Mohammed Amin, et al. v. California Casualty Indemnity Exchange d/b/a California Casualty Group, Case No. STK-CV-UBT-2026-0003331, Superior Court for San Joaquin County, California, Judge George J. Abdallah, Department 10A. The settlement over the September 2–8, 2025 intrusion at the insurer offers $50 with no proof or up to $4,000 for documented losses, plus two years of credit monitoring. The settlement agreement, now readable on the official site CACasualtyDataSettlement.com, answers the question our August 31 report had to leave open: “Defendant will pay for all timely and valid claims.” There is no shared fund to split. As of October 17, 2026, the deadline to opt out or object is November 4, 2026, the claim deadline is November 16, 2026, and the final approval hearing is December 4, 2026.

California Casualty Will Pay Every Valid Claim — the Settlement Agreement Sets No Cap on the $50 and $4,000 Payments. The Opt-Out Deadline Is November 4, 2026; Claims Are Due November 16. — key figures at a glance

The short answer: no cap, and no pool to split

If you got a notice about the california casualty data breach settlement, the most useful new fact is in the settlement agreement itself, which the administrator, Simpluris, now serves from the site’s documents page. Section 52 reads: “Monetary Benefits. Defendant shall pay for the following monetary benefits. Defendant will pay for all timely and valid claims.”

That makes this a claims-made settlement with no fixed fund. In most data breach deals, a pool of money is divided among claimants, and the advertised flat payment shrinks if many people file. The agreement we read describes no such pool and no pro-rata reduction. A valid $50 claim is meant to be paid as $50, and a documented claim up to $4,000. When we reported on this case on August 31, 2026, the documents page would not load for us, so we could not confirm this. As of October 17, 2026, it is in the agreement’s text.

The costs also sit outside the payments to class members. The agreement caps the fee and cost request at $168,000.00 and the service awards at $3,000.00 for each of the three class representatives. California Casualty pays both separately, and the agreement says the service award amount “was negotiated after the benefits to the Settlement Class were negotiated.” The settlement also includes security commitments. The company will give class counsel a confidential declaration on “its information security enhancements since the Data Incident,” and it pays for those enhancements “separate and apart from all other settlement benefits.”

Who gets what, and when the money would move

Every class member can enroll in two years of CyEx Financial Shield Complete credit monitoring, which comes with “$1 million of financial fraud insurance,” and can also choose one of two cash options:

  • $50.00 flat. No documents are needed. The agreement says you “may claim both the Alternative Cash Payment and also Credit Monitoring Services.”
  • Up to $4,000.00 for documented losses, such as fraud losses, credit freeze fees, professional fees, postage and mileage. The losses must have occurred between September 2, 2025 and November 16, 2026. You need receipts, bank statements or other “third-party documentation.” Handwritten notes can add clarity but are “insufficient by themselves.”

There is a safety net for the second option. If the administrator finds your paperwork lacking, you get 21 days to fix it. If you don’t, you “will automatically receive the Alternative Cash Payment.” A weak documented claim still pays $50. You can appeal a final deficiency decision within another 21 days.

On the printed claim form you choose how to be paid: PayPal, Venmo, Zelle or a check. The money will take time. Payments come only after the court grants final approval and any appeals end. The agreement then gives California Casualty until the later of 45 days after the administrator’s accounting of approved claims or 30 days after the “Effective Date” to send the funds. If no one objects, the Effective Date is the day after the final approval order. Our estimate: even with a clean approval on December 4, 2026, payments are unlikely before early 2027. The site gives no date. Cash a check quickly. The agreement says checks carry a legend that they expire within 90 days of the issue date, and reissued payments are good for 60 days.

What to do, and the deadlines

To get paid: file online at CACasualtyDataSettlement.com by November 16, 2026, or mail the form postmarked no later than that date to California Casualty Data Incident Settlement, c/o Settlement Administrator, P.O. Box 25226, Santa Ana, CA 92799. If you do nothing, the FAQ says “you will not receive a benefit from this Settlement,” and you still give up your claims.

Can you sue due to a data breach? In this case, you can sue on your own only if you opt out. The FAQ says that if you exclude yourself, “you will keep any rights you may have to sue California Casualty on your own about the legal issues in this case,” but you get no settlement payment. The deadline to exclude yourself is November 4, 2026. The request must be signed, include the case name and number and your contact details, and say “Request for Exclusion” or something equally clear. You can only exclude yourself, not anyone else. Objections are due the same day and require proof that you are a class member, such as your notice.

Court schedule: the preliminary approval order requires class counsel to file the motion for final approval and the fee application “At least forty-five (45) days before” the hearing. By our count, that is October 20, 2026 for a December 4 hearing. The hearing is set for December 4, 2026 at 9:00 a.m. Pacific in Department 10A, 180 E. Weber Avenue, 2nd Floor, Stockton, California 95202. The court can move it without new notice, and any change will be posted on the settlement website.

Is the notice real or a scam?

The court appointed Simpluris as administrator. The official site is CACasualtyDataSettlement.com. Its contacts are (833) 360-6751 (toll-free, 24/7), info@CACasualtyDataSettlement.com, and P.O. Box 25226, Santa Ana, CA 92799. The site lists the settlement notice mailing as 8/17/2026. Before acting on any message about this settlement, check that it matches these details.

Don’t confuse two separate mailings. The company’s own breach letter from late 2025, filed with the California Attorney General, used a Kroll return address. It offered two years of Experian IdentityWorks and listed a call center at 1-844-354-7528. That was California Casualty’s notice of the breach. The 2026 settlement notice comes from Simpluris, and its credit monitoring is a separate CyEx product. Getting the first letter does not file a claim. The FAQ advises that you “Do not contact the Court or Clerk of Court regarding this Settlement.” Questions go to the administrator.

Was there a major data breach? What the state record shows

The breach is on public record, though no official source we read gives its size. The California Attorney General’s breach list shows California Casualty Indemnity Exchange with breach dates of 09/02/2025 and 09/08/2025, reported 11/19/2025. The sample letter filed there says “an unauthorized person accessed our IT network between September 2 and September 8, 2025, and, during that time, copied some of our files,” and that on November 5, 2025 the company determined which personal data a file held. The letter covers four companies: California Casualty Indemnity Exchange, California Casualty Insurance Company, California Casualty & Fire Insurance Company, and California Casualty General Insurance Company of Oregon. According to the settlement site, the data may have included names, Social Security numbers, passport numbers, driver’s license numbers, medical and health insurance information, and financial account or card numbers.

The lawsuit started in federal court. The agreement says the lead plaintiff filed in the Northern District of California on December 2, 2025, and two other plaintiffs filed a related federal case. The parties mediated at JAMS on March 13, 2026, and the settled case was filed in San Joaquin County Superior Court on or about May 5, 2026. California Casualty denies wrongdoing, and the court has not decided who is right. The settlement website, notice, agreement and state listing we read on October 17, 2026 do not state how many people are in the class. The small fee cap fits a small class, but that is our inference, not an official count.
