Money Metals Exchange Lawsuit: Who Is Suing Whom, and Is There Money for Customers?

As of October 2026, no customer class action against Money Metals Exchange is pending in the federal records we reviewed, and there is no settlement and no claim form. The cases that do exist run the other way or sideways: a trademark dispute with a coin dealer that settled in October 2025, and a Kentucky class action in which Money Metals is a plaintiff, suing the state over sales tax charged on gold and silver. If you are a Kentucky buyer who paid that tax, there is a refund route that does not depend on the lawsuit.

What the Cases Are Actually About
Searches for a “money metals exchange lawsuit” mostly lead to three things, and none of them is a fraud claim by customers.
The Kentucky tax suit. In 2024 Kentucky passed House Bill 8 to remove its 6% sales tax on gold and silver coins, bars and rounds, effective August 1, 2024. Per the complaint as described by Money Metals, Gov. Andy Beshear attempted a line-item veto and the Department of Revenue kept collecting the tax. On March 27, 2025, Money Metals and three Kentucky taxpayers sued the governor, the Commonwealth and the Department of Revenue, seeking back taxes, interest, attorney's fees and an injunction.
The trademark suit. Stuppler & Company sued Money Metals and three co-defendants for trademark infringement; Money Metals counterclaimed. The parties reported a settlement in October 2025.
Older and smaller matters. A 2021 website-accessibility suit under the ADA ended in a confidential settlement, and Money Metals itself is the plaintiff in a 2024 federal case against LawChart.org.
Case Details
Kentucky: Huston v. Beshear, Boone Circuit Court No. 25-CI-0550, filed March 27, 2025 — the same day House Bill 2 became law over the governor's veto (Acts Ch. 100). The case is now on appeal as Kentucky Court of Appeals No. 2025-CA-1034, with the individual plaintiffs as appellants.
Federal, trademark: Stuppler & Company, Inc. v. Money Metals Exchange, LLC, No. 2:24-cv-10206, U.S. District Court for the Central District of California, Judge Dale S. Fischer, filed November 25, 2024.
Federal, ADA: Sanchez v. Money Metals Exchange LLC, No. 1:21-cv-01813, Southern District of New York, dismissed with prejudice by Judge Alison J. Nathan on May 4, 2021.
Federal, Money Metals as plaintiff: Money Metals Exchange, LLC v. LawChart.org, No. 1:24-cv-00257, District of Idaho, Judge David Charles Nye, filed May 24, 2024.
Status: No Customer Case, No Settlement Fund
Stuppler (trademark): a notice of settlement was filed October 9, 2025, and a joint stipulation of dismissal with prejudice followed on October 16, 2025. It was a business dispute; customers get nothing from it.
Kentucky (tax): an appeal was pending in the latest filing we found. In its appellee brief dated March 3, 2026, the Commonwealth argues the claims fail because the Department of Revenue already posted refund instructions. We could not read the Boone Circuit Court ruling being appealed, and we found no Court of Appeals decision as of October 13, 2026.
Who Could Benefit, and From What
Kentucky buyers only. The Kentucky suit asked for two classes — one for consumers and one for dealers. No class has been certified in anything we found. Money Metals told the court it remitted the tax for more than 800 Kentucky customers.
The refund does not wait for the lawsuit. Per the Kentucky Department of Revenue, consumers who paid sales tax on bullion for periods on or after August 1, 2024 should ask the retailer they bought from for the refund, with receipts showing the tax charged. Requests sent straight to the Department without going through the retailer cannot be processed. Retailers then file Form 51A209 with the state.
Outside Kentucky, none of these cases gives a customer a claim.
What Money Is Really on the Table
For Kentucky buyers, the realistic money is the sales tax you were charged on qualifying gold and silver since August 1, 2024, returned through the dealer. House Bill 2 also lets a prevailing taxpayer recover interest, attorney's fees and liquidated damages of $1,000 for each day of a violation — but that only matters if a court rules for the plaintiffs, and as of October 2026 the last appeal filing we could find was the Commonwealth's brief, and we found no decision.
How cases like this one end
Our copy of the federal courts’ own case database covers 38,446 federal civil cases of this typeclosed in U.S. federal district courts between 2015 and 2026:
- 23.8% ended in a settlement recorded by the court. Another 28.5% were dismissed voluntarily, which often follows a private settlement — so the real settlement share sits between 23.8% and 52.3%.
- 4.1% were decided on a motion before any trial.
- 1 in 110 reached a trial (0.9%), after a median of 28.4 months.
- Median time from filing to the end of the case: 5.6 months.
- Only 2,917 of them (7.6%) record a money award at all; the median of those is $500,000.

