A truck crash in Missouri is rarely a two-party case. Alongside the driver, the motor carrier, the trailer owner, the shipper or loader, a freight broker and a maintenance contractor can each carry separate policies. Interstate carriers hauling general freight must carry $750,000 minimum liability under 49 CFR § 387.9, rising to $5,000,000 for certain hazardous materials. Commercial carriers are governed by the Federal Motor Carrier Safety Regulations, not just state traffic law. Hours-of-service limits (49 CFR Part 395), driver qualification files (Part 391), drug and alcohol testing (Part 382) and vehicle inspection and maintenance records (Part 396) each create a documented duty — and each creates evidence when it is breached.

That evidence has a shelf life. A carrier is required to retain records of duty status for only six months (49 CFR § 395.8(k)(1)), and electronic control module data can be overwritten by continued use of the vehicle. A preservation letter sent early is often the difference between a documented hours-of-service violation and a swearing contest.
