McHugh v. Equinox, Inc., Index No. 911677-24, and Carter v. Equinox, Inc., Index No. 901198-25, Supreme Court of the State of New York, Albany County, Justice Richard Platkin. The settlement agreement posted on the official site, EquinoxIncSettlement.com, run by Angeion Group, fixes the fund at $685,000.00 — “a non-reversionary common fund” — for people who were sent a notice about the Equinox, Inc. data incident of on or about April 29, 2024. Class members can claim an estimated $100.00 without proof, up to $5,000.00 in documented losses, and three years of credit monitoring. The claim deadline is October 23, 2026; the Final Approval Hearing is set for November 12, 2026 at 11:00 AM. Equinox, Inc. is not the gym chain and not the Chevrolet SUV.

The answer: the $685,000 is official, and the claim deadline is October 23, 2026
When we first covered this case on August 27, 2026, the $685,000 total was a reported figure; the court-approved notice never states it. The settlement agreement on the official site does. Paragraph 31 defines the Settlement Fund as “a non-reversionary common fund in the amount of $685,000.00,” and paragraph 39 adds that Equinox “shall not be required to pay any more money under this Settlement.” Non-reversionary means money left after claims does not go back to Equinox; the cash payments are instead adjusted upward.
As of October 14, 2026, the official site still lists the same schedule: claim deadline October 23, 2026, online or postmarked by mail; exclusion and objection deadline September 23, 2026, which has passed; and the Final Approval Hearing on November 12, 2026 at 11:00 AM, a date the notice says is “subject to change without further notice.” No fee motion or final approval motion was posted on the site’s documents page when we checked.
Who is in it, and how do I know if I was affected?
How do I know if there is a data breach that applies to you here? The test is a letter, not a membership. The class is “all living individuals residing in the United States who were sent a notice by Equinox that their Private Information may have been impacted in the Data Incident.” Equinox, Inc. is the defendant in two cases in Albany County; the official site lists the exposed data as names, addresses, dates of birth, Social Security numbers, driver’s license numbers, health insurance information, medical treatment or diagnosis information, medication-related information, financial information, provider name and MRN/patient ID. The claim form asks for a Notice ID, “found on postcard notice.” If you cannot find it or are unsure whether you were notified, the notice says to call 1-844-943-4276 or email info@EquinoxIncSettlement.com.
Equinox denies the claims, and the notice states that “the Court has not decided in favor of Plaintiffs or Defendant.” Two searches that land here concern different matters. What is the lawsuit against Chevy Equinox about? This settlement does not cover the Chevrolet Equinox vehicle at all; it covers only people who received a breach notice from Equinox, Inc., so vehicle questions need a separate search for that model. How much will the Equifax settlement be per person? Equifax is a different company with its own settlement and its own official site, EquifaxBreachSettlement.com, operated by JND; nothing on this page applies to it.
What you can get, and where the $685,000 goes first
There are three benefits, and you can combine them. Documented losses: up to $5,000.00 per person with reasonable documentation — credit monitoring you paid for on or after April 29, 2024, unreimbursed fraud or identity theft losses, bank fees, long-distance phone charges, postage or mileage. A documented claim that is rejected and not cured is “treated as if he or she elected a Pro Rata Cash Payment only.” Pro rata cash: an estimated $100.00, no proof needed. Credit monitoring: three years, one bureau, with dark web monitoring, identity theft insurance up to $1,000,000.00 and managed identity recovery.
The agreement sets the order of payment: administration costs first, then service awards, then attorneys’ fees and expenses, then class benefits. Class counsel — Todd S. Garber of Finkelstein, Blankinship, Frei-Pearson & Garber and David K. Lietz of Milberg — will ask for no more than one-third of the fund, $228,333.33, plus expenses. The two class representatives may seek $2,500.00 each, $5,000 in total. By our arithmetic, if the court grants both in full, $451,666.67 remains before administration costs and expenses, and that amount must cover documented losses and credit monitoring before the cash payments. The $100 figure is therefore an estimate: it moves “upwards or downwards based upon the number of valid claims filed.”
What to do by October 23, 2026
File online at EquinoxIncSettlement.com or mail the claim form, postmarked no later than October 23, 2026, to Equinox Settlement Administrator, Attn: Claim Form Submissions, 1650 Arch Street, Suite 2210, Philadelphia, PA 19103. The form offers payment by PayPal, Venmo, Zelle, virtual prepaid card or physical check. Have your Notice ID and any receipts ready; if you want the documented-loss payment, attach proof.
Do not expect money soon after the deadline. The notice says payments come only “after the Settlement is approved and becomes Final,” and appeals can delay that. Under the agreement, payment is due within 30 days of the Effective Date, or within 21 days of a claim’s approval, whichever is later. Credit monitoring activation codes are sent within 30 days of the Effective Date. The court’s preliminary approval order, entered on June 25, 2026, directs class counsel to “promptly file a motion for final approval” after the opt-out and objection deadline; whether that motion has been filed is not shown on the settlement site as of October 14, 2026.
Real or scam: how to check the Equinox data breach notice
The genuine settlement uses one website, EquinoxIncSettlement.com, one phone number, 1-844-943-4276, and one email address, info@EquinoxIncSettlement.com. The settlement documents are hosted by Angeion Group, the administrator named in the plaintiffs’ motion. Nothing in the notice or the claim form asks for a payment to file. A message that asks for a fee, for online banking passwords, or sends you to a different domain is not from the administrator; call the number above and give your Notice ID instead of clicking through.
Filing a claim has a legal effect: per the official site, if you submit a claim you “will give up the right to sue Equinox.” Since the exclusion deadline of September 23, 2026 has passed, class members who did nothing are bound either way, so filing costs nothing extra.
How this case compares
The agreement gave Equinox a walk-away right if more than 500 people opted out; the settlement has not published how many did. Equinox also says it has adopted security changes, which it will describe only in “a confidential declaration” to class counsel. The number of people notified is not stated in any document on the settlement site, so the real per-person payment cannot be calculated in advance. Our data breach settlement calculator shows how fees and claim rates usually change the final amount. For the background on why this is not the fitness chain, see our August 27 report.
