval hearing: January 20, 2027, at 9:00 a.m., Clearwater Courthouse, Courtroom B (or by Zoom if the court orders it). You do not have to attend.
- If you do nothing, “you will get no benefits from this Settlement” and you still give up your claims against Etairos once the settlement becomes final.
The form is signed “under penalty of perjury,” but it does not need a notary. If you are not sure whether you are in the class, call the administrator at (866) 719-2657. The FAQ asks: “Please do not contact the Court with questions.”
Is the data breach settlement legit?
Yes. This one is a real, court-supervised settlement. The notice states: “A court authorized this notice. This is not a solicitation from a lawyer.” The case number on the website and in the notice, 24-002129-CI, is the Pinellas County circuit case. The website is run by Simpluris, a claims administration firm, and its notice, claim form and settlement agreement are hosted on Simpluris’s document server. The only official contact points are (866) 719-2657, info@EtairosHealthSettlement.com and P.O. Box 25226, Santa Ana, CA 92799.
Here is how to check a message that claims to be about this settlement. The real claim process asks for the unique ID printed on your notice, or the name and address you gave Etairos as an employee. A genuine message will not ask for a fee to release a payment. If you are unsure, type the address EtairosHealthSettlement.com yourself instead of tapping a link, or call the number above. Social-media posts about health-care breach payouts are not a source for this case. This settlement covers only people Etairos notified around March 22, 2024. A question about another company’s breach, such as a lab or a bank, belongs to that company’s own settlement and its own official website.
How this compares
Next to the big data breach cases, this is a small settlement. Even if every one of the roughly 3,259 class members took the $75 option, the cash total would stay below a quarter of a million dollars, by our arithmetic. We found no overall cap on what Etairos pays in the agreement. That structure is the main advantage for claimants. Many settlements of this size use a fixed fund and pay a pro rata share that shrinks as more people file. Here, the $75 and the documented amounts are fixed. One condition can still end the deal: under the agreement, if 100 or more people opt out, Etairos may cancel the settlement.
As of October 12, 2026, the settlement website has not published how many claims have been filed. It also does not name the judge or give the date of the preliminary approval order, and we have not been able to review the Pinellas County court file. We will update this report once the court rules after the January 20, 2027 hearing.
