The court-authorised site is ABCDataSettlement.com, administered by Eisner Advisory Group LLC. Every class member can take two years of one-bureau credit monitoring from IDX, plus one of two cash options: documented out-of-pocket losses up to $5,000, or a no-proof pro rata payment the settlement estimates at $50 — “and may be increased or decreased based on the number of Approved Claims, up to $450.” That ceiling is what makes this settlement worth a second look, because on the class size reported for this breach it is not a decorative number. Claims close September 28, 2026. The opt-out and objection deadlines closed on August 28, so the only decision still in front of you is whether to file.

A process server's own files, and the docket behind them

ABC Legal Services is in the business of handling other people's legal paperwork. It is a nationwide process-serving and court-filing company, which means the records it holds are not its own customers' shopping histories but the names, addresses and identifiers of people who were being served or sued. That is an unusually sensitive population to sit in one database, and it is worth stating plainly at the top, because it is the part of this case that no dollar figure captures.

The settlement papers describe an incident that began on or around August 7, 2024. The class definition on the court-authorised site, however, is keyed to a different moment: “All individuals residing in the United States whose Personal Information was potentially compromised in the Data Incident discovered by Defendant in November 2024.” Both dates are correct and they describe different events — the intrusion in August, and the November determination that personal information was actually among the files the intruder reached. Notices to affected people went out by U.S. mail in December 2024. If you are trying to work out whether you are in this class, the August date is the incident and the November date is the discovery; neither is the date you were told.

We confirmed the case independently of the settlement website. The federal docket records In re ABC Legal Services Data Security Litigation, No. 2:24-cv-02092, filed in the Western District of Washington on December 18, 2024, assigned to Judge Jamal N. Whitehead, nature of suit 380, cause 28:1332 diversity. So the case is real, the court is real, and the settlement site's caption matches the docket.

What the settlement pages we read do not say is how many people are in the class. The figure reported for this breach is 39,965 individuals, which ClaimDepot attributes to ABC Legal's filing with the Maine Attorney General's breach register. We could not open the Maine register to check it ourselves, so treat that number as reported rather than verified — but note how small it is, because the arithmetic below turns on it.

Two cash options, and a ceiling nine times the estimate

Every class member, regardless of whether anything went wrong, can enroll in two years of one-bureau credit monitoring provided by IDX, which the settlement describes as including dark web monitoring, real-time inquiry alerts and $1,000,000 of identity theft insurance. That is on top of the cash, not instead of it.

The cash is one of two things. A documented loss payment of up to $5,000 covers out-of-pocket losses traceable to the incident, with proof. Or, instead, a no-proof pro rata cash payment, which the settlement puts at “estimated at $50, and may be increased or decreased based on the number of Approved Claims, up to $450.”

Here is why that $450 is interesting rather than boilerplate. Class counsel will ask for up to one-third of the fund — $833,333.33 — plus reimbursement of costs, and service awards “not to exceed $3,500 for each of the Class Representatives.” Our arithmetic, not the court's: take the $2,500,000 fund, subtract the requested fee, and about $1,666,667 remains before litigation costs, notice, administration and service awards — all of which come off the top and none of which we can size from the pages we read. So treat that figure as a generous ceiling on what reaches claimants.

Against a class reported at 39,965 people, that pot divides in two revealing ways. At $50 a head it would stretch to roughly 33,000 claims — about 83 percent of the class. At the $450 ceiling it covers only about 3,700 claims — about 9 percent. Data-breach claim rates in settlements of this size typically land in the low single digits of a percent, well under that 9 percent line. If this one behaves like its peers, the binding constraint is the ceiling, not the estimate. That is the opposite of the usual data-breach settlement, where a huge class grinds the pro rata share down to a few dollars, and it is a direct consequence of how few people are in this class.

Two honest caveats. First, none of that is a promise: the notice's own words are “may be increased or decreased,” and administration costs in a small settlement eat a proportionally larger share. Second, we could not determine from the pages we read whether unclaimed money reverts to the defendant or is redistributed, and that determines what happens to anything the ceiling leaves behind. We are not going to guess at it.

One deadline is open; two already closed

The settlement carries three deadlines, and as of today two of them are behind us.

The practical consequence of that ordering is worth spelling out, because it is the single most common misunderstanding we see in our inbox. The opt-out deadline passing does not cost you money — it removes an option you almost certainly did not want, namely leaving the settlement in order to sue on your own. You can still file a claim. The only deadline that costs you anything is September 28.

And approval is not payment. The judge hears the case on October 26. If approval is granted, the order still has to become final, which means waiting out the appeal period before any money moves. Nothing about filing early accelerates that; filing late simply ends the possibility.

How to file, and what not to pay for

The court-authorised website is ABCDataSettlement.com, run by Eisner Advisory Group LLC. Claims are submitted there or by mail. If you received a notice it carries a claim ID, which makes the online form straightforward; the FAQ we read does not state that a claim ID is mandatory, and we are not going to assert either way — if you believe you are in the class and cannot find a notice, the administrator's contact channels on that site are the right place to resolve it, not a third party.

That last point is the one worth repeating every time. A settlement administrator never charges to process a claim, and no service that charges you a fee or a percentage can get you a larger payment than the form on the official site. For a settlement whose realistic per-person outcome sits somewhere between $50 and $450, a “claim helper” taking a cut is a meaningful bite out of a small cheque.

One note on which ABC this is. There are several unrelated companies in our own database with similar names — ABC Supply among them — and their breach cases are different matters entirely. This settlement is ABC Legal Services, LLC, the process server, case number 2:24-cv-02092 in Seattle. If the case number on your notice is different, you are looking at a different settlement.
