Paid Domino’s 6% “Health Care” Charge at One of Four San Francisco Stores? If the Store Has Your Email, a 75% Voucher Comes Automatically — Cash Pays Only 50%, and You Must Claim It by November 8, 2026

Hayden Miller, et al. v. Asi Foods Inc., et al., Case No. CGC-25-630503, Superior Court of California, County of San Francisco, Judge Jeffrey S. Ross. Four franchise companies that run the Domino’s stores at 3116 Noriega Street, 320 Bayshore Blvd., 5200 Geary Blvd. and 728 Geary Street settled claims that they added a six percent charge tied to San Francisco’s Health Care Security Ordinance and, the plaintiffs allege, presented it as a tax. Anyone in California who paid it between December 4, 2023 and August 12, 2026 gets back 75% as a store voucher by default, or 50% in cash with a claim filed by November 8, 2026. Judge Ross granted preliminary approval on August 12, 2026; the opt-out and objection deadline is October 24, 2026 and the final hearing is December 18, 2026. The defendants deny wrongdoing. Paid Domino’s 6% “Health Care” Charge at One of Four San Francisco Stores? If the Store Has Your Email, a 75% Voucher Comes Automatically — Cash Pays Only 50%, and You Must Claim It by November 8, 2026 — key figures at a glance

The short answer: a voucher comes by itself, cash takes a claim

If you ordered from one of four Domino’s stores in San Francisco and paid the extra six percent line labeled for the city’s Health Care Security Ordinance between December 4, 2023 and August 12, 2026, you are probably in the class of Hayden Miller, et al. v. Asi Foods Inc., et al. The settlement gives you a choice. Do nothing, and if the stores have your email, you get a voucher worth 75% of the fee you paid. File a claim, and you get 50% of the fee in money instead. The official notice puts it this way: “For those Class Members for whom Defendants have a valid e-mail address, the Voucher will be sent as a default and automatically with no further action required by you.”

The four stores are 3116 Noriega Street (94116), 320 Bayshore Blvd. (94142), 5200 Geary Blvd. (94118) and 728 Geary Street (94109). Other Domino’s stores in San Francisco are not part of this case. Only California residents qualify. The amount is not a flat payment: it is calculated “based on records of your purchase history maintained by Defendants.” The settlement site does not publish a total settlement value, a class size or the total fees collected.

Is Domino’s facing a lawsuit? In this case, yes, on paper. Domino’s Pizza, LLC, the Michigan company, was named as a defendant next to the franchisees Asi Foods Inc., Aai Foods Inc., Ahi Foods Inc., Ari Foods Inc. and their owner. Judge Ross’s order notes that Domino’s Pizza “is not a signatory to the settlement agreement,” but that the deal “resolves all of the claims against Domino’s Pizza, LLC,” and the release covers it if the court gives final approval. The vouchers and payments come from the franchisees.

Who gets what, and when the money moves

The math is simple. Our examples: a $30 order carried a six percent fee of $1.80; the voucher returns $1.35 of that, the cash option $0.90. If you paid $100 in these fees over the class period, the voucher is worth $75 and the cash $50, a $25 difference. Most people will be dealing with small amounts.

The voucher has real limits. The settlement agreement says it “(i) shall be redeemable only at the Four San Francisco Locations; (ii) shall not expire; (iii) shall not be transferable and valid for a single use only; (iv) are not redeemable for cash ... (v) shall not be valid for past purchases, and (vi) shall not be replaced if lost or stolen.” It does not expire, but you have to use the whole thing on one order at one of those four stores. If you moved away or no longer order there, the 50% cash option is likely worth more to you.

Nothing is paid before final approval. Under the agreement, vouchers are emailed and cash payments are emailed or mailed “Within thirty-five (35) days following the Final Effective Settlement Date,” which is 35 days after judgment if nobody appeals. If Judge Ross enters judgment at the December 18, 2026 hearing and there is no appeal, our arithmetic puts the effective date at January 22, 2027 and the deadline for vouchers and payments at February 26, 2027. An appeal would push that back. The paper claim form says a cash payment is mailed as a check; the agreement also allows an emailed payment.

