Is Mercor Legit? What the Public Record Shows

Mercor is a real company. Mercor.io Corporation is based in San Francisco, was founded in 2023 and raised $350 million at a $10 billion valuation in October 2025. It pays experts — doctors, lawyers, scientists and others — to train AI models for labs such as OpenAI and Anthropic, and its help pages say hourly contractors are paid every Wednesday through Stripe or Wise. Real does not mean trouble-free: a March 2026 data breach exposed some experts' Social Security numbers, a proposed class action says Mercor misclassifies its workers as independent contractors, and a message that uses its name is not proof that it comes from Mercor.

What Mercor Is, by the Record
When Mercor raised $350 million at a $10 billion valuation on October 27, 2025, TechCrunch described it as a company that connects AI labs with domain experts who train their models. Felicis led the round, with Benchmark, General Catalyst and Robinhood Ventures participating. At the time Mercor said it had more than 30,000 experts on its roster and paid its contractors more than $1.5 million a day. Its Terms of Service name the provider as Mercor.io Corporation, 181 Fremont St., San Francisco.
The work is contract work. Mercor's own help pages say it does not deduct taxes, that experts handle their taxes “as an independent contractor,” that U.S. experts file a W-9 and receive a Form 1099 once they earn more than $600 a year, and that hours are tracked with a tool called Insightful. Identity is checked once, through a service called Persona. That arrangement — not whether Mercor exists — is what one of the open lawsuits challenges.
Case Details
The pay case. White v. Mercor.io Corporation, No. 6:26-cv-00201, was filed on May 8, 2026 in the U.S. District Court for the Northern District of Texas, San Angelo Division, before Judge James Wesley Hendrix. The first amended complaint of June 25, 2026 alleges “systematic misclassification” of Mercor's workforce as independent contractors and pleads fraudulent information returns under 26 U.S.C. Section 7434, breach of contract, unjust enrichment and ERISA benefit claims. On June 9, 2026, Mercor moved to compel arbitration, strike the class allegations and stay the case, or alternatively dismiss it; Law360 reported that Mercor argues the plaintiff signed seven agreements requiring individual arbitration. The plaintiff filed her opposition on June 30, 2026.
The data breach case. In re Mercor.io Corporation Data Breach Litigation, No. 3:26-cv-02821 (N.D. Cal.), combines seven class actions over the March 2026 breach and has been stayed since July 21, 2026 for mediation — details on our Mercor data breach lawsuit page.
Closed cases. Scale AI sued Mercor over trade secrets on September 3, 2025 (No. 3:25-cv-07402, N.D. Cal.) and dismissed the case with prejudice on January 2, 2026 — a dispute between companies, with nothing in it for experts. In a separate Texas breach suit, White v. Delve Technologies, Inc., the plaintiffs voluntarily dismissed their claims against Mercor with prejudice in June 2026 (notice filed June 8, approved by the court on June 10).
Status: Two Open Cases, No Settlement
Neither case has a fund, an administrator, a claim form or a deadline. We also found no FTC or state attorney general enforcement action against Mercor in the court records and news coverage we searched. Mercor did file breach notices with state attorneys general, including California, Texas and Washington — those are notices, not enforcement actions.