Three Things to Watch For
A searched-for lawsuit with no claim form attracts invented ones:
“Money Metals class action payout” pages
Several sites describe a Money Metals consumer class action without naming a court, a case number or a plaintiff. If a page cannot give you a docket number you can check, treat it as content, not a case — and never hand it your account details.
Kentucky tax-refund “agents”
The bullion-tax refund runs through the dealer you bought from, with your receipts. You do not need a paid service, and nobody legitimate needs your Social Security number or bank login to process it.
Confusing Money Metals with other gold sellers
The $185 million Metals.com and Barrick Capital fraud case and the US Money Reserve litigation involve different companies. A caller citing those cases to sell you a “recovery” for Money Metals purchases is mixing them up, deliberately or not.
Money Metals Exchange Lawsuit — Questions People Actually Ask
Is there a Money Metals Exchange class action I can join?
No. As of October 2026 we found no pending consumer class action against Money Metals Exchange, and no settlement, fund, administrator, claim form or deadline. The one class action in the news is the Kentucky tax suit, where Money Metals is a plaintiff, not a defendant.
What was the Stuppler v. Money Metals lawsuit about?
It was a trademark infringement case (No. 2:24-cv-10206, C.D. Cal.) brought by coin dealer Stuppler & Company against Money Metals, Westminster Mint, Bullion International (The Highland Mint) and one individual; Money Metals counterclaimed. After a settlement notice on October 9, 2025, the parties stipulated to dismissal with prejudice on October 16, 2025. Terms were not public in what we read.
Why is Money Metals suing the governor of Kentucky?
Kentucky exempted gold and silver from its 6% sales tax effective August 1, 2024, but kept collecting it after a contested line-item veto. Money Metals and three residents sued on March 27, 2025 in Boone Circuit Court (No. 25-CI-0550) for refunds, interest, fees and an injunction. The case is now on appeal as No. 2025-CA-1034.
I live in Kentucky and paid sales tax on silver. How do I get it back?
Ask the dealer you bought from. The Kentucky Department of Revenue says consumers seeking a refund of tax paid on bullion for periods on or after August 1, 2024 must request it from the retailer, with receipts; the retailer then files Form 51A209. Requests sent straight to the Department cannot be processed. See the Department's refund instructions.
Who is the owner of Money Metals?
We could not confirm the ownership from a primary source. The company's own March 2025 press release names Stefan Gleason as CEO of Idaho-based Money Metals Exchange.
What is the lawsuit against U.S. Money Reserve, Inc. about?
That is a different company with its own litigation history; this page does not cover it. See our US Money Reserve lawsuit page for where those cases stand.
Is Money Metals the same as Metals.com?
No. The regulators' $185 million fraud case over overpriced bullion, run through a receivership in Texas federal court, involves Metals.com and Barrick Capital, not Money Metals Exchange. That case shows up in searches because of the similar name.
What should I do if I have a complaint about a Money Metals order?
No class action covers it, so an order problem is an individual matter: keep your invoice, shipping records and written correspondence, and raise it with the company in writing first. For open settlements that do take claims, see our list of open class action settlements.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
