What Bland v. Humana Is About

Bland v. Humana Inc. is a proposed Humana class action under the Telephone Consumer Protection Act. According to Humana's own summary of the complaint, the plaintiff says a call center hired by Humana phoned the plaintiff's residential number on February 1, 2025, September 18, 2025 and October 16, 2025, even though the number was on the National Do Not Call Registry.

The lawsuit alleges the calls used spoofed caller IDs and a made-up name, “Medicare Help Centre,” and that the third call was transferred to a Humana agent who tried to sell the plaintiff a Humana Medicare policy. The claims rest on the TCPA's Do Not Call and caller-ID rules (47 U.S.C. § 227(c)(5) and 47 C.F.R. § 64.1200(d)). The complaint proposes three classes, including a National DNC Class and an Internal DNC Class.

Humana denies liability. Its position is that a third-party vendor made the calls, that nothing ties Humana to the first two, and that one call is not enough for a Do Not Call claim.

Case Details

Bland v. Humana Inc., No. 1:26-cv-00659, U.S. District Court for the Middle District of Pennsylvania, Judge Karoline Mehalchick. Filed March 16, 2026; Humana was served April 7, 2026. On May 19, 2026 Humana moved to dismiss with prejudice, and also moved to strike the class definitions, to split discovery into three phases and to stay the case. On May 29, 2026 the plaintiff asked for more time to respond.

In re Humana and Centerwell Data Security Incident Litigation, No. 3:26-cv-00167, U.S. District Court for the Western District of Kentucky, Judge Rebecca Grady Jennings. On August 21, 2026 the court merged six breach suits filed March 11–17, 2026 (Norris, McKinney, Harn, Friedman, Toor and Meaney-Grube) and gave plaintiffs 45 days to file one consolidated complaint.

Barrows v. Humana, Inc., No. 3:23-cv-00654, also Western District of Kentucky before Judge Jennings — the Medicare Advantage AI claim-denial case.

David Elliott v. Humana Inc., Western District of Kentucky — an older TCPA class action. The district court certified a class, and on December 30, 2025 the Sixth Circuit refused to hear Humana's appeal of that order, per Humana's 10-Q.

In re Humana Inc. Securities Litigation, No. 1:24-cv-00655, District of Delaware, Judge Jennifer L. Hall — a shareholder case, not a consumer case.

Closed: Farmer v. Humana Inc. and Cotiviti over a 2020 breach at a records-review subcontractor (64,654 people) was settled in 2022.

Status: Five Open Cases, No Consumer Settlement

As of October 6, 2026, there is no Humana settlement of any kind open to consumers. No fund, no administrator, no claim form, no deadline.

Bland (Do Not Call): early stage. Humana's motions to dismiss, strike, bifurcate and stay were filed in May 2026; we could not verify any ruling on them. No class has been certified.

Humana data breach: consolidated on August 21, 2026; pleadings stage. Humana says it learned on September 29, 2025 of unauthorized access in August 2025 caused by a vendor's software vulnerability.

Barrows (AI denials): the furthest along. Humana has answered (amended answer August 26, 2026), plaintiffs filed a second amended complaint September 29, 2026, and their class-certification motion was scheduled for October 15, 2026.

Elliott (TCPA): class certified; the Sixth Circuit denied Humana's appeal petition on December 30, 2025, so the case continues in Kentucky. No settlement.

Securities case: on April 27, 2026 Judge Hall substantially denied Humana's motion to dismiss; it is in discovery. It concerns shareholders only.

Which Case, If Any, Includes You

Do Not Call case: the proposed classes target people on the Do Not Call Registry, or people who asked to stop, who still got Humana Medicare sales calls. Nothing is certified, so nobody is a class member yet. If you get these calls, write down date, time, the number shown and the name the caller used.

Data breach case: the proposed class is people whose information was in the incident. Your proof is a notice letter from Humana or CenterWell. Humana has not disclosed a total count; the Texas attorney general listed 4,618 Texans notified.

AI denial case: Humana Medicare Advantage members whose post-acute care (rehab, skilled nursing) coverage was cut off. You do not sign up for any of these cases. If a class is certified or a settlement is reached, a court-appointed administrator sends notice.

Is There Money? Not Yet

No settlement, no fund, no claim form in any Humana consumer case as of October 2026. Nobody can tell you an amount.

What does exist is the breach notice offer: per Humana's notice, 24 months of free credit monitoring and identity restoration through Equifax, with enrollment open until March 31, 2027. That is a company offer, not a settlement payment.

The one Humana data breach that did settle is old: the 2020 Cotiviti incident. That deal offered up to $5,250 in documented losses (up to $250 ordinary, up to $5,000 extraordinary) plus two years of credit monitoring; the objection and opt-out deadline was November 15, 2022. It dates from 2022 and says nothing about what the 2026 case will pay.

Five open cases, a breach notice and a Medicare sales season make an easy cover story:

“Medicare Help” callers who end up selling a plan

The Bland complaint describes exactly this: a spoofed number, a generic name, then a transfer to a plan agent. Do not give your Medicare number to an unsolicited caller. Hang up and call the number on your member card.

“Claim your Humana settlement” pages

There is no Humana settlement open to consumers. A site asking for your Humana ID, Social Security number or a fee to “secure your payment” is collecting data, not filing a claim.

Fake credit-monitoring enrollment links

The real Equifax offer is free and is described in your Humana or CenterWell letter. Enroll only from that letter. Nobody legitimate charges for it or asks you to confirm your Social Security number by text.

Humana Lawsuit — Questions People Actually Ask

What is Bland v. Humana about?

It is a proposed class action under the Telephone Consumer Protection Act, case No. 1:26-cv-00659 in the Middle District of Pennsylvania. The lawsuit alleges that a call center working for Humana made Medicare sales calls to a number on the Do Not Call Registry using spoofed caller IDs. Humana has moved to dismiss.

Is Bland v. Humana related to the Humana data breach?

The shareholder case, In re Humana Inc. Securities Litigation in the District of Delaware, alleges misstatements about Medicare Advantage costs and Star ratings. On April 27, 2026 the court substantially denied Humana's motion to dismiss, finding falsity adequately pled for 42 statements. It is in discovery, with no settlement.

What should I do right now?
