What the Lawsuit Claimed

Nicholas Brown, who bought a Brita Everyday Water Pitcher with the Standard Filter for about $15 in Los Angeles in 2022, filed a putative class action alleging Brita's packaging and marketing — phrases like "BRITA WATER FILTRATION SYSTEM," "Cleaner, Great-Tasting Water," and "REDUCES Chlorine (taste and odor), Mercury, Copper and more" — led consumers to believe the filters remove or reduce all common contaminants hazardous to health to below lab-detectable levels. Brown claimed Brita's filters do not do this for arsenic, chromium-6, nitrate/nitrites, PFOA, PFOS, total trihalomethanes, and uranium (the "Common Hazardous Contaminants"), and sued for violations of California's Unfair Competition Law, False Advertising Law, and Consumer Legal Remedies Act, plus breach of warranty and unjust enrichment. Case Details

Nicholas Brown v. The Brita Products Company, No. 2:23-cv-07851-DMG-RAO, U.S. District Court for the Central District of California (Hon. Dolly M. Gee) — originally filed August 18, 2023 as Case No. 23STCV19534 in Los Angeles County Superior Court, then removed to federal court by Brita on September 20, 2023. On appeal: No. 24-6678, U.S. Court of Appeals for the Ninth Circuit (Judges Kim McLane Wardlaw, Ana de Alba, and Eric C. Tung). There is no settlement administrator, no official claims website, and no hotline — because there is no settlement.

Current Status: Case Closed, Dismissal Affirmed

On April 16, 2026, a three-judge Ninth Circuit panel unanimously affirmed the district court's dismissal of Brown's entire complaint, in a published opinion written by Judge Wardlaw. The court held that "a reasonable consumer would not expect a fifteen-dollar water filter to 'remove or reduce to below lab detectable limits common contaminants hazardous to health' in tap water, notwithstanding clear disclosures to the contrary." The panel also affirmed the district court's decision to deny Brown leave to amend his complaint, calling any further amendment futile. That makes the dismissal final at the Ninth Circuit level. As of August 2026, there is no public record of Brown filing a petition for rehearing en banc or a petition for certiorari to the U.S. Supreme Court — the case appears closed.

Who Can File a Claim? Nobody — There's No Class and No Fund

Scam Alert: There's No Brita Settlement to "File For"

Because the case made headlines in 2023 and is easy to confuse with genuine, still-open settlements, some websites and messages exploit that confusion. Three patterns to watch for:

"File your Brita settlement claim now" pages

Several low-quality legal-content sites publish articles implying there's an active Brita settlement with a claim form to fill out. As of August 2026, there is no such settlement — Brita won this case outright. Don't submit personal information to any page claiming otherwise.

Requests for your Social Security number or bank details

No legitimate settlement claim ever requires payment upfront, and there's no legitimate claim at all here. Anyone asking for your SSN, bank login, or a processing fee to "release" a Brita payment is running a scam. Report it at ReportFraud.ftc.gov.

Confusing this case with unrelated PFAS or Clorox settlements

PFAS ("forever chemicals") litigation is active against many companies — including large, separate cases like the AFFF firefighting-foam MDL.
