Did a One-Way Video Interview for an Illinois Job? HireVue's $3.75 Million Settlement Estimates $150 — and Its Class Window Stayed Open Until Six Weeks Ago

Deyerler v. HireVue covers anyone who completed an interview on HireVue's video platform in Illinois between January 27, 2017 and June 25, 2026. That is a nine-and-a-half-year window that closed this June, not years back — so an interview you did this spring can still count. Claims close October 13, but the deadline to opt out or object is two weeks earlier, on September 28.

What the case says HireVue collected

HireVue runs the automated video interview platform many employers use for first-round screening: you record answers to prompts on your own, with no human on the other end, and software processes what you submit. The lawsuit alleges the platform collected voice and facial biometric information from Illinois candidates without the written disclosure and written consent that Illinois's Biometric Information Privacy Act requires.

The case is Deyerler, et al. v. HireVue, Inc., Case No. 2026LA00000141, in the Circuit Court of Lake County, Illinois. Defendant has agreed, in the administrator's words, "to create a $3,750,000.00 Settlement Fund for the Class Members."

The class definition, verbatim from the official site, is people who completed an interview through HireVue's video interview platform "that involved a model that may have collected your 'voice and facial biometrics'" in Illinois between January 27, 2017 and June 25, 2026.

Read that clause carefully: the qualifier is a model that may have collected biometrics, not one that provably did for you personally. You are not being asked to prove what the software did with your face.

A class window that runs to June 2026 is unusual

In most class actions the class period ends at or near the filing date, which is typically years before you read about the settlement. The Farmers Do-Not-Call case we covered yesterday cut off in June 2026 as well, but that is the exception; the patient-portal settlements from the same week close their windows in 2023 and 2024.

Here the window runs nine years and five months and ends June 25, 2026 — about six weeks before this article. If you did a HireVue interview for an Illinois position this past spring, you are inside the class. That is worth saying out loud because the instinctive assumption is "this is about something that happened years ago, it can't apply to me."

The geography test is Illinois. The statute at issue, 740 ILCS 14, is an Illinois law, which is why an identical interview taken from another state does not qualify.

$150.00 is an estimate, and here is the arithmetic under it

The administrator does not oversell it. Verbatim: "The amount of each valid claimant's payment is estimated to be $150.00, but the exact amount is unknown at this time and depends on several factors, including how many valid claims are submitted." Each eligible claimant receives an equal share after administrative expenses, attorneys' fees and service awards come out of the fund.

Class counsel will request attorneys' fees "of up to one-third of the Gross Settlement Fund, plus reasonable expenses" — up to about $1,250,000 of the $3,750,000. The three class representatives will each apply for up to $6,000, or $18,000 together.

Our arithmetic, not the administrator's: $3,750,000 minus roughly $1,250,000 in fees and $18,000 in service awards leaves about $2,480,000 before expenses and administration. At $150 apiece that supports on the order of 16,500 paid claims. File in larger numbers than that and the per-person figure comes down; file in smaller numbers and it goes up.

For context on what the law itself contemplates: BIPA provides liquidated damages of $1,000 for each negligent violation and $5,000 for each intentional or reckless violation (740 ILCS 14/20). A $150 estimated share is about 15 percent of the lower statutory figure — which is the ordinary shape of a class settlement, not a scandal, but it explains why the number is $150 rather than $1,000.

No notice email? You can still file, with documentation

Many people who interviewed years ago no longer use the email address the notice would have gone to. The FAQ addresses this directly: class members without an email notice can "submit a claim with your interview documentation" and the administrator will determine eligibility from it.

In practice that means anything showing you completed a HireVue interview for an Illinois role in the window — the confirmation or invitation email from the employer or from HireVue, a calendar entry, the application record. Unlike the YouTube TV settlement, which locks its online form behind a LoginID and PIN, this one leaves a documented path open for people the notice never reached.

The dates, and the one that comes out of order

The deadline that lands first is not the claim deadline. September 28, 2026 is the last day to opt out of the settlement or to object to it. October 13, 2026 is the claim filing deadline. The final approval hearing is October 28, 2026 at 9:00 a.m. CT in Lake County, Illinois.

The practical consequence: the decision to keep your right to sue HireVue individually has to be made two weeks before the deadline for taking the money. If you are still weighing whether $150 is worth releasing that claim, September 28 is the date that actually binds you, and after it passes the only remaining choice is file or get nothing.

As with every settlement on this calendar, approval is not payment. Nothing is distributed until the court grants final approval and any appeals are resolved.
