What happened on September 28 — and what has not happened

The Delta fuel dump settlement reached its final approval hearing on Monday, September 28, 2026, at 8:30 a.m. — a date the official settlement website still shows in a banner, after the hearing was moved twice (from May 18 to July 13, and then to September 28). City News Service, in a report carried by MyNewsLA.com that day, wrote that the judge “tentatively approved” the settlement and “is expected to issue his final order at a later date.”

That distinction matters. A tentative ruling from the bench is not a judgment. Nothing in the settlement starts to run until a written final approval order and judgment is entered. As of our check on October 1, 2026, the official site at DL89Settlement.com listed no final approval order among its case documents, and the CourtListener mirror of the federal docket showed three transcript order forms filed on September 29 and 30 (docket entries 742 to 744) but no final approval order. That mirror can lag behind the court’s own system, so the absence there is not proof that no order exists — only that none was publicly visible to us.

How much per claim: the court’s two scenarios, and why the real number should be higher

The money left after fees and costs — the notice calls it a Net Settlement Fund of “approximately $50,590,000” — is split into two pots. 67% goes to owners and is divided equally per property. 33% goes to residents and is divided equally per person. Someone who both owned and lived in a class home can be paid from both.

When Judge Kronstadt granted preliminary approval on November 13, 2025, his order repeated the parties’ estimate of the class — 38,135 property owners and 160,000 residents — and what that would mean:

  • If everyone claimed: $888.82 per property and $104.34 per resident.
  • If half claimed: $1,777.64 per property and $208.68 per resident — $2,612.36 for a family of four in a home it owns.

Actual participation appears to be far lower than either scenario. After the September 28 hearing, plaintiffs’ attorneys told City News Service the settlement “will be distributed among nearly 13,000 property owners and residents.” (A preview story from the same wire service earlier that day said 38,000, which matches the roughly 38,000 class properties in the court’s order and so appears to be a class-size figure rather than a count of claims.) Neither the official site nor any court document we could read gives the number of approved owner claims and resident claims separately, so no exact payment can be calculated today.

An illustration only, not a prediction: the estimated class adds up to 198,135 owners and residents; 13,000 would be about 6.6% of that. If the approved claims split between properties and residents in the same proportion as the class estimate — roughly 2,502 properties and 10,498 residents — the notice’s net fund would work out to about $13,500 per property and about $1,590 per resident. A different split changes those figures sharply, and the 13,000 figure itself comes from the attorneys, not from a filed claims report.

When the money can move: 30 days, then up to 60, then up to 20

The notice says only that payment follows final approval and any appeals. The settlement agreement is more specific, and it works like a chain:

  • Effective Date. The settlement becomes effective when the final judgment can no longer be appealed — either because the appeal period ran out with no appeal, or because every appeal is finished. In federal civil cases a notice of appeal generally must be filed within 30 days after the judgment is entered.
  • Delta pays. Delta must wire the settlement fund “within sixty (60) calendar days of the Effective Date.”
  • The administrator pays. Payments go out “within twenty (20) calendar days of the payment of the Settlement Fund.”

Added together, that is up to about 110 days from the day the written judgment is entered, if nobody appeals. Because the judgment had not appeared when we checked, that clock had not visibly started. An appeal by an objector would stop it; the notice warns that resolving appeals “can take time, perhaps more than a year.”

Payments may be digital (the agreement lists a virtual prepaid card, Venmo or Zelle) or physical (a check or debit card), at the administrator’s choice. Each payment is valid for 90 calendar days; a reminder goes out 14 days before it expires, and expired payments are reissued only for good cause. If cashed payments do not reach 90% of the net fund, the uncashed money is redistributed to the people who did cash theirs; otherwise the remainder goes to charities named in the agreement, subject to court approval.

Who is in the class — and why you cannot join now

The class covers people who, on January 14, 2020, owned, lived in or rented one of the 1-to-4-unit residences on the list of affected properties prepared for the case by John A. Kilpatrick, within the Class Area map on the official site. Only people who filed a claim form with proof of ownership or residence by February 6, 2026 are paid; that was also the deadline to opt out or object. Children under 14 had to be claimed by a parent or guardian.

If you lived in the area and did not file, the notice is blunt: you “will not receive a payment” and you are still bound by the release. The agreement makes no provision for late claims that we could find. Excluded from the class are, among others, government entities, anyone who filed their own lawsuit over the jettison, and owners who sold their property after the incident without disclosing it to the buyer.

Where the $78.75 million goes

The agreement caps what may come off the top before class members are paid: attorneys’ fees of up to $24,000,000, litigation costs of up to $2,000,000, notice and administration costs of up to $2,100,000, and service awards of $60,000 in total for the four named plaintiffs ($15,000 each). Subtract all four caps from $78,750,000 and $50,590,000 is left — the figure in the notice. After the hearing, plaintiffs’ attorney Filippo Marchino told City News Service the class will receive about $51.2 million if all fees and costs are approved; the written order will show the final amounts.

Besides cash, class members received a joint declaration by both sides’ experts on laboratory testing. Its summary on the settlement site says fuel reaching the ground “likely would not have been detectable in soil within one hour of the jettison.”

How the case got here

According to City News Service, a Delta Boeing 777 bound for Shanghai lost thrust shortly after leaving LAX and released about 15,000 pounds of jet fuel before returning to land. Plaintiffs argued the pilots dumped fuel at low altitude over densely populated neighborhoods instead of over the ocean or at a height where it would dissipate. Delta has denied wrongdoing throughout and, according to the wire report, says a Federal Aviation Administration investigation cleared the pilots. The notice states that the court did not decide in favor of either side. Seven lawsuits were consolidated into this one; Frankie Lomas, Roxanda Yancor, Jose Alvarado and Maria Alvarado are the named plaintiffs, and The X-Law Group is class counsel.

How to check your claim, and how to tell real mail from fake

The only official channels are the website DL89Settlement.com, the toll-free line 1-833-419-4070, and the mailing address Delta Air Lines Settlement Administrator, P.O. Box 301132, Los Angeles, CA 90030-1132. The site is run by the administrator Verita. The notice asks class members not to call the court. Nobody has to pay a fee to receive a settlement payment, and no legitimate message will ask for a bank password. Settlement payments can be taxable depending on what they compensate; that is a question for a tax professional, not for the administrator.