Fees are paid on top. Class counsel, HammondLaw, P.C., will ask for up to $200,000 in fees and costs, and the three named plaintiffs for up to $1,500 each. The notice says payment of those amounts “will not affect the benefits provided to the Class.” The papers supporting final approval and fees are due November 18, 2026.

What to do, and the deadlines

  • Want the voucher and the stores have your email: do nothing. The FAQ says that if you do not file a claim, “you will receive a Voucher.”
  • Want cash instead: file the online claim on AsiFoodsSettlement.com “before 11:59 pm on November 8, 2026.” If you miss it, you get the voucher.
  • Ordered without an email (in-store cash, phone order, a different address): you must act or you get nothing. Send proof of purchase to info@asifoodssettlement.com or to Miller v Asi Foods c/o Settlement Administrator, PO Box 23698, Jacksonville, FL 32241-3698. The administrator then sends a login. The paper form must be signed under penalty of perjury, have all proofs of purchase attached and be submitted by November 8, 2026. The FAQ is blunt: without a valid claim, “you will receive no benefits under the settlement but you will still be bound by the settlement unless you exclude yourself.”
  • Opt out: online, by email or by mail, postmarked or submitted by October 24, 2026, with the words “Request for Exclusion” at the top. Not by telephone. Opting out keeps your right to sue on your own and means no voucher or cash.
  • Object: also by October 24, 2026, with the word “Objection,” the case name, your contact details, your signature and your reasons. If you file both, only the opt-out counts.
  • Hearing: December 18, 2026, 10:30 a.m., Department 613, 400 McAllister Street, San Francisco. You do not have to attend.

Defendants estimate they have email addresses for approximately 95 percent of the class, according to the agreement. If you used several email addresses or ordered both online and in the store, the purchases tied to the email the stores have on file are what counts automatically; anything else needs proof of purchase.

Is the email real or a scam?

The settlement is real. Judge Jeffrey S. Ross of the San Francisco Superior Court signed the preliminary approval order on August 12, 2026 and appointed American Legal Claim Services, LLC as administrator. The agreement required email notice to start no later than 28 calendar days after that order, so by our count notices should have gone out by about September 9, 2026.

Check any message against these points. The only official website is asifoodssettlement.com, the email address is info@asifoodssettlement.com, and the mailing address is a PO box in Jacksonville, Florida. A real notice does not ask for card numbers or bank logins, and you never pay to receive a voucher. The voucher itself is not due until after final approval, so a message before then that claims to deliver your “Domino’s settlement voucher” should be treated with suspicion. Remember too that the voucher is good only at the four listed stores; a code offered for any Domino’s store is not this settlement. If in doubt, open the site yourself instead of clicking a link. The court’s case file can be searched under CGC-25-630503 on the San Francisco Superior Court’s website; the notice asks people not to direct questions to the clerk or the judge.

How the case got here

The plaintiffs filed in San Francisco Superior Court on or about October 24, 2025 and filed the operative Second Amended Complaint on December 19, 2025, claiming violations of the Consumers Legal Remedies Act, the Unfair Competition Law and the False Advertising Law, plus fraud. The central allegation, in the notice’s words, is that the defendants “charged a fee of six percent of an order paid by consumers associated with the San Francisco Health Care Security Ordinance but improperly identified the fee as a tax to consumers.” The defendants deny any wrongdoing and say the claims are without merit and subject to arbitration. The parties settled after mediation on April 29, 2026. The complaint had sought a class going back to July 1, 2024; the settlement reaches back to December 4, 2023, the date the defendants began operating the four stores.

The settlement also looks forward. The defendants “no longer pass on the HSCO fee to consumers and have not done so since January 2026,” and they agreed that any future charge of this kind “will be clearly and conspicuously disclosed.” San Francisco restaurant surcharges for employee health care have been fought over in court before. This case is narrow: four franchise stores, one fee, and a payout tied to each customer’s own order history, not a shared fund. We have written about similar fee cases, including the Raging Waters processing-fee settlement and the Capital One Arena venue-fee settlement, where class members got equal shares instead of their own fees back.
