What the Lawsuit Alleges

For more than a decade, women have alleged that using Johnson's Baby Powder and Shower to Shower for feminine hygiene caused ovarian cancer, and that Johnson & Johnson knew for decades its talc could contain trace asbestos without warning consumers. J&J denies the allegations and maintains its talc is safe and asbestos-free. The company made three separate attempts to move the litigation into bankruptcy through subsidiaries (LTL Management twice, then Red River Talc). All three were rejected, the last dismissed on March 31, 2025 over improper voting procedures and impermissible third-party releases. J&J then said it would not appeal and would not attempt a fourth bankruptcy filing, returning the claims to the regular court system.

Case Details

U.S. District Court, District of New Jersey — MDL 2738 (In re: Johnson & Johnson Talcum Powder Products Marketing, Sales Practices and Products Liability Litigation), before Judge Michael A. Shipp, plus parallel state-court cases. In Canada, a separate Canada-wide talc class action was certified against Johnson & Johnson on March 4, 2026, by the Ontario Superior Court of Justice; the court has not yet ruled on the merits.

Current Status

On July 27, 2026, Johnson & Johnson announced a proposed resolution of the ovarian talc litigation estimated at $5.5 billion, disclosed in an SEC filing the same day. Three things about it are widely misreported. First, it is not final. The agreement takes effect only if law firms representing roughly 95% of active claims opt in; if that threshold is not met, it does not automatically take effect. No court has approved it and no fairness hearing has been scheduled. On July 29, 2026, a week after setting a 120-day show-cause deadline, the MDL court put all deadlines in the MDL on hold while the settlement is worked out, and they have stayed on hold since. Second, $5.5 billion is a floor, not a cap. Plaintiffs' co-lead counsel Chris Seeger has said the deal does not cap J&J's total payout and the figure could reach $7 billion or more, because payments are set case by case rather than drawn from a fixed fund. Third, no money moves soon. J&J expects to pay up to $3 billion in 2027, with further payments in 2028. When we checked in October 2026 we found no appointed claims administrator, no claims portal and no published filing deadline — an agreement that is not yet in effect has nothing to administer. On August 28, 2026, the court ordered the lawyers negotiating the deal to send it a confidential update every two weeks, starting September 15, on how many claimants are signing up toward the 95% threshold.

Who Is Affected & Can You Join?

The proposal covers ovarian cancer claims that were already filed. The U.S. Judicial Panel on Multidistrict Litigation counted 69,340 actions pending in MDL 2738 on October 1, 2026; J&J's own count including state courts is roughly 76,000. Two groups are not covered. Mesothelioma claims are handled separately, and J&J has said it previously resolved the large majority of them. And future claimants are excluded: this agreement applies only to existing cases, a key difference from the failed bankruptcy plans, which tried to bind future claims as well. Someone diagnosed with ovarian cancer today who used talc products would need to file a new individual lawsuit, subject to their state's statute of limitations, typically one to three years from diagnosis.

Is There a Payout?

Nobody has been paid, and no per-person amounts have been published. Payments are described as case by case rather than a flat per-claimant figure, and tier values are not public. Several attorney-marketing sites already list confident specifics: a "December 31, 2026 deadline," a five-tier payout grid with exact dollar amounts, a claims portal supposedly open since March 2026. None of that appears in J&J's announcement, its SEC filing, or in wire coverage from CBS, AP, NBC or Bloomberg Law. Treat those figures as advertising, not fact. If you already have a case, your own attorney is the only party who can tell you where you stand — law firms, not individual claimants, are the ones opting in or out.

You cannot yet. There is no claims administrator and no claims portal for this proposal as of July 30, 2026. If you already have a filed case, your attorney handles participation on your behalf and should be in contact. If you do not have a case and believe you have a claim, that means filing a new lawsuit rather than a claim form, subject to your state's statute of limitations.

How much will each person receive?

Unknown. Payments are described as case by case rather than a uniform per-claimant amount, and no tier values have been published. The $5.5 billion figure is a floor, not a cap: plaintiffs' co-lead counsel has said total payouts could reach $7 billion or more. Any site quoting exact per-person amounts today is guessing.

When will talc settlement payments start?

J&J expects to pay up to $3 billion in 2027, with further payments in 2028, and only after the participation threshold is met. Nobody is being paid in 2026.

Does this cover mesothelioma claims?

No. This proposal covers ovarian cancer claims. Mesothelioma claims, those alleging asbestos contamination in talc, have been handled separately, and J&J has said it previously resolved the large majority of them.

I was just diagnosed with ovarian cancer. Am I covered?

No. The agreement applies only to claims already filed. That is a key difference from the failed bankruptcy plans, which tried to bind future claims too. A new diagnosis means a new individual lawsuit, and your state's statute of limitations, usually one to three years from diagnosis, still applies.
