No Hacker Required: Cookies on a Delta Dental Portal Produced a $12.67 Million Settlement — $16.50 a Person, No Proof Needed, 12 Days Left

Feeler v. Wyssta Services isn't a breach case. The claims administrator behind Delta Dental's “Cover Me” member portal allegedly wired its own website with advertising trackers — the same pixel playbook behind the MyChart litigation wave. About 768,000 portal users can claim up to $16.50 with no proof of harm, but only until August 20.

The allegation: an insurance portal wired for ad tracking

Michael Feeler v. Wyssta Services, Inc., Case No. 2026LA000050, in the Circuit Court of Sangamon County, Illinois, alleges that Wyssta installed “advertising and analytics tracking technologies, such as cookies and pixels” on a Delta Dental member portal without users' knowledge or consent — in violation of the federal Electronic Communications Privacy Act and the Illinois Eavesdropping Statute. That's the official site's own summary of the claims.

Note what this is not: nobody hacked anything. No ransomware, no stolen database. The dispute is over what the website itself allegedly embedded, and who may have received visitor data as a result. Wyssta “denies the allegations and all liability or wrongdoing,” and no court has ruled on the merits — the settlement resolves the case without a finding of liability.

Who's covered — narrower than “Delta Dental members”

The class, per the official site: all U.S. residents who held an account on my.deltadentalcoversme.com between January 23, 2021, and January 23, 2025. That is the “Cover Me” portal used for individually purchased Delta Dental coverage, operated by Wyssta — a dental and vision insurance claims administrator, per press coverage of the settlement. classaction.org puts the class at roughly 767,896 people.

That makes the headline framing — “Delta Dental users may be owed cash” — broader than the fine print. If your dental plan runs through an employer and you've never used that specific member site, this settlement likely isn't yours. The test is the portal, not the brand on your insurance card.

The $16.50 math

The FAQ states Wyssta will pay “up to approximately $12,670,284 as a Settlement Fund,” and that each class member who submits a valid claim form gets “up to $16.50” — reduced pro rata if valid claims outrun what's left after costs and a class-counsel fee request of up to $2,500,000 (about 19.74% of the cap). Note the direction: $16.50 is a ceiling, not an estimate that can rise. Run the numbers and the cap is engineered for near-total participation — 767,896 members times $16.50 is almost exactly the fund.

No proof of harm, loss documentation, or receipts are required — just a valid claim form by August 20, 2026, which is also the opt-out and objection deadline. The final approval hearing is September 9, 2026, at 1:00 p.m.; payments follow approval and any appeals. Administrator: Kroll Settlement Administration, (833) 930-1183.

The pattern: member portals keep paying for tracking tech

If this sounds familiar, it should. Embedded trackers on health-adjacent login portals have become their own litigation category — the MyChart pixel cases are the highest-profile example, and dental has a parallel track: the DentaQuest settlement (a genuine breach case — outside intruder, different animal, bigger per-person money).

The trade-off is consistent across the category: tracking settlements pay less per person than breach settlements, but claiming is simpler because there's no injury to document. The practical move is always the same — identify the portal you actually used, then check its deadline. This one has twelve days.