Who the Mercor Cases Would Cover
The pay case proposes a nationwide class of all persons in the United States who, from January 1, 2024 through class certification, did paid AI training, data labeling, evaluation, coding or similar project work through Mercor's platform and whom Mercor treated as nonemployee contractors. Narrower subclasses cover workers whose Insightful-logged hours were cut before payout, workers whose projects required unpaid work outside Insightful, workers for whom Mercor filed Forms 1099-NEC, Texas workers, and current workers. As of September 30, 2026, we found no class certification. The proposed class is limited to persons in the United States; Mercor's help pages say experts outside the U.S. file a W-8BEN and receive no 1099.
The catch is arbitration. Mercor's Terms of Service contain an individual-arbitration clause with a class-action waiver, but say it does not apply to experts: for them, the arbitration terms of their Expert Independent Contractor Agreement or Worker Agreement control. Mercor's motion argues that the plaintiff signed agreements requiring individual arbitration and asks the court to send the claims there and strike the class allegations; as of September 30, 2026, we found no ruling on it. The breach case proposes a class of U.S. residents whose data was actually or potentially accessed in the March 2026 incident, including everyone who received notice; no class has been certified there either; see the Mercor data breach page.
Is There Money? Not Yet
The one thing with a date on it is the breach offer: Mercor's June 25–26, 2026 notice offered 24 months of free credit monitoring from Cyberscout, a TransUnion company; the notice set the enrollment deadline at October 1, 2026 and says codes do not work after that date. How to Spot a Fake Mercor Message
Mercor itself reaches people by email, text message and WhatsApp, so the channel alone proves nothing. What gives impostors away is what they ask for:
A fee, a kit or a check before you start
Mercor says it earns a margin on companies' pay rates and that “we only generate revenue when you are successfully placed on a project”; its payment pages mention one optional charge, Stripe's 1% fee for instant payouts. The FTC's rule: honest employers “will never ask you to pay to get a job,” and none will send you a check to deposit and have you send part of it back.
Passport or SSN requests by chat
Mercor's help pages name where ID and SSN requests are legitimate: identity verification through Persona, where you upload an ID and record a selfie video; the W-9 that U.S. experts fill in when accepting an offer; Stripe's own identity check, including your SSN, when you set up payouts; and a background check through a secure link from Zinc or Certn. A “recruiter” collecting ID scans by chat or email is outside those channels — and after the March 2026 breach, a stranger may know enough about you to sound convincing.
“Mercor settlement” and “join the lawsuit” pitches
There is no Mercor settlement, and nobody pays to be a class member — if a class is certified, you are in it unless you opt out. At least one claims company says it and partner law firms are bringing individual arbitration claims for Mercor contractors; signing up with such a firm means agreeing to real terms, so read them rather than treating it as a sign-up form.
Mercor — Questions People Actually Ask
So is Mercor legit, or is it a scam?
By the public record, Mercor is a real and heavily funded company: Mercor.io Corporation in San Francisco, valued at $10 billion in October 2025, supplying expert contractors to AI labs including OpenAI and Anthropic. The open questions are different ones — whether its contractors are legally employees, how it protected their data, and whether a given message really comes from Mercor.
Does Mercor actually pay?
According to its help pages, Mercor pays hourly contractors every Wednesday around 12:00 PM PST for the previous work week, which runs Saturday to Friday on India Standard Time. Stripe holds a first payout for 7 days, and a Wise transfer has to be accepted by email before the money moves. Pay disputes exist: the White lawsuit and a BBB complaint both challenge hours Mercor did not pay for.
Am I a Mercor employee or an independent contractor?
Mercor treats experts as independent contractors: its help pages say it does not deduct taxes, U.S. experts file a W-9 and receive a Form 1099 above $600 a year, and experts outside the U.S. file a W-8BEN. The White lawsuit argues that Mercor's control over hours, pay rates and screen monitoring makes experts employees. As of September 30, 2026, we found no court ruling on that.
What is the Mercor lawsuit over pay about?
White v. Mercor.io Corporation (N.D. Tex., No. 6:26-cv-00201) says Mercor misclassifies its workforce. It seeks damages under 26 U.S.C. Section 7434 for Forms 1099-NEC it calls fraudulent, pay for Insightful hours Mercor deducted and for required work outside Insightful, and benefits under any ERISA plan Mercor maintains. Mercor wants the case sent to individual arbitration; as of September 30, 2026, we found no ruling.
What do Mercor reviews and complaints say?
As of September 30, 2026, the Better Business Bureau lists Mercor as not accredited, with a C+ rating that it attributes to a “failure to respond to 1 complaint(s) filed against business.” That complaint, filed July 4, 2026 and marked unanswered, says only a small part of about 15 hours of onboarding and project work was paid and questions the monitoring of a personal computer. Reviews on the same BBB page range from “the best AI training company I have been with” to complaints about onboarding tools that did not work and time that went unpaid.
How do I spot a Mercor scam?
Start from Mercor's own channels, not the message: log in at work.mercor.com yourself to see real offers, and write to support@mercor.com if unsure. Work addresses ending in @mercor.expert come with project tools after an offer is accepted, and the breach notices came from mercor@notifications.cyberscout.com. A request to pay for a job, or to deposit a check and send money back, is what the FTC calls a scam.
Was my data in the Mercor data breach?
The practical test is whether you received a notice. Mercor says that of its nearly five million experts, “only a very limited subset” had sensitive information affected; its filings with the Texas and Washington attorneys general list Social Security, driver's license and passport numbers among the data. Notices went out by email on June 25 and 26, 2026. The full picture is on our Mercor data breach lawsuit page.
What is worth doing right now?
If you received the June breach notice, the notice set the enrollment deadline for the free monitoring at October 1, 2026 and says the code stops working after that date — if that date has not passed, enroll now; if it has, call the number in the notice, 1-844-507-8047, and ask whether you can still enroll. Either way, freeze your credit at Equifax, Experian and TransUnion; bureaus may not charge for it. If you work through Mercor in the U.S., keep your offer letters, Forms 1099-NEC and payout records; they show your rate, hours and tax treatment if the pay case ever reaches a class stage. And check every new offer by logging in yourself.
Separate from this case: were you injured in the last 2 years?
Class-action payouts are fixed amounts through an administrator. A personal injury claim is a different case — and often worth far more. Free estimate, no obligation.
