Five Different Fights Under One Name
“Epic Games lawsuit” covers cases that have almost nothing in common except Fortnite.
1. The FTC case (2022). According to the FTC, Epic used design tricks known as dark patterns to charge players for purchases they did not want, let children run up charges without a parent’s permission, and locked some accounts after players disputed charges. Separately, the FTC alleged that Epic collected personal information from children under 13 without parental consent. Epic agreed to pay $520 million: a $245 million refund order and a $275 million COPPA penalty. Only the $245 million pays players.
2. Epic v. Apple. Apple and Google both removed Fortnite from their app stores on August 13, 2020, after Epic changed how players could buy V-Bucks, and Epic sued. Epic largely lost against Apple, but a 2021 ruling barred Apple from stopping developers from pointing users to other ways to pay. In April 2025 the trial judge found Apple had violated that order.
3. Epic v. Google. A jury sided with Epic in December 2023, finding Google’s Play Store practices anticompetitive.
4. Player class actions. In March 2025, two parents filed a proposed U.S. class action alleging that Fortnite’s Item Shop countdown timers were deceptive. In September 2026 a Dutch foundation began a mass claim on behalf of young Dutch players.
5. Addiction lawsuits. Families have filed personal-injury suits alleging that popular games, Fortnite among them, were designed to be addictive for children. Every claim above is an allegation unless a court has ruled on it.

FTC refunds: a $245 million FTC administrative order, finalized in March 2023. The refund administrator is Rust Consulting, reachable at 1-833-915-0880. The $275 million COPPA penalty came through a separate federal court order filed by the Department of Justice.

Status on September 30, 2026: Nothing New to File
Apple — at the Supreme Court. On December 11, 2025 the Ninth Circuit upheld the contempt finding but reversed parts of the sanctions, including the outright ban on any Apple commission on purchases made through outside links. On June 30, 2026 the Supreme Court agreed to hear Apple’s appeal, limited to one question about contempt. Apple filed its brief on September 14; Epic’s is due November 13, 2026. No argument date appears on the docket yet. On August 13, 2026, Justice Kagan refused Apple’s request to pause the trial court proceedings.
Google — verdict stands, deal withdrawn. The Ninth Circuit affirmed the verdict and injunction on July 31, 2025, and the Supreme Court let the order take effect in October 2025. A settlement announced in November 2025 and revised in March 2026 needed Judge Donato’s approval; according to Gizmodo, Google and Epic withdrew it in July 2026 after the judge voiced skepticism. In August 2026, Aptoide Games became the first rival app store offered inside Google Play in the U.S.
Player lawsuits. The Dutch claim is at the demand stage: SMC served Epic with a notice of liability and offered to negotiate. For the U.S. Item Shop timer suit and the addiction suits, we found no settlement and no claim form.

Which Case Could Involve You
FTC refund: it covered players charged in-game currency for items they did not want (January 2017 to September 2022), parents whose child made charges to their card without their knowledge (January 2017 to November 2018), and players whose accounts were locked after disputing charges (January 2017 to September 2022). It only helps you now if you filed by July 9, 2025. No new claims are accepted.
Apple and Google cases: you are not a party and cannot join. Their outcome changes how app stores handle payment links, fees and rival stores. It does not send money to players. Dutch claim: SMC represents Dutch players who played Fortnite before age 21. It does not cover U.S. players.
U.S. Item Shop suit and addiction suits: there is nothing to sign up for. The addiction cases are individual personal-injury suits, not a fund you join; a class action includes you automatically if a class is ever certified or a settlement is reached, and notice would come from a court-appointed administrator.

The $275 million COPPA penalty is a civil penalty, not a refund fund. No player or parent receives any of it.

Three Things to Watch For
A famous brand, young players and a refund that has been “coming in 2026” for over a year is a combination scammers exploit:
“Join the Epic Games class action” ads
The class action in the September 2026 news is Dutch and covers only Dutch players. There is no U.S. claim form for it. A site asking for your Epic login, card number or a fee to “join” is collecting data, not filing anything.
“Your Fortnite round 3 refund is ready” messages
Claims closed July 9, 2025, so any invitation to file one now is fake. Real payments go only to people who already filed, as a check or PayPal payment. The FTC never demands money; the refund administrator’s number is 1-833-915-0880.
Free V-Bucks or an “App Store refund” from the court cases
FTC refunds are paid in real money, not V-Bucks. The Apple and Google cases pay no consumer anything, so a message offering you a share of an Apple or Google ruling is invented.

When is the third Fortnite refund round?
The FTC says it expects to send additional payments in 2026 once all claims are validated. As of September 30, 2026 it has announced no date and no amount. The FTC refund page is the only authoritative source; our Fortnite refund page tracks it.
What is the Epic Games lawsuit in the news in September 2026?
A Dutch consumer foundation, Stichting Massaschade & Consument, is seeking over €100 million for Dutch players who played Fortnite before age 21. It points to the Dutch regulator’s 2024 fine of €1,125,000 over Item Shop pressure tactics, which a Rotterdam court upheld in January 2026. Epic says the Item Shop has no timer and that parents can require a PIN for purchases. The claim does not include U.S. players.
What is the Supreme Court deciding in Apple v. Epic Games?
Only whether a court may hold a party in civil contempt for violating an injunction’s “spirit” when the order is silent about the conduct. No. It is a civil penalty for alleged children’s-privacy violations. According to the FTC, the settlement also required Epic to turn voice and text chat off by default for children and teens. Only the separate $245 million refund order pays players.
